hi all
can anyone help me with this? do I send a letter to them as the CCA letter is not enough, or is it enough?
Should I demand statement of account and what else if anything? Does anyone super out there have any advice on what to write (is there a template?)

oh... i'd better delete the pdf then! although the bank a/c is no more.. i'll re-post the pdf tomorrow without my personal details.
what about the statement of account? should I have not received some breakdown of the account and where their figure came from?
capquest take the money straight from my card... i was naive when it was set up lets say....
can anyone help with what documents I should have received? is it legit?

Hi all
1) CCA'd Capquest re an Egg Credit card.
2) Received a letter back from them saying that the account was on hold until further notice.
3) On Saturday 9th Aug (After 12 days, but within the month of sending the CCA cheque off) I receive a signed copy of the EGG statement (which I will upload).
The thing is, in the letter received on Saturday, they stated that they have put the account on hold until the 17th August, BUT they have taken a payment and increased my monthly payment by £11.00. (today is the 11th).
I'm not sure that they should have taken the money after saying my account will be on hold until the 17th and I thought the CCA documents included a statement of accounts (so I can see where the figures come from etc). Can anyone help?
I'll see if I can scan the document in shortly.....

Just took other advice literally I guess. So result with that one at least!
I count 12 days from the 15th May (08:00am when it was signed for).
Now - for the 30 days - I read that this is 30 straight days - does this include weekends or am I to stick with the Monday - Friday count again?

I CCA'd DLC - they received the letter on the 15th May.
I know we count 12 (+2) working days for them to get the agreement to me + a further 30 days before the debt is unenforceable.
Question is - as I got phone calls and there are people from DLC always phoning on Saturdays, can we count a Saturday, as a working day?
What do you think?:grin:

Hillesden is an egg one.... a loan.
The tesco finance one is thru RBS, and I made offer to them when they came out of the woodwork about 3 years ago and never heard from them again. But what they're doing, is on my credit file, they keep on saying that month after month (for a few years now) i miss a payment. whereas other creditors defaulted me ages ago....
I guess their game is to never default so people have to put right the debt? which I don't mind doing, I have the debt, i am willing to pay back what I borrowed but my credit file will be clear except this in a years time and I don't know how best to handle it...

Thank you so much! I guess, in my case - my file will be looking pretty hot, except that Tesco finance one, where they have never defaulted me. Will the debt become statute barred after 6 years of non payment from me and disappear or by doing what they're doing, will they keep it alive and ugly on my file?
(I checked, as I thought I was paying these guys - but I wasn't. I did write to them with offer of payment, but no one ever got back to me...)

damn it! I hoped that it would show as a default for 6 years. Will it return to just a normal, outstanding amount after 6 years or will it still make my credit rating poop...
So, if I satisfy the debt, it will stay for 6 years after that and then disappear? (but hopefully not as a default....)

This thread will put some of you in the picture as to what my delightful shows. Can someone enlighten me as to what's the best course of action.
First, am I correct in believing that the credit file will only show my defaults for 6 years, from the date of default.

So, (yes I feel a bit blonde today), if I pay off an a defaulted for 5 year account, it won't take the stance of making a note on the file for "six years after the date you settle an account"

Yes - i'm not worried about it being on my file for the next year. Its just, if I pay off a debt within the year, when its been marked as satisfied does that then stay on the credit file for a further 6 years.
i.e. I thought that two things stay on your credit file - a default (stays for 6 years), and if you satisfy a debtor (for 6 years).
So, if you satisfy a debt 5 years into a default, will it then show as satisfied (for a further 6 years on your credit file - or disappear after the initial 6 years.
I know what I mean...

My defaults on my credit file are from 5 years ago.
Did I read somewhere that this information stays on your file for 6 years from date of Default (5 years ago in my case) and then 'disappears' from the credit file?
But, am I also right in thinking that, if I was to settle my debts now, the information would stay on my credit file for the next 6 years?
i.e. if I paid off a defaulted debt, it would be worse for me with regards to my credit file as it would have gone by 2009 but as paid off, it would stay for 6 years from that date?
As previously mentioned, I have a couple of debts that I could clear in full this year, if I ate value baked beans constantly and walked instead of drove places, but I don't want to shoot myself in the foot, as they say.
Can anyone assist?

Out of all my DCA's, i've only CCA'd DLC - they are the only ones that seem to think intimdation and threats will work in their favour. Sadly not for them, not with me.
My other creditors have been quietly taking payments, occassionally ask for more but the answer is no. I want to pay back what I owe but won't be bullied. So the bullies get the CCA. When I pay one debt back in full (got a couple that, £1000 ish and £2500 ish that I'd like to clear) then my repayments on others can increase. I've had the interest frozen so fairs fair in my heart. I borrowed, I pay back...(only redundancy made this mess)
However, you'll probably see posts from me in the future of me CCA'ing other DCA's - never say never...
May I just add that this forum has been an amazing help and my donation is winging its way to you guys for your tremendous help and support xx:)

Got a letter response from Hillesden Securities yesterday in relation to my CCA and telephone harrasments letter sent on the 13th... it states:
Thank you for you letter dated 13 May 2008 regarding the above account. I would confirm and advise the following:-
1. I acknowledge receipt of your payment of £1 in connection with your data request under the consumer credit act 1974.
2. We are still awaiting a copy of your original agreement from our client Egg Banking Plc. When this becomes available it will be forwarded to you.
3. If we are unable to forward a copy of the original agreement, we will be able to supply a true copy of the document which will comply with section 77 - 79 of the consumer credit act 1974.
4. we have removed your contact telephone number from our records and will continue to pursue you through written communication only.
5. Please note that if you do not keep a regular dialogue with us regarding this account and update us accordingly, our guidance from the information commissioner states that we are entitled to reinstate your contact telephone number to continue activity on the account when required.
Should you require anything further at this point please contact me accordingly. I will update you on developments in 21 days if there are no developments beforehand.

The letter I sent were signed for at 8:00 am on the 15th may. I have printed copies off the royal mail site.
If they do not send through an original agreement within 12 days (do I count saturday as a working day for them - they always call on a saturday?)... what does it mean?
I understand they have a further 30 days to get this to me, but what do the two sets of dates mean? i.e. 12 days means.... and 12 + 30 days mean?
Also, should they not send me a true original and send me a true copy, what I should I get back to them with?

I sent the CCA and telephone harrassment letter and it was delivered and signed for on the 15th May. I have printed out copies of the letters, taken photocopy of the cheque for £1.00 and printed out the proof of delivery. The phone calls were still coming last night, but as my mobile is on silent, they didn't bother me. do I count 10 working days from the 15th, or from the 16th (i.e is the 15th day 1....)
I'll keep you posted on any responses on this thread!

The original debt was for an Egg loan....
Should I CCA them? I've got a fair bit of paperwork running back over the years, but mostly they are letters threatening court / from their own solicitors etc.... nothing showing the credit agreement (I will send the letter tonight).
What would you recommend though, with regards to making a payment? I don't want to miss a payment this month...
I'll send the telephone harrassment letter too - 4 phone calls yesterday, 3 so far today....the list goes on!

What paperwork received from a DCA fulfils the CCA criteria.
I have a copy of the Egg credit card application form, signed and dated by myself back in 2001.
What else should I have received?
i.e. statement of account?
