Every debtor I've encountered has lied. Plus most if not all the posts on CAG show how they lie, again and again. Additionally, creditors get lied to.

No, being unable to provide a CCA does not mean defaults should be removed. The debt is still due and payable.

The debt HAS been acknowledged. The law is specific on this.

Easiest thing is to pay it in full and it will be classed as 'satisfied'.

Actually to keep the default they do not need to 'prove' the debt is legitmate.

Simply phone them up and ask what address the 'debtor' was resident at and give your wifes dob to check if theres is different.

Probably the original debtor gave the creditor a false forwarding address, (yours). This happens quite often. Debors are crafty and people like you suffer!

The money is still o/s so totally acceptable for them to ask it be paid. OFT fully approve of this, see their guidance notes.
