  1. Hi, many thanks for the reply. I have received a refund minus the £10 for the sim card, ill have to accept a loss on but im determined to claim the return postage back, any help is much appreciated.
  2. Hi, Thanks in advance for any advice. I purchased a mobile phone online for my wife from e2save via the Richer Sounds website. The phone was a Nokia PAYG costing £59.99 plus a compulsory £10 airtime. Included in the packaging was an envelope with the sim card and a note to say inserting the simcard would deem the phone as accepted and you would not be able to return the item for a refund. After two days the phone developed a fault where the handsets volume would not work, the phone was used with a different simcard and the supplied one has never been used or activated. My problem: I called e2save and reported the phone as faulty and offered a replacement on return of the faulty phone. By this time i had spent over twenty minutes on their premium phone number so i decided i wanted a full refund including return postage as the phone was faulty and would be returned within seven days of receipt. I was informed by a very rude person that i would loose the £10 airtime credit as the phone had been used and they would not refund the return postage.. is this right!! The phone has been returned by Special Delivery within seven days with a letter stating that i am requesting a full refund including return postage under the DSR. I am expecting some hassle from them in getting a refund in full and any advice would be greatly received....

I would really appreciate some help with the defence when the necessary details are supplied and is there any further details i should request that are not included below: REQUEST FOR INFORMATION I have received a recent court claim from your organisation. In order to file a defence and counter claim I require some information. Given that this matter is now the subject of legal proceedings, you are obliged to disclose under the Civil Procedure Rules, the information and documents detailed below. The information must be furnished within fourteen days of the receipt of this letter. If you fail to comply, this will be reported to the Court, a copy of this letter will be provided as evidence to the same and an Order enforcing your compliance will be sought. 1. A true copy of the executed credit agreement and any terms and conditions that applied to the account at the time of default and at the time the account was opened. 2. All records you hold on me relevant to this case, including but not limited to: a. Transcriptions of all telephone conversations recorded and any notes made in relation to telephone conversations by your company, or by any previous creditor b. Where there has been any event in my account history over this period which has required manual intervention by any person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my account formerly held with *********.(AMEND TO THE COMPANY NAME) c. True copies of any notice of assignment and/or default notice or enforcement notice that you or the original creditor sent me, with a copy of any proof of postage that you hold. d.Documents relating to any insurance added to the account, including the insurance contract and terms and conditions, date it was added and deleted (if applicable). e. Details of any collection charge added to the account; specifically, the date it was levied, the amount of the charge, a detailed financial breakdown of how the charge was calculated, and what the charge covers. f. Specific details of the fees/charges levied by any other agency in respect of this account and a detailed breakdown of said fees/charges and what each charge relates to and on what date said fees/charges were levied. g. A genuine copy of any notice of fair use of my data as required by the Data Protection Act 1998 h. A list of third party agencies to whom you have disclosed my personal data and a summary of the nature of the information you have disclosed. i. Copies of statements for the entire duration of the credit agreement. 3. Any other documents you seek to rely on in court. I will require this information within the next fourteen days. I must advise you that if the information is not forthcoming, it will be reported to the Court that you are trying to frustrate proceedings and denying me the opportunity to file a defence and counter claim.   4. Hi as far as im aware this is the first i am aware of this (letter arrived today) but i will check to make sure i havent missed anything from them. I can certainly say that i havent received any form of CCJ or interim CO. I have not got a clue who the original creditor is, as Cabot have obviously bought the debt. I can also be certain that the debt has not been taken by myself in the last ten years as i have only had two loans (one mortgage and one secured loan) in that time. Obviously i need as much information as possible but how do i go about getting the CPR info? It does say the a judgment was given on 8th Feb at Northampton CC.

  8. I have just received notification of an application for a charging order against my property and have no idea what to do. I have recently been to court in relation to arrears on my mortgage, with some exceptional advice from here i managed to get back on track and avoid a repossession. Now i have an application for a charging order against my home from another company (Cabot) for a debt i know nothing about. Any help once again id most appreciated.

Ok yesterday was literaly a five minute in and out hearing, GMAC opposed the suspension again (no surprise there) on the basis of previous payments not made, the judge replied that was history and ordered the warrant suspended. Absolutley chuffed here and a big thanks to everyone who helped especial Ell-enn & Andrew1 ....

A big thank you all again, although we aren't out of the water yet i would like to offer some advice to those who may be in the same or a similar predicament.... dont give up, explore every avenue there is and most of all stay positive. Another valuable exercise is for users to keep their posts updated as they proceed, as reading through other similar threads gave me a lot of hope and encouragement.

  21. Ill call them tomorrow and find out the date and make the payment on Thursday, the next mortgage payments due next week but i may call and make the payment myself on Friday in person. Otherwise im not sure if there's much i can do at the moment. I may get the property valued and use this as a last resort should the next hearing fail, to get an order to give me time to sell the property myself (which is an option).
