  1. Hi, Details are as follows, He moved out 11th Aug, rent owed for Aug No tenancy agreement, I understand he/we would have been on a Statutory Periodic Tenancy. No notice given by him Left sharpish, posted keys in letterbox We had big disagreements over some bills in the house, separate issue. Said he had not paid the rent becuse he had to pay the council tax bill cos his name was on it and he did not want that as I owed the one half of it and had not paid yet and they were chasing (besides the point I think but it is related to the payment of the rent) I am speaking for the landlord on this, he's a good friend of mine. Worked with me and lived there with me before this guy. Long story short, he has not paid the council tax, has lied. I have paid it today and have had to cover his rent owed for the month with the LL, so I have paid twice in effect. I want to recover the rent he did not pay (on behalf of the Landlord) He would try to raise issues over the property if he challenged in court. But, I do not have any knowledge on this process so will leave it there. I presume at the end of the day the rent has not been paid by him and is owed. Does/can he challenge that, what grounds could he challenge. It still has to be paid no matter what, is that right??? Questions, questions! The house was in very good order and No services were withheld and suffered no harassment, etc. He is the sort of person that if he receives a summons he would freak and get on his high horse, he liked to think of himself as a bit of a know it all, used to quote law etc on things all the time. Very opinionated and a very large chip on his shoulder, "entertaining" in an argument too. But, he would probably go to lengths to not have something against his name, he wants to "stay of the grid" so to speak and have no interruptions/hassle in his life. Weird one but maybe not as I am sure this sort of thing happens a lot. Thanks Steve
  2. Hi Everyone, Please could someone give me some advice on what to do to recover rent owed to me? Is there a thread here with ythe best way to proceed, I presume I will have to go through Small Claims, is it worth it? Any help is appreciated, thank you. Steve
  3. Hi Everyone, CTAEO I have just received one of the above. I would like to know if there is ANYTHING i can do to reduce the amount they take. Looking at the figures and tables it will cause considerable hardship to me!!! What can I do, if anything, albeit get myself sacked... (Joke!) Many thanks in anticiaption of help Steve

Hi everyone, I given the statement or means into the court and they have told me what should happen next, etc. The opposing party will look at it and then come back with their repsonse, etc and we'll all go from there I presume. But.... I have just been informed at work today that I am in a "consultation period" prior to posssible redundancy! How does this affect any attachment of earnings order. Can I delay it stating special circumstances or such like. Obviously nobody can collect money if I am not working (earning). Any thoughts would be gratefullt received! Steve

  6. Cheers Ell-enn, Makes me feel a bit better, I want to pay it back but at a much lower amount. £25 per month is all I can afford at the moment and I have put that on the form. I can PUT some money in with it now, just about can afford it if I stop some other things, but am concerned it is too low compared agianst the debt (£7500)? What do you think? My figures do not add up as I have been borrowing money from my mother each month to make ends meet. My outgoings are higher than my incomings, they look OK if I add my mothers lending into the Income table?!?! But they are very tight nonetheless. I am a Project Support Consultant. I support Project Managers for a Large national insurance firm. They may not look kindly on this and I need a car for my work as I travel between offices a lot, if that is relevant. I will be taking the form in this afternoon personally to the court, getting a receipt too! Steve

  9. Thanks Andy for the quick reply, I have had alook at the 13 reasons and I honestly dont think I can use them. I have not paid the loan for a while and admit that BUT i did have plenty of chats with them back along trying to sort it out, offering a lower amount per month, etc but they "fizzled out" then all of this. I had the County courts summons a while ago and endaevoured to fill it all in but it fell by the wayside, I forgot, which I know is very stupid of me. I am quite prepared to pay something each month, albeit significantly lower, as referred to above but do not want them taking 15% of wages like they did last year for my council tax?!!?!?!?!? I will not be able to live, literally! Thank you Steve
  10. Hi, I have just picked up and letter with "an application for Attachment of Earnings order" from Welcome Finance for a loan. I have tried searching this site for help on what to do with this letter before I fill in the "Form of Reply" and "statement of means" Can anyone point me in the direction of a good forum post or help on what to do with this letter/form. I wantr to fill it in and get it to the court here today if I can? Maybe there are things I can do beforehand to delay proceedings, etc. Thank you Steve

  15. Thank you Mr Shed. He pays to the landlord (homeowner) separate to me and his arrangement is with the homeowner. I handled the initial visit and viewing, interview. Acting as his agent I suppose you could say. He did intimate that he would be working at the door in a chat but has not worked (writing a book) since being here but that will not be in any agreement anyway. All literature he has has the landlords details on, Council Tax benefit, and whatever else he has. I kind of look after the house for him but that is very loose. It is in a good state, clean and tidy. Garden needs atttention at the front. But inside, more or less faultless. No services have been waithdrawn or interrupted and I see nothing that he can challenge on. The landlord does not visit that often, once or twice a year, we have a Landlords Gas Cert, things like that. I have not checked the landlords responsibilities thoroughly though.
  16. Hi Everyone, First post so be gentle... I am living with a guy who I would like to have moved out (evicted I suppose) I am not the landlord but my best friend is (house owner) and we are looking at what we need to do. Some background first. I have asked him for some money owed for bills and he has said he will not pay me the money anyway, no matter what the reasons at this stage. I have tried discussing why, etc but he has issues with confrontation and keeps interrupting me when I am trying to talk and explain, then goes off subject, usual thing. So annoying, just cant get anywhere with him so I want him to move on. He has moved all my stuff out of the lounge, tidied and rearranged a lot more stuff. Put a bikelock on the back gates so I cant nip in and use the space even though I just have to lift the gates off . I do not want to bore you with any more details no matter how entertaining they are. Suffice it so say, he is acting like a immature child and he is in his 50/60's, all quite funny! I am calm and relaxed about it all cos his behaviour makes me laugh and I want to do it legally and smoothly (if this sort of thing would ever be smooth). So, We are not sure what tenancy he has (not very good I know!) but he has one of the WHSmith rent books with the agreement on the back and I think the landlord may have done an AST agreement when he first moved in. But he has been here 2/3 years so I think that or anything he has had would now have expired. It would never have been a Fixed Agreement. Nothing has been given to him, agreement wise for a long long time too. I would say it is safe to assume he is on a Periodic Tenancy type thing (sorry for flippancy). Questions please: I presume he is now on a Periodic Tenancy now, is this correct? Can the Landlord ask to see his rent book and does he have to comply? Just to check the type to make sure it aint anything weird as I have been reading all over this site and one thing I have seen it not to get any of it wrong. If it is a Periodic tenancy argreement am I right to say that all we have to do is issue a NTQ making sure we get the dates are right (28 days) and we satisfy all the content requirements, etc as outlined on the Housing Law site The Housing Law website. We do not have to outline any grounds in the NTQ, we can just ask him to go. If we are unsure of dates are we OK to add on few extra days to make sure we are OK? Can we base any dates on when the rent is paid by him? (Monthly) If yes, can I get a template for a NTQ anywhere here or somewhere else, I have not been able to find one. I am aware of the susequent consequences if he does not vacate on the 29th day and that we may have to go to the next step. But, he is one of these play it by the book kinda guys, Mr Frugal and the thought of having to pay the court fees will frighten him off a bit. I remember someone once saying to me "never do anything on the principle of the matter" it just costs to much, I think that may ring true for him. If not I do not mind paying the £120 fee or whatever it is get it all done just for peace of mind. Thank you in anticipation of any help offered... The Sewingkit :o
