Hi I have just received a"NOTification MUTUAL ASSISTANCE IN FUNDRAISING C.E. from Agencia Tributario in spain. this is from the HRMC in the uk for "claimed" unpaid taxes They are claiming 3500 euros for 2007 and 1500 euros for 2006. I have lived in Spain for 4 years now and this is the first communication I have received. I am an english teacher with no assets or Money. I understand that this debt cannot be pursued as the debt is more than 5 years old and is less than 15000 euros? could anybody give me advice on what I need to do? Can they deduct the cash form my Spanish bank account? (In Spain the government can do this automatically for unpaid taxes) any help would be appreciated! Reggie
  2. Hi there Could somebody give me some advice? I have received a letter from the DWP stating that i owe £156 from a social fund loan from 1992!! They are threatening to take me to court and enforce bailiffs to rcover the money if i refuse to pay back. Are they allowed to do this on a debt that is 17 years old? Many thanks

  4. Thanks for your replies. thing is we actually like the car - does anybody know how much a vehicle depreciates without a service history? paid £5600 on an 04 plate. We are looking at getting them to refund some cash - have been told we could expect between £1000 and £1500? cheers
  5. Hi Tom SO far they have charged me: £100 "registration fee" £50 x 2 for 2 Bailiff visits which did not take place I have so far paid the Original fine plus the £100 fee. I am refusing to pay the Bailiff fees as: 1 there was a problem with their on line systems and my original payment did not go through. 2 No Bailiff has visited my Apartment - there is a 24 hour concierge who logs every visit. Leeds is Norther East Yes i did receive a letter - as soon as i received it i rang up to complain - which is when i found out that my original payment had not been processed. I offered to pay in full then but i was told it was too late as a bailiff had already been appointed and an additional £50 added to my bill. How can they charge for bailiff visits that do not happen?

Hi there I have just bought a second hand car from a reputable second hand car dealer (if there is such a thing!!) which was sold with a full service history. the car is 4 years old with 20k on the clock We were given the log book and the service book with the relevant stamps which seemed to tally with the mileage of the car. The last service stamp was at 18k miles. However when we got the car home we looked more closely at the service history and realised that they had given us a service book for a different vehicle! (same make and model but different Reg) We checked with Hyundai head office as they keep a record of all their vehicles service history and it seems the vehicle we had bought had only been serviced once in 4 years at 10k! (not exactly a full service history!) When we asked the dealer for the service book for our vehicle we were told they had mislaid it. We have now been told that the Hyundai Warranty is invalid if the car has not been serviced every 12 months, and that a full service (including cam belt) is £700. Where do we stand in relation to getting the dealer to pay for the service or indeed getting a refund? Regards MM

Hi again i sent Philips the template letter below: DATE Dear Sir/Madam Re: [YOUR NAME + REF]: Opportunity to refund and compensate for fee error I write following visits by your bailiff, however there appears to be an irregularity with your fees and I ask you to provide the following within fourteen (14) days: a) The name of the certificating court and certificate number for the bailiff in charge b) Written confirmation of your fees and charges c) Truthfully confirm in writing they are lawful according to prescribed legislation d) The name and address of the person or body you act for They have written back with the following: With ref to your recent communication regarding your outstanding arrears due to West Yorkshire Magistrates Court, i write to inform you that due to strict guidelines by our client we are unable to withhold any further action. the balance on your account is £95 an i would be grateful if you could forward payment within the next 7 days to avoid any further action. Should payment not be received at this office within this timescale further costs may be incurred Could somebody please answer a few questions? 1 No bailiff has ever visited my premises, yet they continue to charge me £50 for every "visit" Can they do this? What can i do to get these charges dropped? 2 I have paid in full the original Debt of £60 plus philips fees of £120. They are now chasing me for an additional £95 for 2 Alleged bailif visits. As the original debt to west yorks magistrates has been paid, do Philips still have the right to enter my home to reclaim their fees? 3 They are continuing to spell my surname incorrectly - My name ends in EN they have it spelt AN. IF the Bailiffs do call and ask if i am Mr .......AN do i have the right to tell them that its not me? 4 what is the subject to access ? Any help would be appreciated Cheers
  9. Hi What is a subject access request? Also seeing as i have paid the original fine in full plus Philips original charges, (they are now chasing me for the additional bailiff fees) would this now not be a civil case? IE would their power of entry now not be vailid? Regards
  10. Sounds good in theory but i am not willing to part with any more cash and then have to wait weeks or months for a refund! These people are basically extorting cash with menaces! Also how can they charge for a Bailiff visit that does not actually happen? Cheers

  12. Hi there. I had an unpaid speeding fine of £60 which was passed onto Philips collection services for payment. they added on another £120 for their fees - fair enough i thought, so i paid £60 by switch and arranged to pay the remaining £120 on line a month later. This i did (or thought i had!) however about a month later i get letter from philips saying that the debt had increased to £196 as a bailif had been sent twice to my address to collect the unpaid fine! No Bailif has ever been anywhere near my place as i work from home and there is a concierge on reception at all times. I checked my bank account and the 2nd payment had not been made. When i checked the letter from philips they had my name spelt incorrectly - i am assuming that this is why the on line payment had not gone through. I rang up immediately but the most arrogant unhelpful person on the phone refused to listen to my story and just kept insisting that "payment must be made in full". I said i was willing to pay £120 - £100 there and then and another £20 at the following month. She took my payment and then still insisted that there was another £60 to pay! I asked to speak with a supervisor and this was refused. I was told to write - but in the meantime a bailiff would be sent out and i would be charged another £50. I asked her to suspend the account until i had written in but she refused! So i emailed them with the details but got no reply. I then started to get 2 to 3 text messages every day asking me to pay the debt in full. I rang again today to pay the final £20 to be told that i had to pay in full and this had now risen again by another £50 (now back up to £110) as a bailiff had visited. Again no bailiff has been anywhere near!!! I cannot speak to anyone other than the rude collection agent to get this resolved, they refuse to put me through or even to discuss payment in part! I have been told that a bailiff will be calling again tomorrow and the debt will be increased to £170! so that's £320 from a £60 fine! I am at my whits end with this and don't know where to turn? So a few questions: 1 my surname is spelt incorrectly on all of their correspondence - is this a loophole i can exploit? 2 No bailiff has visited - yet they keep adding £50 to my account 3 I have tried to make payment in full, but their on line systems seems to have had a teddy with my surname - 4 I am refusing to pay anything other than an additional £20 but they keep adding bailif fees - can they do this? HELP !!!!!!!
  13. hi thanks for the advice - i will be going in in person and asking for a written explanation. the money came out on Friday - not Saturday and it was a manual transfer not the DD. That is due to come out on Monday. Cheers
  14. Hi there I have a premier account with the HSBC and also an unsecured loan. My loan payments used to come out on the 3rd of every month. Last month i was struggling and moved the payment (on the advice of HSBC!) to the 28th of the month giving me almost a full months grace. On the 15th August i checked my account and found that it was £409 light (the exact amount of my Loan repayment) The loans department had just taken the money out of my premier account with no warning! (no letter no phone call) When i called to complain ( Call center in India but lets leave that for now) i was told that there was nothing they could do as i was in arrears with my loan! I gently explained that i was NOT in arrears but had moved the payment day on the banks advice and that the payment would be made on the 28th (still within the calender month) After going through 2 supervisors and an hour on the phone they reluctantly re payed the money but then explained that the DD had not been set up for the 28th. They now couldnt set this up as i was technically "late" with the payment so i asked them to set up a manual payment for the 28th which they did and then set up the DD to come out on the 28th of the following month. (hope you are still with me it gets better!) A week later and i have around £150 left in my account with my salary going to be paid in 3 days time. I take my girlfriend for a meal ,bill comes to around £60.i present my debit card but its refused. As you can imagine i was more than embarressed and had to apologise asmy girlfriend had to pay the bill. I Check my balance and low and behold the Loans department have yet again taken £130 of my £150 to pay my loan !!!! As you can imagine i am hopping mad! The Manual payment is due to come out in 3 days time and they have taken virtually every penny i had left in my account with no warning!!!! I call custerm services and repeat the process above - taking another hour of my life and am told i will get a letter of apology. (im still waiting) I double check the the DD is set up for the 28th of September, which it is, and calm down a little. Its now Saturday the 27th September - My Dd is due to come out on Monday all is well. Untill i check my bank account and find out that it is £409 light. YES THEY HAVE DONE IT AGAIN!!!!!!! Another call to Bombay - another hour wasted but this time after i complain that i cannot understand a word "James" is saying he terminates the call! Thats it - i have had it with them i am heading into the local branch on Monday and my account is getting Tranfered to the Abbey. What are my rights here? surely they cannot just move money without informing me? especially as i am not even behind with payments? Do i have a right to claim compensation for the emabarrasment they have put me through? Any thoughts would be most welcome! REG

The Management company have also written to my lender asking them to pay the debt in full (i dont understand this as they have also instigated proceedings against me?) My Mortgagae company have asked my permission to pay this and add to the mortgage (which is fine by me!) However they have also stated that this would be classed as arrears on my Mortgage account and be per sued in the normal way (ie if i cant pay then they would look to repossess) so what should i do? Take my chances with the CCJ and make an offer to pay or let my mortgage company pay and face being repossessed? Seems like a rock and a hard place?
  16. Hi there im new to this forum - hoping somebody could help or give me some advice? I own an apartment which is in a high rise building and is on a leasehold. There is a management company who i pay £100 a month to for the maintenance and upkeep etc. Unfortunately due to circumstances i have fallen behind with payments to the management company and am in arrears to the tune of £1900. they instructed a solicitors to claim the money back from me. Back in September i made an offer of £150 per month to pay back this debt. i paid one installment whilst i was waiting for a reply, but I did not get a response until after christmas when the offer was turned down and they threatened me with legal action. I again explained my financial position to them and increased my offer to £200 to be reviewed on a 3 month basis (my pay fluctuates as i get paid commission and there was a possibility that i could make interim payments or even pay the debt off in full) The solicitors replied that they would put this offer to the management company but that i should make payments anyway. I replied that i was not going to make any further payments until i had an agreement that they would not instigate proceedings against me. Another 6 weeks went by without a reply so i contacted them again and asked them to accept my offer. Without warning i have now received a county court application for the full amount outstanding! At no point have i stated that i was contesting the amount owed and have constantly asked them to come to an agreement with me which they have just ignored. So i now have to reply to the court application, the only option i can see is for me to admit the claim and make an offer of payment? I have some questions and would welcome any advice? 1 Even though i have made an offer of £200 previously, can i reduce this on admition of the claim? 2 It says in my agreement with the management company that if i default on the fees that they can gain entry to my property? Does this mean that if they have a judgment against me that they can throw me out of my own flat? 3 Can they get a judgment against me even though i have made a reasonable offer to pay? Any help would be appreciated, i have until this Friday to reply to the claim. Many thanks
