  1. Hi Haydn Ok, first things first: I think they HAVE to respond to your Subject Access Request, don't they? I stress: I'm NOT UP ON THE FINE LEGAL POINTS of all of this, so don't quote me, but I'm sure I've picked up from somewhere that, because of the Data Protection Act, they have to give you the information you request. Maybe someone reading this who knows for definite the legal stance on this can help?... As for what happened in court - well, the judge was so used to dealing with these bank cases that I didn't have to explain anything! He did all the talking, which was basically him summarising out loud my claim as stated on my Allocation Questionaire, and then, due to Barclays' no-show, he awarded in my favour. One question he did ask me was the date from which I was starting my claim - so I was glad I'd taken to court with me the previous six years of bank statements, and was able to give him a very precise answer! But that was pretty much it. I was out of there in ten minutes!
  2. Hi I've never posted anywhere on this site before, but I have been using its fantastic advice to get back the money Barclays have been illeagally taking from me over the last six years!... For anyone who is going through the process at the moment, here's how my experience went: I sent the initial letter to Barclays, asking for my money back. They declined. I sent the 'letter before action'. They offered me an insulting £280 (I was claiming back almost £600) as a "full and final settlement". Following the advice of this site, I declined. Their time ran out, so I filed a claim online through the small claims court. They entered a defence, (the usual word-for-word stuff about being fair and transparent) so I filled out a court Application Questionaire. (Again, guided through it by this site!) A date was set for the hearing, which happened last week. I attended, to represent myself - Barclays didn't even turn up! The judge awarded in my favour: the full amount, plus £50 interest, plus £80 court fees, plus £50 for loss of earnings for the day! So first of all I just want to say a huge thanks to everyone involved in the Consumer Action Group, for this fantastic site, and the work you're doing! And to everyone reading this who is in the middle of a claim: keep at it! Even if it goes all the way to a court room, it seems the banks know they're on to a loser, and you will get your money back!
