Doh sorry! I've put them on photobucket, 5 parts are the CCA and the other is the letter asking for my signiture in response to the Data information request. Thanks http://s584.photobucket.com/albums/ss290/thk1111/

The CCA that they sent me is attached, are they allowed to only sendme the 1st three sections? Or does it have to be the full CCA? Also they sent me a postcode this morning telling me that they will be calling me next week and I need to call them if it is not convenient for them to contact me!

Attached is the letter I sent asking for all the info they have on me so I can see how much of the balance is charges and the reply they sent asking for my signiture which I will not give them. I asked for the info again on the phone last night and the rude mans response was that I am just trying to waste time and interest and charges are still building up and that he would not send me anything and I must pay now over the phone to him! I told him to get ####ed and hung up on him, he called me back straight away and I told him that I hung up on him cos I did not want to speak to him, he said that he knew that I put the phone down on him and he was just ringing me back to say what a #~~# I was! I told him to eff off again and hung up once more. Now what should I do? the 40 day deadline has passed and they are refusing to send me the information they have on me. Do I report them? CCA they sent me to follow in next post... MBNA3.doc

Thankyou for your speedy reply. It is dated before April 6th, so what does this mean for me?

It's april 2007, I've just had a look at the original agreement that they sent me and there is only sections 1-3 of it, it was an internet application and they have not sent me the full original CCA?

Hi Here is where I am at now with these... I feel that I now need to push on with things as they are now saying that they will commence with court action, so would be grateul if people could help below with these 3 things: I told them that I was not prepared to pay their extortionate interest rate which they have cranked it up to, they say that If I bring my acount upto date then they will then discuss the interest rate and charges with me and not until then; I'm not going to fall for this as I know they are just saying anything to get money out of me, what is the best way to challenge the interest rate? I have received a copy of a CCA which I beleive is genuine but should I still scan it up on here anyway? Also I SAR'd them and the 40 day limit has expired too for them to provide the information I asked for, all I received from them is a letter saying that I must send them my signiture, I phoned them up to tell them I was not prepared to send my signiture and they said it will be in the post but they have just ignored me, so have they now defaulted and what should I do? Please advise cos I'm unsure of what to do next, I have no money to pay them which they can't get into their thick heads and I also have other creditors hassling me too which I need to seek help with. Thanks THK

Hi Well it is January 13th and still no sign of a CCA. So far over the last fortnight just 'you must pay now' letters and twice daily phone calls from my friends in the Indian call centre. At first I was not bothered by the calls, if I have time I try to keep them on the phone as long as possible to stop them harassing somebody while I am wasting their time who is scared of these calls. But I never get past the security questions with them, I always seem to forget the answer and give an incorrect response although I am fed up with them now they are getting boringly repetitive and I want a stop to them. I am not sure what to do next, do I send them anything or just sit back and wait to see what they do?

There is no way though that they should be passing my answers to security questions such as place of birth, mothers maiden name, etc to anybody especially to people the other side of the world inside a third world country. CCA request will be posted tomorrow so how long do they get to respond due to xmas and new years hols?

Just a thought... how and why do an outsourced indian call centre know the answers to my security questions? Is this against the data protection act and should I complain?

I have just printed off a CCA request letter, I feel I need to push on with things as I keep getting phone calls and letters from aegis but I accidently answer all the security questions incorrectly so they can't continue with the call Who do I send the letter to MBNA or AEGIS?

Hi, update on where I am with these, and help needed... Because I refuse to pay the charges and stupid interest rate I have cancelled the direct debit and have been hit with 3 x £12 charges again, obviously I won't be paying these to them either. Got a letter from AEGIS (same address so MBNA in disguise?) and a missed call from them too. What I want to know is how to challenge their incredible interest rate hikes from an average rate to the ridiculous percentage it is now? And if you can and how to claim back this unfair rate? Currently it is 2.2071 a month but I don't know how to work it out, I am guessing its around 30% Also I want to know how to claim back these charges? I think there is about 10 x £12 in all Cheers THK

Thanks steve for your reply Thats what i thought, what date did the credit card companies and other financial companies realise that they must issue and hold onto legal CCA's? I may still try though cos as said on my opening post this is the one financial company that i have had the displeasure with being associated with that I really really hate and I would love to get revenge. The question I have though is... I don't give a f##k about MBNA but would this put other creditors on 'alert' that I would like to stay on good terms with? MBNA is the only card I have maxed out,(and will never pay it off cos of the astronomical interest rate that they have increased it too), so I have room on other cards to transfer or should I look for a 0% into offer with someone else? Please can you direct me with a link to a thread on how to reclaim credit card charges as i only haveclaimed back from banks in the past and not sure how to with credit cards

    I loathe MBNA!!

Hi My bank returned the direct debit last month as I did not pay money into my bank account until after midday on the date it was due to come out, the day after I realised it had bounced and I immediatly paid the minimum payment + a little extra. A few weeks later I have received my monthly statement and see that they have fined me 3 x £12, = £36 . One for return payment default sum, one for return payment late default sum and on overlimit default sum (overdrawn bcause of the other 2 charges ). I was expecting one £12 but x3 is a joke I have a few credit cards but this is the only one I really hate and wish I never took it out, I remember the original APR was reasonable and inline with other CC's rates but every few months since then I receive a letter saying my APR is increasing and now they have increased it so high that it is stuck at its limit and I don't think I will ever pay it off. The interest is in monthly % figures so I don't know how much it is compared to other lenders :? My other debt I am happy to try pay off and maybe with this one I should try and do a balance transfer to a different Credit Card but I feel that MBNA took the p#ss with the APR increases and now these charges and because of this I would not feel guilty at all if I had the fortune of being able to tell them the debt is unenforceable, but the card was taken out in spring 2007, so they are likely to have a CCA, right?

    Natwest

Hi Yesterday I went overdrawn when a £50 direct debit came out with only £40 in my account leaving Me £10 overdrawn, so I paid £60 in as soon as I realised this that day to get rid of the overdrawn tenner plus get me £50 in the black. I thought this was problem solved but this morning I see that they have charged me £38, have now rejected the direct debit evebn though they could see i made an attempt to rectify this asap. I've stuggled this month to keep my head above water and a £38 charge is going to hit me hard as it has been taken out of my money that was meant to be used to pay another bill who are also likely to charge me now because of Natwest. I've tried explaining this to my local branch over the phone but they are just like robots with a script of No, no no, there is nothing we can do, read the terms and conditions, blah, blah, blah Whats the best way to claim back just a single charge from them? Surely not worth going to court for? On another topic.......last year I started to make a claim for some natwest charges which I was hit with about 6 years ago, but as soon as my case got stayed I just put the paperwork in a drawer and forgot about it, this charge yesterday and speaking to a stubborn natwest puppet over the phone today has reminded me about it, I wondered if I can resurect my old claim on hardship grounds as although I am in work, i'm self employed in a new business and struggling to make ends meet at the moment and this charge has just made things worse for me. Thanks
  18. Hi I've just been turned down by a couple of the high street lenders after I had never been refused credit before. So I decided to check out my credit file, I have green account satisfactory comments going back years but now I have one late payment fee for a credit card, it was a genuine mistake which is now going to cost me dearly for the next 6 years. I thought I had cleared the full balance in full the month before but there was £15 and a few pence left on the statement, I did not realise my mistake until I received a letter saying that I have failed to make the minimum payment of £5 and here is a £12 charge. I paid the full balance which had now gone to £28 over the telephone immediately after reading the letter, thinking that would be it but now this late payment comment for failing to pay a Fiver minimum payment is going to cripple my chances of getting a normal rate loan for the next 6 years, right? I've been passed onto freedom finance by a loan comnpany I applied to who telephoned me this morning, I gave them all my details but after checking out there website I see that its a secured loan which I do not want and at the bottom in their small prit there is a broker fee of £819 On the amount of loan that I want £5k I would expect to pay only around what they are charging as a fee in interest only but I'm expecting them to come back to me to say I'll have to pay £7-8k+ back including fees and interest if my calculations are correct and there is no way I'm paying that! What is my best option on who to apply for? Or is it going to be the most expensive £5 that I have forgotten ever and I am stuck with these rip off companies until my late payment on my credit file vanishes many years away?
  19. Do you think that Ikonic publications who tried to make out I was in the ESP mag and Vardis who contacted me last week for the Childrens charity are the same people, or have I got two frims trying to con me here? They sound similar over the phone and are both from the manchester area, there 'sales' tactics are very similar. Found this on manchester TS website, great info. Manchester City Council Trading Standards Service Also do a search for Ikonic publications but this is about the most info I can find here http://forums.moneysavingexpert.com/showthread.html?t=486971
  20. Article found on the guardian website.... Time to call advertising conman's bluff I part-run a small business. Since last November, I have been plagued with calls asking if I want to contribute to charities by sponsoring wall charts for the ambulance service, a calendar for firefighters and anti-bullying leaflets for schools. In late March, Education Support Publications in Manchester started to ask for payments: £149 for the firm's name stamped on 20 school books which I did not order. I have had several phone calls including county court threats. How do I get this company off my back? HN, Bournemouth At nearly £7.50 a copy, the 24 page leaflet is hardly cheap. Education Support Publications comes from Ikonic Publications which was set up last October. Its sole director is Andrew Bates. Until his resignation last October, Bates was a director of Carroll-Dillon Publishing, which also specialised in selling high-cost leaflets to firms which, naturally, are attracted to good causes. In Ireland, Carroll-Dillon published a controversial school book on drugs, described by the Irish National Teachers Organisation as "totally unsuitable". In 2006, Carroll-Dillon paid for Ian Bates, Andrew's brother, to stay in a luxury Dublin hotel. Ian Bates moved to Ireland after he was convicted at Manchester Crown Court in 2002 of conspiracy to defraud by selling adverts in an anti-drug book aimed at schoolchildren. Andrew Bates is also a director of Core Media Services which sells similarly priced leaflets on drugs and other issues for schools. The best way to deal with this is to call Ikonic's bluff by telling it to take you to court, where it will have to prove you were a willing purchaser of its expensive leaflets. Unless it has evidence of this, the court will throw out the claim - assuming it gets that far.
  21. Well an hour and half after I wrote my message to say the calls had stopped I get another call, this time they are pretending to be ESP (educational support publications) and they are making out that I sponsered one of their mags in February! As mentioned on a previous post I've only been trading a few weeks so this is impossible. It took me a few minutes on the phone to realise it was them but as soon as they were trying to get me to pay for fake advertising that I hadn't bought I knew it was Vardis or another arm of their group again, so I told him where to go and hung up. A quick search on the internet for ESP and yes people have written about it again I know I've been told to ignore them and TS are already onto them but this is just harassment and I just don't need this. How long is this going to go on for, I'm trying to run a business here
  22. Thought I'd give an update as it would be useful info if anyone else came across these... Since I reported them to TS I have only received one phone call to which I just told them that I had reported them and was going to turn the record feature on on my phone. After which he just started acting an immature fool again on the phone followed by abuse so I just hung up, and I've not heard from them since. Today I was contacted by trading standards who have looked into my case, he said it was a [problem] that they were aware of as many people had already contacted them about it, I am to ignore all contact they try to make to me both written and verbal unless it gets too abusive/threatening then I need to contact them again. He said that they have been contacting businesses initially trying to sell fake advertising space then if business owners don't buy from them they will try every trick to try and get you to part with your money, like saying that you have bought a few months ago/pretending to be a different company/etc. He says that they just hope that the business owner is weak and just agrees to pay! They are currently under investigation, its a known [problem] to them. The man who runs Vardis - Andrew Lownsborough, has already been prosecuted in the past, so I asked why and how are they still trading? And he said that they keep moving around the Lancashire and merseyside areas and using different people all the time. I offered to give evidence but they say they have more than enough people already and what they have from me is enough. I hope the poeple behind it get a long long time being careful not to drop the soap in the shower of one of HM prisons So the advice is to ignore them, they are being investigated and hopefully will be brought to justice shortly
  23. I have spoken to Trading standards this afternoon, they say I need to write to them and say you have to prove to me that I owe them money for adverts or leave me alone, - they won't be able to cos I have not agreed to anything, not even falling for their con when they keep trying to making me slip up and say yes by mistake. If they carry on harrassing me and trying to [problem] money out of me after this then I need to get back in touch with TS and they will investigate further. I wonder how many people with a weaker personality have just gave into them and paid up? This company has been ripping people off for years by the sounds of it even making the National Press and I can't understand they have been getting away with it for so long but somehow they are? I'm very busy the next few days but I'll make sure I find time to write this letter, these are the wierdest people I've ever come across, I don't know how they get a kick out of trying to steal hard working people's money.
  24. How do I get them to stop harassing me though? Its my business mobile that they keep ringing from different numbers, I have to answer cos it might be a potential customer and they know this thats why they choose to ring from a mobile rather than a landline where I would be able to tell its them by the lancashire area code. I've already been quite rude to a customer today and had to apologise cos I thought it was Vardis I was speaking too, they always start the conversation pretending to be a friend, someone I know or a customer before trying to trick me into agreeing into buying or saying that I have had one of their adverts.
  25. Hi Has anyone heard of or had any dealings with these? I'm a small business owner and they are an advertising agency. I was cold called from one of their agents to have an advertising slot in one of there magazines (can't remember the name of it), the women on the other end seemed quite polite and I may have been interested in advertising so I listened to her sales pitch but when it came down to the prices they were too expensive so I managed to get rid of her eventually off of the phone. Later that day I was called by a man again from Vardis asking if I'd like to advertise with him, he was representing a childrens charity magazine (forresters), his pitch was rubbish, repetitive and he would not take no for an answer but I declined politely and in the end I thought he'd given up as he just said give me a call if you are interested. The very next day a women from Vardis called and said I'd agreed to advertise with them, I replied that I had not agreed to anything to which she immediately just hung up. So I decided to do my research on Vardis and there all over the net with people that have had problems with them! Do a google search for vardis and forresters together and you'll see what I mean. I found that they have even made the national papers (it won't let me post URL) I've had many calls all week, usually from a mobile number and each time saying that I have agreed to advertise with them then this morning really took the p#ss, it was a call from a mobile where he called me to thank me for the support I'd given their charity this year, I told him I did not have a clue what he is on about! To which he replied that I had been in a full front page advert in one of his mags earlier in the year, my business has only been going about a month so I told him straight where to go with that. I explained to him that I knew what their game was as the internet is a powerful tool and their are hundreds of people that have wrote about how Vardis were trying to [problem] them all over the net! After this he got childish, He was playing animal and other sound effect noises down the phone and trying to amuse himself I think by acting a tw#t trying to be funny and talking sh#te, I told him that I was going to report him to TS, to which he said he was going to report me. I asked him what for and he said that he came around my house to buy 2 boxer dogs and I sold him a hedgehog. He needs better comedy material IMO! I just hung up on him eventually cos his jokes were cr#p and he was boring me. Looking at what other people have posted on other sites this is just the start and I am now to expect a call from crown debt recovery to demand money who are the same people as the advertising agency! Sorry about the long post but if there are any small business owners out there do not fall for them. Advice/help needed please! (do a search for 'Vardis Forresters' if you need more info) They are wasting their time cos they not get a penny from me but I just do not need the hassle Thanks
