Im pleased to say that it is the first scenario lol basically the original a/c had a loan put onto it or something like that . . . . i asked for the CCA to which I recieved the following "We refer to your correspondance dated 30 May 2008 We regret to advise that the loan agreement has been misfiled and despite searching our records we have been unable to locate it. Our record of setting up the loan has insufficient detail to enable us to recreate the agreement with the required degree of certainty this course of action requires. In the circumstances we appreciate that under s.77(4) of the CCA if you decide not to meet your obligations under the loan as they fall due we will be unable to take steps to enforce repayment of the loan. However we consider that you should continue to meet your obligations under the agreement bearing in mind that the agreement isnt void, it remains valid and your continuing default will be reported to credit ref agencies. S.77(4) only prevents us from pursuing recovery of the debt through the courts. For the avoidance of doubt, we confirm we still require repayment to be made in respect of the current account. The current balance outstanding on account 600. . . 239 . . . . . . When responding to requests made under section 78 the bank is required to provide you with a copy of a security document (if any) and a letter containing the following details; oustanding balance, details of interest and charges outstanding and the amount of daily interest accruing. However, a copy of your account opening form has been ordered and should be sent to you under seperate cover. I have never recieved the copy of account opening form or any other documents from them. So . . . . . is bog off still the way to go about this?? thanks -
Since my last thread "round 2" I heard nothing from AIC or for that matter NatWest until a few days ago and it seems that they have just decided to give the chasing to a new company . . . Westcot? unfortunetly for them NatWest never did send me the copy of my account opening form, so am I still within my rightsto write back and say untill i recieve the opening form Im not corresponding with anyone?? Any help much appreciated in advance

but the letter says that the account part is still open? or am i misreading the whole thing? well im not responding for 6 years then or untill i get alotta cash in hand

well in that case they can rot!!! lol would it be 6 years from now or from when i took out loan?

If i were to offer a payment plan how much could i offer? and would i offer it to them or the debt collection agency? what would you advise as a neutral? after 6 years (from now) will it be wiped?

so even though they have 30 days from when i sent the cca letter to them. If they do get one say . . .9 months from now I still have to comply with them?? I was just kidding about getting credit . . . trying to make light of this situation! lol

well surely they wouldve sent it to me by now?? it cant take that long to put in an envelope and send can it?? well as i said it will have been a month since they received it on the 18/7. so ill have to cross fingers they cant find anything!!!

No im making No payments to them at all Im out of work and have offered them what I could afford and yet they somehow wanted a settlement figure which I wouldnt be able to afford even if I was working!! Well ill just leave it be then and if I have any come back ill remind them that they have broken the law??

They received the letter on the 18/6/08 and I stated 12 working days from the time they receive? Is it worth sending a follow up letter?

Hi all I sent off the letter to AIC about asking for my CCA and enclosed £1 postal order and apart from a few missed calls (dispite saying to only contact me through mail) Ive heard nothing back from them!! Is there a follow up letter than I can send to make sure there not planning Round 2?? Many thanks Steve

Well to be honest I think its an overdraft taken out to cover credit cards lol Story is up until I was 21(ish) I played pro football and as most stupid footballers I used credit cards to pay for everything cuz I was too lazy to take cash out of a ATM. So I acknowledge that I do actually deserve the severe treatment from them
