  3. Yes, they are trying to intimidate you! Stick to your original timetable of letters and send the next one in when their time is up. Keep us informed!
  4. Well my worries were unfounded, as the Halifax just opened an account for me over the phone... a regular current account with a debit card and cheque book etc. I was concerned about the credit check, as I have always fallen over that hurdle in the past. It seems that my efforts over the last 5 years or so to improve my record have paid off, so I am feeling very pleased with myself today!
  5. Thanks noomill, that looked very complicated! I complained to the Information Commisioners Office about Barclaycud and eventually they supplied what I had asked for (but only 6 years back from their compliance date rather than from when I initially submitted my SAR) so maybe I will leave this bit. I was only going to do it to because I could! Thanks for the info.
  6. Thanks for that, will look into them. I know I am more at risk of my accounts being closed after making a second claim. I am somewhat concerned about my huge £1300 overdraft... can't afford to repay that for a bit if they close me down!
  7. Not yet, was going to look around for some advice on a good parachute a/c to go for. Trouble is, I am not working and think it may be difficult to get another account elsewhere...
  8. After being refunded all the charges I claimed last year, I am going to claim again as the b*****s are charging me even more than they ever have done!!! I know I should have got my act together and not incurred any more after the last payout, but that doesn't mean they can still get away with it! ;-) The first letter went this morning by recorded delivery so we will see what happens this time!
  9. No I didn't actually make this request... according to the blurb "an informal overdraft request occurs when a payment is presented to us to debit to your account and either you do not have enough funds in your account, or a high enough formal overdraft limit." The only reason there were not enough funds to process whatever it was, is because I am still over my limit due to last months "arrangement fee" of £100. Funny how they fees change from month to month eh? The same fees on my joint account were £64 one month, then £75 the next. How do they work that out then, lol I almost wish they would just bounce the item, it would be cheaper!!!
  10. Thanks for your replies... I feel more confident about claiming again now!
  11. Hi all, I am putting together a second attack on HSBC after a successful claim last year. Hoping someone can advise me on whether or not HSBC is justified in charging these "arrangement fees". Basically what the blurb on the statement says, is that they are charging this fee (£125 this month!!!) for an "informal overdraft request", ie a payment/cheque/whatever has hit my account and will take me over my limit and they have had to decide whether or not to let the item through rather than automatically bounce it. Have they renamed the penalty charge so that it would not look like a penalty charge? Thanks!
  12. Has anyone claimed compensation under section 13 of the Data Protection Act? Just a quick question for you all... Has anyone claimed compensation under section 13 of the Data Protection Act due to "damage suffered as a result of a contravention of the Data Protection Act"? Any of you who complained to The Information Commissioner's Office about Barclaycard hiding behind the microfiche argument should know what I am on about! I am putting together my initial claim to send to Barclaycard and would like some advice on this matter PLEASE!!! Thanks in advance
  13. Well, I said I was ready for Barclaycard, but I have done nothing for months! I finally complained to the Information Commissioner's Office about B'card hiding behind the microfiche thing and eventually got a reply from them in my favour... they told B'card to do as they were told and provide what I had requested. However, B'card sent my the missing statements in Dec 06, and only went back 6 years from then, not 6 years from my original request in May 06. I have just added together all they owe me, and have guesstimated the charges between May and Dec 06 and put all that on my schedule of charges. No doubt they will disagree, but then they had better provide the correct info so I can work out the right amount! Here we go again...
  14. I have been busy with HSBC for a while now, but having received back everything I requested from them, I am now ready for you Barclaycard...
  15. My victory against HSBC is now complete as I have got back all the money I requested. Donation on its way!
  16. Just added my bit to the survey, and will send a donation as soon as the money arrives in my account... hopefully by the end of next week according to their letter.

Hi, I have just had the same letter you got, offering a smaller amount that I asked for. If they are prepared to offer as much as they have, then it won't hurt them to go all the way and refund everything you have asked for. I will be accepting their offer in PART PAYMENT, and will amend the bit on the letter (that I have to sign accepting their offer) to show that I will accept the offer so far but will continue to claim the rest in court if I have to. No reason to give them any extra time, you gave them 14 days, I assume when you sent the LBA. Tell them your original deadline still stands. Good luck!
  22. Well, been a while since I updated... I got no response from my first letter, so sent them the LBA. This time, it took them a week to reply, with an offer of £1775.00 (I told them I wanted £2088.75). I got the letter that said they would win in court but for "commercial reasons" they would rather pay up. Going to tell them I accept this figure as part payment only, and that I will chase them for the rest in court if necessary... I am wondering though, has anyone else done this, and actually received the part payment, and still had to carry on to MCOL for the rest? Or has the bank just gone on to repay the full amount?
  23. Hi, Will the claim exceed £5000 if you add the joint account to either of the individual accounts? If so you will need to make a separate claim for each account. I am claiming for my joint account in my name only, so you can do the same, it does not need to be a joint claim.
  24. FINALLY I have got it together (young baby in the house!) and sorted out my preliminary request for HSBC, requesting £2183.75 from 3 bank accounts and 1 credit card. Going to send it today, so the clock will start ticking from Monday...
