Hi I've had a letter from the lewis group today too. My situation seems similar. I filed my defence at northampton and got a letter stating if the claimant didn't contact the courts by ** date it would be stayed. Only I never got a letter to confirm it and heard nothing for almost 12 months. Then got a letter from lewis demanding payment in 5 days too. Was your letter from northampton stating the case was stayed? I was just wondering whether to follow same advice too? Sorry to jump your thread Regards -

HI all ok just to update I've recieved a letter from the courts saying that they have recieved my defence( they recieved it on the 21st sept) Also had letter from Cohen offering a FF settlement which no way can I afford the offer has a 14day expiry. Whats my next move or do I wait??? Any advice welcome please:) Regards -

hi all :grin: thanks for your reply:-D I'm gonna go for it and see what happens as far as I can see thats not my full CCA as you said no electronic signature box so if they have got a copy of this then they've not forwarded it to me. I Sent the civil procedure request and as I've also read on here Howard Cohen & Co said it didn't apply to them and that I have sufficient information already. So I'l try the 'neither admit nor deny' and if they can produce hope they let me change my defence. Kind regards -

thank you 42Man:grin: I'm gonna be doing my defence tomorrow:eek: and I'm hoping to put that I neither admit nor deny due to the CCA they forwarded been insufficient??? surely even though it was electronic they have to forward me the relevant papers that actually say its a CCA?? what would you think 42Man in your opinion? please Regards -

Hi 42Man I'm not sure but its no longer than 3 years I don't think. So I'm presuming it's enforceable as I've read that on here internet applications are enforceable after 2004 but what they have sent me doesn't mention CCA yet they say they've enlosed it? They're taking me to court -

ok thanks for your input, its appreciated:smile: and I agree with what you've said about natwest's response. The £1000 overdraft dropped today and we incurred £90 charges, so telephoned them again and they said that he hadn't had an overdraft since July!We had the paper work infront of us, so was put through to the lending manager he said they'd been having several problems with the online creditzone overdraft increase/decrease facility and he refunded the charges and put the overdraft back on. Will def be making a complaint to raise my issues mainly the loan cancellation rights, just to see what there response will be. Thanks again for your input your bank -

hello again:) Ye gonna put my complaint in writing tomorrow, my hubby's had several sharp phone conversations with them since We're actually not that bothered about them using the loan for the overdraft as we wanted to reduce it, but we won't be telling them that! ;-) as its the way they've ran the account thats just sooooo not on! Then ye as you say opening another account this week and will eventually be telling them to stick it where the sun don't shine!! Think I'm gonna enjoy this battle, as all my CC & DCA companys have gone very quiet over the last 2 months?? all 6 of em:oops: and I'm stopping myself from ringing em to ask why they have not been calling or writing ! I do hope that I have not upset any of them in anyway, lol -
