Hello all, I have been reading the posts on this forum for quite a while now and using the advice as i have had 2 PCNs from Excel Parking Services. The correspondence has occured exactly how many of you tell it - first i got the PCN with photo's of my car. I responded with the template letter instructing them to take it up with the driver. They replied to both letters with various reasons why i should tell them who the driver was or else. I replied to one of the PCN second letters stating i was not obliged to tell them who the driver was, didnt have a contract etc as per template letters. I have since recieved a debt collection letter against both PCNs and i have replied to that referring them back to their principle. I have now recieved a letter from Graham White solicitors as below - and i am wondering on the implications of this letter. Could anyone tell me if i need to respond to Graham White with a letter referring them back to Excel stating the claim is in dispute. I also feel i need to send a cease and desist letter to Excel, however the more i read the letter from Graham White solicitors the more it seems such a poor excuse of a threat - the INTENDED LITIGATION is in capital letters to scare me, it makes no reference to their case against me evidence etc but focuses on how i will suffer if i dont pay them through bad credit records, baliffs etc with a token line at the end to contact them regarding settlement within 7 days. Any advice would be much appreciated as soon as possible. The general jist of the letter is "It is a legal requirement to send notice of INTENDED LITIGATION before legal proceedings are issued in the County Court. This letter fulfills this requirement. Take note the costs associated with issuing a claim are as follows: etc.. Any judgement registered against you would seriously affect your chances of obtaining credit in the future etc..... In the event of a Judgement order not being adhered to we will instruct Baliffs to attend at your addres etc..... Please contact us with your proposals for settlement within 7 days to avoid the possibility of this action." ://i353.photobucket.com/albums/r398/improveddc/image.jpg
