  1. Hi, Back in May RW sent me formal demand for a Debenhams account. I requested a copy of CCA & statement of account but since my request they have never been able to provide me with any documents relating to that account. Today I received a letter from them offering to reduce the outstanding amount from £3000 to £1500 with a possibility to repay over 3 years. I want them to reduce the debt even further but how can I do that as until now I have said to them that I had no knowledge of the debt?? Can anyone help?? Thank you,
  2. Hi There, Thank you for your reply. Just a couple of questions: 1)Do I still need to CCA Debenhams despite having done that already with RW? 2) Where can I find a sample letter for a S.A.R? what kind of information do I need to provide to them? Thank you so much all for your help
  3. Hi All, I will do my best to keep it short. Back in May Robinson & Way sent me a demand of payment for a Debenhams account. I then sent them a CCA request and Notice of Assignment early June, but never received anything and after the 12+2+30 delay passed I sent them a letter and they sent me back the £1 postal order but they kept sending letters for demands of payment for the debt to which so far they have not been able to bring one single proof. I sent them another letter to say to them that I will no longer communicate with them until the day they can show me proof that the debt belongs to me. I recently received another letter from them requesting that I provide them with my past addresses for the last 6 years (which I will not do!!!) and I have noticed that they have made an unrecorded search on my Credit File. Can anyone advise what should be my next step??? Thank you,
  4. Thank you, Can the CCA be unenforceable simply by sending me the wrong year of the Terms & conditions? they did send me a statement of account. The 30 days is up on the 20th July, what kind of letter would I need to send to Capquest and justify that it is not a true CCA? If I was in a position to offer a Full & Final Settlement, am I still allowed to go back to the original creditor (intelligent finance)and make an offer?? Lots of questions I know... Thank you
  5. Thank you for your reply, The document that you see, I have typed it myself as I was unable to scan it, I was trying to reproduce it word for word. The Halifax Plc address appears on the agreement. They did sent me a statement of account and a booklet 2001 and not 2000 which is basically their terms & conditions for their bank account, credit cards, loan etc... The document is indeed titled : Credit Agreement Regulated by the Consumer Credit Act 1974 Do you think it is still enforceable? Thank you
  6. Hi everyone, Having difficulties scanning a CCA that I have received from CapQuest regarding a debt from Intelligent Finance taken over the internet back in 2001, I have reproduce word for word the document. i would really appreciate your opinion and let me know if the CCA that they have send me is an enforceable CCA. I would like to add that they also sent me the application form of that debt. Thank you very much:) CCA 1.doc CAC2.doc

  9. Hi all, am new to this site and any help would be appreciated. A few weeks ago I requested the CCA for a debt with Intelligence Finance, which was taken over the internet back in October 2001. Over the week end I received some documents from Capquest but I am not sure if they have sent me a true CCA. The documents consist of 3 pages, the first one tiltled "Conformation of Application Details" which has all my details (address, occupation, DOB, Salary..etc) followed by a section about (declaration, data protection, credit scoring) and my signature and a 3rd page titled "Credit agreement regulated by CCA 1974" with the loan amount, charge for credit, total amount payable, APR, and amount over 72 months. At the back of that page a small section about my rights and a final section which says " This is a Credit Agreement regulated by CCA 1974, sign it if you want to be legally bound by its terms" and my signature. Is that a true CCA? would anyone know what am suppose to look for? It seems to me that it is just the application form that they have sent me!! Thank you so much for your help
