  2. Ok back to this. I have taken a few days off to consider my actions and enjoy my sons birthday with him Now I shall get back to this and get it sorted. Someone has kindly provided me with the info on the bailiff that called here and I am a little confused I think I thought that bailiffs were employed by the company that they collected for but this chap is self employed. So how does that work? does this mean that he can work for several companies all at the same time? Sheraton

  5. Ok right here goes. I think that I have blanked out all names etc on Jacobs reply so I am going to try and add it on here so you can all see what we are up against. Before I do can I just say that neither me, my husband or my MIL or violent and we have a mobile phone bill which proves two 999 calls, oh and a receipt to prove that our original email to Jacobs (disputing charges) was received and read by Jacobs. Oh and to add to that the first tme I knew what Baliffs name was, was when man at council told me today Figures dont add up either Sheraton
  6. I have said on several occasions that I want to press charges and they are absolutely refusing. and saying that NO criminal act has been comitted. Have quoted info from Devon and Cornwall doc and have been told that they dont have anything like that. Just dont know where to go from here. I did think about the local press but to be quite honest having all my neighbours watch the commotion and then having my MIl involved was bad enough. I dont want my children to be talked about at school Sheraton
  7. Hi Fairparking It is Crewe and Nantwich Local Authority and Cheshire (Crewe) police. I have had a very interesting conversation with the gentleman at the council this afternoon who is more than willing to support us in our complaint with Jacobs. I think that we are probably very lucky to have found him, his point of view is that we have complained, Jacobs have responded but he is pushing for a thorough investigation. If anyone else is reading this from our area and have the same kind of problem then please please complain to the council - there is someone there who WILL listen. The police however - what a joke I was told two weeks ago (ish) that they would look into bailiff law and get back to me, what they have actually done is marked the file No Further Action because apparently no crimes were comitted. I am busy replying to the complete pack of lies that Jacobs have provided and then I am looking to file my form 4 tomorrow. Just had my MIL laughing her socks off when I told her that MR Bailiff claims that she is very violent
  8. Have rung council and they have asked that I submit my reply to the Bailiffs statement. I will be doing this, this afternoon. I have tried to ring to check that Bailiff is certificated but keep being told that I have rung the wrong number ??? What do I write on a form 4 ?? I know what happend but I am unsure how to make it short enough and also what legislation to quote. Have spoken to police again - absolute waste of tme !!!!! I was going to scan bailiffs reply on to here but I am not sure if it gives too much info on it and in all honesty I am hopeless at blanking out names etc. Sheraton
  9. OK desperately need your help now. We have had a reply from the council which is basically no help what so ever. The reply that they have enclosed from Jacobs is made up of a complete fabrication. I know that the Bailiff is obviously ofquestionable character but I hadnt expected quite so many lies. Where on earth do I go from here????? There are sooooo many lies it is unbelievable

  11. Not at all happy now. I asked for a response to my complaint within 10 days. That deadline ran out last Friday 19th. I have just been told by recoveries officer at council that Jacobs have responded to my complaint and that we should have our reply by Thursday 25th. I dont want to appear unreasonable, expecially given that the gentleman in recoveries has been sympathetic so far and I do understand that he needs time to digest their comments. However it makes me really angry that he is aware of their response and we arent. This delay is just causing more stress. I have been unwell now for allmost 10 days and although I cant blame this situation entirely, it certainly isnt helping. The question is do I bother waiting the extra 24-48 hours for the response or should I just go with my original intentions and spend the day tomorrow forwarding a form 4 complaint to the courts and forwarding complaints to just about anyone I can find? I KNOW that Jacobs are in the wrong and it really gets to me that I am the one anxously waiting for their response so that I can move on. :mad::mad: Sheraton

I dont know enough to get involved in this discussion but I am watching with interest due to issues of my own But Devon & Cornwall police doc as per other thread Drakes/Marstons "They cannot force their way past someone at a door or wedge their foot in a doorway to prevent the door being closed" Direct Gov website "Forced entry includes pushing past you once you have opened the door or leaving their foot in the door to prevent you closing it. Such action would make the whole process illegal" Either it is legal for a bailiff to leave his/her foot wedged in your door/gap or it isnt??? Police and government seem to think it isnt Sheraton

  14. Ok, more suggestions needed please. Finally had call from next police office. No attempt to make appointment to come and take statement. It's really a civil matter and you need to pursue it through courts etc. I said that yes I will be doing this however an attending police officer should not stand there and let a bailiff break the law. I believe that given there was no immediate serious threat (ie I wasnt about to kill him or vice versa) then the attending PO should have checked where bailiff stood. Police officer blabs on about they do have powers to enter your property in certain cases etc and so I advise PO that I know my rights and know that in this particular case he did not have any right to enter and that even if he did he still does not have rights to use force. Tried to explain about all the illegal fees and they really arent interested in that. Not sure if I have got anywhere at all. PO has agreed to look into bailiff law and speak to attending officer. PO will get back to me. I have told PO that I am not at all amused that I should be portayed as the villian which is how this feels. Thanks to reading this site prior/post baboon's visit I know exactly what he cant do but Police dont seem to have a clue and really dont seem even remotely interested. I advised PO that I wasnt shown any ID, any warrant, any docs at all and he refused to give me his badge numer or name. Repeated once again that infact I have handed over shed load of money to someone and I have no idea who they are or if indeed they are even a bailiff. So when PO calls me back I fully expect to hit a brick wall but I am not prepared to let this go. So trying to be prepared - where on earth do I go when they come back to me with the ususal civil matter? Oh but I was told that if he comes back and is threatening then I should ring them straight away - my question is what for? so they can enjoy a bit more entertainment?? Oh I am soooooo annoyed, that whole phonecall just felt like, tell he to pursue through courts and get rid!!!! On a positive - my dogs are home now, so I feel a lot safer and we are currently looking into having CCTV/intercom fitted so that if we ever end up in this kind of nightmare again it will all be recorded.   16. I told attending police officer that I wished to press charges, he said to think about it because it wont go anywhere you know. Rung police station next day and said I want to make a statement with a view to pressing charges and was told "well it wont get you anywhere you know, they (bailiffs have a job to do) yes I reply but they have to do it within the law. Police office sighs and says they will get someone to call me. 3rd Police officer (when they finally ring the following day) says we cant take a statement unless you immediatley want to press charges. We can only deal with criminal acts and not complaints about bailiffs doing their job etc etc. Ok I say I want to press charges, thanks very much. That was yesterday lunchtime and I am still waiting for the local unit to call me to make an appointment to call me :-? Perhaps they think if they leave it long enough I will forget, yeh right!! sheraton
  17. Had same kind of situation years ago. Two baboons turned up to remove my car. ok yep I was in some arrears but not a huge amount and I had paid over half what was due under the agreement. OH had just been paid so we actually had the money in the house to cover the full arrears. Offered the money to the baboons, they refused and started to clamp car. OH rings trading standards, trading standards speaks to baboons, trading standards speaks to finance co and car stayed Lucky for us they turned up during working hours and someone was at TS to answer phone. Dont just give up and give them the car, if you have paid over a third then you have a right to fight your corner. I am sure there will be someone along later to give you some advice. Sheraton

No I'm no where near there I have no intention of insulting the police force when they arrive BUT I do intend to be ready for their "we can only investigate criminal activity, it is not our place to prevent people doing a job" Policeman who attended our house said "I would think carefully before trying to press charges, it wont go anywhere you know" It may not but it wont be for want of trying. If everyone who had the same problem made a complaint then at some point someone will have to listen. I have decided that if my complaint to my local authority is not taken seriousy then I will persue every single legal option available to me
  19. Oh so true!!! I have now spoken to 3 police officers who obviously dont have a clue. Whilst I am wating for them to appear to take my statement (heaven only knows when they will show) I have decided to be helpful and print a few quotes of various sites for them. Sheraton
  20. Jacobs again Boltonbabe, I can wholeheartedly agree with you that their representatives are very nasty and intimidating. However as you have allready been told there is nothing they can do as long as you dont let them in. Well done for putting a note on your door, whatever you do DO NOT OPEN THE DOOR no matter what. I have just submitted a very strong and comprehensive complaint to my local authority in resect of Jacobs and the matter is also being looked into by the police (although somewhat reluctantly). I hesitate to give advice as there are far more knowledgable people than me however what I will say is make sure that you keep every single letter that they stuff through your door, ring your council as well as write but do not deal with anyone other than a senior recovery officer. This comment is not meant as any critisism of the lower staff but they simply do not have the authority to do what you are asking. Lastly please, please dont be scared. This is rich coming from me given that they have recently scared the pants of me but now I have decided to fight back my fear lessens each day and my confidence grows Sheraton
  21. Totally unrelated. Different Bailiff, different local authority. I still am not happy with the amount the we have paid this authority (stick at it and you can win) and the fact that absoutely no contact was made with us prior to the bailiff being sent our home. They definatley idnt follow precedure either however as I let them in and I agreed to pay out of fear I have accept this one as part of a learning curve. Getting back the last lot of fees just makes a bitter pill a bit easier to swallow and proves that just because they say they are right doesnt mean that they are. Due to both these bailiffs chasing us and not really taking our circumstances in to account, we were at one time paying £360 per month to Bailiffs and also trying to pay the next lot of council tax at £120 per month. Kept telling them that we just couldnt do it and ended up falling seriously behind with the next lot. Sheraton
