  1. Hi everyone, On just checking my credit file, it seems that a current occupant of an address I lived at 4 years ago has filed a "self-protection", category 0 CIFAS record on her credit file. Now, it is showing on my credit file too, I believe because CIFAS do things by addresses. However, Considering I have not lived there for 4 years, and have no connection with this person whatsoever, why is it on my file? Can I get it removed?! Please say yes! Many thanks in advance!!!!
  2. Well I do have proof that they debited £3000 from my card, I have the statements. I also wrote them two letters a couple of years ago which I got no response to (I have copies of those letters). Surely the burden of proof should be on them to prove they provided some sort of service for the payment they took?
  3. Oh dear. Looks like I am screwed then. Are you certain of this? It seems a little unfair, considering I am the consumer. Otherwise they could do that relentlessly and con lots of people - and so long as nobody recorded the call they would be in the clear? Surely the burden of proof must lie with them?
  4. Hey folks, Right, I found a Corvette that I liked on autotrader, and called the dealer (based in Manchester), who told me there was a lot if interest in it. The price was £19000. They said if I paid a deposit of £3000 over the phone, they would hold it for me for 30 days. Considering I had not seen the car in the metal as yet, I asked if I could get a refund if I changed my mind - to which the salesman said YES. So, a week later I called them and informed them I had decided not to go ahead, and wanted a refund. They refused. Now, I was never sent (or signed) any paperwork regarding the car, and wasn't even sent a receipt for the payment, despite my requisting one. The problems for me are: 1) this happened a long time back - 4 years ago in fact. I have never got round to claiming simply out of being pressed for time. This I fear may be a significant problem, no? 2) The card I used to pay was a Natwest debit card, and that account has since been defaulted and closed (in no small part due to this). Do I therefore have any claim against Natwest? Any help here would be appreciated. In essence, I have proof (in the form of bank statements) that they charged me £3000, and I know they have no evidence that I signed anything, nor that they sold me anything. I also have no doubt that they did sell the car.
  5. Oh really? That is great news. Are you certain of this? You see, the main issue for me is that I need to make sure my record is clean in 3 years. The agencies say they report for AT LEAST six years, does anyone know of situations when defaults are reported for longer if they are not settled? Or am I completely in the clear come 3 years, even if a DCA gets hold of the debt?
  6. Hi folks. I was just wondering, seeing as debts are usually only reported if the corresponding address is used in the search, if I wait until six years after I have left that address, and thus do not need to declare it, does this mean that any defaults from that address no longer appear on my report? Thanks!
  7. ok thanks, in that case unfair charges will not get the default removed for me.... but I am still none the wiser as to whether companies are willing to remove the default if I make it a condition of F&F settlement.

  9. Hi, I have a default with Mint that is still shows as unsettled, and I have not heard from them in 3 years. Will it automatically drop off in 3 years if I do not settle it? I am really unsure what to do. I really want to get a mortgage in a few years time, and want my credit record clean by 2011. I am inclined to let sleeping dogs lie, but then again, if they sell it to a DCA, then I will have another default stuck on and another 6 years - too much risk I think! So, my primary question is, if I write and offer to settle the balance in full, on the condition that they remove the default notice from my credit file immediately, is this something they sometimes agree to? Or is it a no-hoper? OR - should I write and challenge the default through all the usual methods (Mint do not seem that responsive based on what I have read here!) ANY help MUCH appreciated! Would really appreciate some advice...as I really need this default removed. Thanks a lot in advance!
  10. i guys, I have a default from Feb '06 with Mint for a credit card which has an unsettled balance of £1800. There were lots of late paymebnt charges put on, so I would like to reclaim those and get the default removed. What is my best route? I am about to SAR them, but am confused about other steps. Do I ask for a CCA (has anyone had succcess with them thorugh this method)? And how do I go about reclaiming the unfair charges and thus getting the default removed (on the basis that the debt was unfair?) Really looking for starting points here - any help much, much appreciated.   12. Hi, I was wondering if anyone could advise me on the following situation. Back in January, I went on a trip to Spain, where unfortunately I was robbed at knifepoint for my suitcase, that had all my clothes, electronics and my wallet inside too. I reported it to the police, got the relevant documentation and submitted the claim. My insurer (Morethan) have been diabolical at getting back to me regarding it. It has been 9 weeks since I submitted the claim, and having taken all this time (much to my disgust since I have little money for new clothes at the moment), they have today passed on the claim to a third party (Cunningham Lindsey). I received a letter from them today asking me to call one of their "claims co-ordinators" to discuss the claim. Having checked their website they are clearly a fraud detection firm. Firstly, I was told that the insurance company had 8 weeks to come to a conclusion on a travel insurance claim, is that right? It has already been 9 weeks and only now have they passed it on to ANOTHER company, who will probably take even longer. Can I do anything about this? Secondly, my claim is 100% genuine, and I have nothing to hide. However, I am concerned that they will barage me with questions about an event that happened what is now (due to their incompetence) some time ago, in the hope of finding inconsistencies. Can I refuse to speak to them, and instead deal with them by letter? Any tips on dealing with thes people? What rights do I have here? I am really sick of these people, as whenever I called Morethan (literally every 3 days for the last 9 weeks), they always fobbed me off with "we'll call you back" or "its being handled right now", and never got back to me. They claim that they aim to deal with claims "within 5 working days"! I really want to take them to court/ complain to ombudsmen... any help would be much appreciated.
  13. Thanks, i will get that sent off today... just a quick question: if i do not pay the debt off, when willthe default drop off my file, is it 6 years from the date of the actual default notice? Or will it be there perpetuallly if I do not pay it?

Should I try a CCA challenge with them? I do not remember ever receiving a default notice. I also made an effort to start making payments but never heard back from them. Would really appreciate some advice...as I really need this default removed. Thanks a lot in advance!

I forget exactly how much ( the total overdraft debt was £1460). I paid this off back in Feb 2006. I am yet to contest those bank charges. I am about to write a letter, but what should I lead with? I am thinking these: 1 ) The fact that my contract with them has ended, should mean that my permission for them to process data about that account has also ended. 2) Defaults contained unlawful charges then the defaults themselves are unlawful as they do not reflect the true amount of the debt 3) Challenge under the CCA - ask to see a copy of default notice, and of the CCA. How do I go about reclaiming the charges and simultaneously having the satisfied default removed? Can it be done? Which should I lead with? Any help much appreciated.
