DX Thanks, this debt relates to a credit card for which the company sent me a default notice in 2000, I then arranged payments through a DMC, these continued until 2002 when I could no longer afford any payments. since then I have not made or arranged any further payments or acknowledged this. Activ kapital has since bought this debt and has been hounding me with phone calls, which to date I have completely ignored. They really know how to make your day don't they? Thanks again.
  2. Shadow Thanks very much for your advice, I'll get onto it right away. Should I send a statute barred letter and also a letter stating the data protection act in the same envelope? I'm a numpty, I completely forgot there are 3 agencies as all my info except that one seems to be on the one. I suppose I'll have to sign up to them all, as if activ Kapital has registered DN's with one they've probably registered with them all. Thanks again.
  3. I have just accessed my credit files for the first time and have discovered that Activ Kapital have posted default notices on it. The first one in 2004 and then again in August 2008 for the same debt, which originally defaulted in 2002 and I have not acknowledged since then and is now statue barred. Is this legal? is there any way to get this removed? Also I have a store card which I pay every month and there are no problems with it but there is no reference to this account on my credit file, is this normal? Any advice would be most appreciated.
  4. Thanks cerberusalert, that has put my mind at rest a bit. Just one more thing, do I send the CCA letter to SRJ or to Westcot who are their clients?
  5. I hope some one can give me some advice. I received a letter from Wescott a few months back for a debt of £300. As I had no idea what this was about I sent them a "prove it" letter. They replied stating that they would investigate further. I have now received a letter from SRJ Debt Recoveries stating that they are going to start litigation on behalf of their client Wescott - Littlewoods. This makes more sence to me as I had an account with littlewoods in 2003 although £300 is definitely made up of charges. Because I had sent Wescott a "prove it" letter should I now send SRJ an "account in dispute letter" or a CCA letter? After reading through some posts it seems that the solicitors for SRJ are none other than Bryan Carter! Some one posted that Bryan Carter are not allowed to operate in NI, and as I live in NI should I just ignore this letter? If anybody can help I would be very grateful as I'm finding this all very confusing and stressful.

  7. Hi Thanks everybody for helping, I have an update and another question. I sent cca and got reply return of post saying they had closed their files and were returning it all to 1st Credit. Regarding the SD, I rang the court and they told me that there was nothing lodged with them, I am in the middle of trying to find out wether this is satutory barred or not. My question is this I live in Northern Ireland does this make any difference to the laws? Sorry to be such a numpty but I have no clue about this things. Any help would be greatly appreciated. Thanks
  8. HI Thanks for your advice, if I send CCA and also ask why I haven't received a statutory demand will I still be able to apply for it to be set aside even though I haven't received it?????? Any help would be gratefully apprecriated asap. Thanks
  9. Hi this is my first post, I am new to this so please be gentle. Here goes:- I had a loan with Alliance & Leicester years ago and ran into problems with my monthly payments. I contacted them at that stage and they were really unhelpful so I contacted a debt management company to deal with them on my behalf. This worked well for about a year and then Alliance & Leicester started contacting me again demanding more money. Long story short, I got so stressed out with it all that I stopped paying all together, this was in about 2002/03. I have received demands from a few different debt collection agencys from time to time since then but rightly or wrongly buried my head in the sand and ignored them. Today I have recieved a letter from Connaught Collections stating " I write to inform you that we are now in a position to present a Bankruptcy petition against you following the recent delivery of our Statutory Demand". I have not received a statutory demand although interestingly my dad told me that an A4 letter was sent to his address for me about a month ago (he sent it back not at this address) as I have not lived there for 6 years! I am at my wits end and dont know which way to turn, having read through some other posts should I just ignore this letter or should I send a cca?, i'm not sure wether this all started 5 or 6 years ago and don't know if it is statutory barred or not. Can somebody please help as I am tearing my hair out. Thanks
