  1. My apologies for the delay but just to let you know the cheque cleared. Thank you so much for the amazing site. It's changed how I run my life! And thank you to everyone who helped me out. I spent a good deal of time pooing my pants and everyone here really chilled me out and advised well. Thank you so much. I couldn't afford to pay the full 15% but I donated what I could. Is there anything I can do to help out with the site? Is there anything else I need to do in regards to my thread? Does it need to be refferred to the, ahem, SUCCESSFUL, section?
  2. YYYYYYYYYYYYYYYYYYEEEEEEEEEEEEEEEEEEEEEEAAAAAAAAAAAAAAAAAAAHHHHHHHHHHHHHHHHHHHHHHHHH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Cheque arrived this morning. Full amount.   3. Court said I have to send the letter i got to today as a fax and ask for a general adjournment to give time for the cheque to clear. That sounds right, right?

Ok I've recieved the letter she said had been sent. it reads as follows: "We refer to the above matter and to your letter dated 30 April 2007 Subject to our clients position in our letter of 25th April2007, as a gesture of goodwill and strictly on the basis that our client denies any liability to you, our client again provides a goodwill payment of £1.874.49. Our client, National Westminster Bank Plc, has forwarded a cheque to you directly in the sum of £1,874.49. We now await reciept of the completed Notice of Discontinuance" The amount they are offering is my claim and fees but with no interest added from the date of my initial claim onwards. I finally got through to the court and they said to get Cobbetts/Natwest to fax me proof of what they are doing and then to fax that with a covering letter to them for the judge to see. I am worried that when the cheque arrives it will have an account specified for it to be payed into again. (I returned the last one for the same reasaon) I really need to pay this money into my Abbey account! I have a feeling that the cheque has not actually been sent yet. Should I try to get them to do a transfer into my Abbey account and fax me confirmation of the payment so I can give that to the court? Can I do that? I have to call Cobbetts ASAP so Parkvale or anyone else, if you're about please let me know what you think! Thanks
  5. Does anyone know if it is possible for them to get money cleared in my account by the end of today? It would really help to have the knowledge when I speak to Cobbetts again. Thanks again for the above Parkvale.
  6. Ok I will do that. Do you know if there is any way for them to actually get cleared funds into my Abbey account by the end of the day? Do I suggest they send someone to their local branch with the cash??
  7. Ok Just got a phone call from Cobbetts asking if I had recieved a letter today. I don't get my post before 12 noon so I couldn't tell her. She said it contained an offer for the full amount of my claim. I said I'd call back when I recieved it. She said the cheque would be sent out today and I would recieve it tomorrow. But my court time is 11:30am tomorrow morning so there is no way I will ACTUALLY recieve the cheque before leaving for the court. What should I do? I don't trust that the cheque will arrive with no restrictions or conditions as they've mucked me about everystep of the way up to this point. Is there anyway I can get them to pay it straight into my Abbey account instead of sending a cheque? AAAAHHHHH it's very exciting but some advice would be good!! HELP!!
  8. Hi if anyone with any knowledge or experience has the time could you plese read my previous post? Probably going to be up all night stressing about it so if you think you can help please do! Tomorrow is the last day before the court hearing. I'm ready to go to court if I have to but I'd much rather sort it out beforehand! Do I need to try to speak to the District Judge tomorrow? How would I do that? I'm guessing you can't call direct! Thanks

Hi I've just picked up an answerphone message from Cobbetts saying thank you for the letter I sent (see above) but they have not submitted a bundle of evidence because they wish to rely on nothing further than what I have submitted already and that it would be a waste of everyone's time for them to do so. My court date is on Wednesday at 11:30am. I'm assuming I have recireved nothing in the post but I won't get my post from the Fri/sat/sun until tomorrow morning when the building manager gets in. Does this mean that I'm actually going to court with them on Wednesday? There's no way they can get the money cleared in time right? My Natwest account is dormant and I have strongly specified that I want a cheque with no restrictions. I'm a bit flustered by this. Is it normal? What should I do? Call the court tomorrow? Call Cobetts? I would really appreciate someone taking the time to advise on this so I can get cracking first thing in the morning as, like I said, the court date is set for Wednesday morning.   10. haha fair play. I just know I'd read about people getting 3 times their claims in some situations, I figured that was how they did it. Not sure how I felt about it anyway, I want to be able to tell people how I did it and help etc. (if it all ends ok!!) I was thinking how helpful it would be if they were to cancel my overdraft and loan as well. It amounts to about 2 thirds of my claim again. It was only a thought. I'm ready, got all my figures written down and I'm thinking of my Grandma for politeness!!

If I were to accept an offer of more than the amount claimed in return for a "gagging clause" that would mean that I would not be able to ever mention my win on here or anywhere else right? so my experiences would not be able to help anyone else? is that right?

  13. Hi So I sent the letters. I added a reminder of the timescale onto the one to cobbetts and sent the courts a copy of it. So I guess as Parkvale suggested I'm waiting for them to contact me today maybe? Any advice on how to deal with any negotiations? Thanks
  14. Ok Thank you very much. Off to the post office I go then! So that means I should restate in the letter I send today that I want the cheque sent to me and not credited onto my dormant account? (Sorry for all the questions)
  15. OK Thanks. I'll do that. I have a couple of questions if you have time? If they want to negotiate with me tomorrow am I within my rights to ask for a cheque to be sent rather than having my Natwest account credited? As far as I'm aware the account is not active. Should I remind them of the timescale of this in the letter I send today? Thanks again
  16. I'm thinking I need to write to them reminding them that as my Natwest account is either dormant or dead that in order to get a cheque cleared in a different account they need to send it NOW! Should I email Cobbetts? AHHH!

Hi I'm sending the above letters today but before I do can someone advise me on the following?: In the letter it gives the bank 7 days to comply or I apply to the district judge for the case to be struck out. I waited until Friday (just gone) to call the court and check nothing had been sent to them but now, if i send the letters today, they won't be recieved until Tues at the earliest and 7 days from tuesday is the day before my court date. Is it worth it? Should I not just apply directly to the judge now? Am I missing something? If I'm going to send anything today I have to get it in the post by 1pm so if anyone is around and reading this I'd really appreciate a res[ponse. Thanks Again
  18. Hi would really appreciate some advice if anyone is free? ThenI can get whatever I need to send in the post by the end of today or at least by tomorrow morning and it would arrive on Monday at Cobbetts and the court. My court date is 12 days away and I'm getting a little nervous. Don't want to slip up at the last minute! Thanks
  19. Hi Parkvale and everyone else. Ok as you advised above I've waited til today and just called the court. Natwest have not filed any evidence with the court and I have recieved nothing here. What should I do now? I have drafted two letters which I will paste below. Are these ok? Should I even send the one to the court? Or should I apply directly to the judge straight away? Again, advice would be very gratefully received. I will be working between 12 and 4 today but it would be great if I could get any letters sent by last post so if anyone is around and reading this today a reply would be fantastic! Thanks Letter to Cobbetts: Claim No: 7****** Hearing date: 27/06/07 at 11:30am Dear Sir/Madam I write in relation to the claim as detailed above, and specifically the order made by District Judge Armon Jones dated 15th May 2007. You were ordered by the court to by no later than 14 days before the hearing to file and serve the documents upon which your client intends to rely at the forthcoming hearing. A copy of this Notice of Allocation was included in the evidence bundle I sent you. This date would have been today, 13/06/07. I have, to date, received no such documents and accordingly I hereby request that you do serve upon me these documents at your earliest convenience. I consider your non-compliance to be particularly unacceptable in view of the fact that you are specialist solicitors representing a large financial institution with vast resources, and feel that your litigation should be conducted in a professional manner befitting of such a prestigious organisation.   20. I have heard nothing from Cobbetts or Natwest and recieved no evidence bundle from them. the court date is the 27th with instructions to have swapped evidence no later than 14 days before hand. If i count from tomorrow (14th) then the 27th is the 14th day. what should I do now? Inform the court? Will someone advise if they have time please? Thanks so much.
  21. Hi I have a court date set for the 27th June. i and NatWest have been ordered to exchange evidence and send to the court. I have sent my two bundles. If Natwest fail to send their bundle will I have won by default? At what point is the 14 day limit up? The beginning of wed 13th? thend of wednesday? What should I do if I recieve nothing? Any help or advice would be greatly appreciated. fairly stressed here. Joe

  24. Still heard nothing after sending the cheque back, (see above). I'm getting a bit twitchy and nervous about it again. Could anyone reccommend a course of action? Should I call the court? I filed my aq on 26/03/07 and have heard nothing from them since then. Is this normal? Any help would be appreciated. Thanks.
