  1. I have finally got through to the court. Defence is due on or before Mon 10 Mar. I am on hols Fri 7 Mar-Sun 9 Mar. I therefore would plan to submit defence to arrive special delivery on Fri 7 Mar. Would the defence be harmed if requested documents arrived between 6-10 Mar. Requested timescales are cca 4 Mar (gave them 14 days), cpr 1 Mar (gave them 10 days). stanfranks
  2. My positon so far. Court phone is continually busy so do not yet have defence date. I estimate this as either Fri 7 Mar or Mon 10 Mar. Nat West solicitors acknowledged receipt of cpr and advised information would take 4 weeks. No acknowledgement from Nat West themselves. Solicitors have not acknowledged receipt of cca but have cashed the £1.00 cheque. Based on the maybe I should now be thinking about my defence. stanfranks
  3. I got a little confused with cca request and cpr. But I am now upto speed - cpr as per your template sent today giving them 7/10 days to reply. Sent to Nat West special delivery with copy to their solicitors. I have proof of postage of all letters sent so far. BTW my requested file from equifax arrived today and does not show anything relating to Nat West (is this good ?). I understand my next step is to obtain from the court the date when defence needs to be filed. I am also maintaining a log of activity from receipt of Claim Form.   4. As the Claim is dated 6 Feb and I have sent a AOS, does this mean a defence needs to be filed on Mon 10 Mar. I sent a cca request to Nat West solicitors but not a cpr request. If I send this today reply in 14 days is Wed 5 Mar - do I send the cpr to Nat West or the solicitors. The Claim Form states address for sending documents is the solicitors. Should I state a specific date for me to receive in the request. I am concerned the time-scale is tight and to make matters worse, I am away for the weekend starting 7 Mar but return PM 9 Mar.   5. Andy, On the AOS I ticked the 'defending whole of the claim box'. Did this via courts website. I also sent a letter to the court to advise I am awaiting further info from claimant so that I can prepare a defence. The court is Northampton. stanfranks
  6. Thanks Andy, No account numbers on claim. I have not yet defended in full as I am awaiting info from Nat West solicitors. However the CAB rang solicitors on my behalf and they gave 2 a/c numbers. I do not have a record of these. They also advised they would be putting a charge on the house. The debt may relate to a loan I had with Nat West. Due to re-organising my finances on-going payments may have been overlooked. This was 2 years ago and they have not chased for payment. At this stage I do not know if it is this loan balance they are claiming. stanfranks
  7. POC states: By an agreement entered into between the Claimant and Defendant. The Defendant has failed to pay the sum of 6715.41 or any part thereof. The Claimant has requested payment but the Defendant has refused or delayed to pay. The Claimant claims the sum of 6715.41 and interest under s69 of the County Courts Act 1984 at a rate of 8% per annum from 5 Feb 08 until judgment or sooner payment. Costs. The claim does not include issues under the Human Rights Act 1998. Does this help. stanfranks
  8. I have sent a CCA request via Special Delivery today. Acknowledgement of Service also sent to the court with a letter stating I am awaiting further information from the Claimant (Nat West) to enable me to defend the claim. The claim was dated 6 Feb - what is the time-scale for filing a defence. What happens if the info requested does not arrive on time. I need this to prepare a proper defence. Would the following help: No Default Notice has been received. No letters received advising issues with an account or that court action would be taken. Thanks stanfranks
  9. Thanks pt2537. The claimant is Nat West Bank. They are claiming o/s balance of a loan where they state I have refused or delayed payment. No correspondence has been received from them to advise any loan payments where in default. Although this could relate to a loan where the last payment was 2yrs ago with a balance owing of approx £ 4000. I will only know if the send a copy of the cca. I can provide more details later.   10. Hi, This is my first post and having read the threads regarding ccj's, I need some help. I have received a claim form dated 6 Feb 08 with amount £ 7000 incl court fees. I requested for a copy of the signed credit agreement plus account statement - sent by Recorded Delivery. The claim is for non-payment of an unsecured loan. No details where given on the claim form. This would appear to be a loan where I had overlooked payments. The loan company have not chased or contacted me until the court claim last week (last payment 2 yrs ago). I am concerned they may put a charge on the property even if payment arrangements are agreed with the court. Can they do this and also could they forced the sale of the house. Thanks stanfranks
