Thanks Alan much appreciated As they dont want me to inform the ombudsman, i would like to inform the OFT and TRADING STANDARDS after i`ve had a response concerning my CCA,as they would not comly with both of my requests. Regards gordon -

With regards to the letter from the manager, i never contacted him and made a complaint previous to the 15th, i phoned him on the 18th and he said my PPI was under investigation as a complaint had been filed. I sent for an SAR (Subject Access Request) on the 22nd dec and as you can see from the reply, they to think that 1. i`ve made a complaint and that 2. i will not be recieving my PPI until the investigation is complete. (what investigation and what complaint?). Should I wait or send them a letter stating stating the terms of the data protection act 1998 or wait for thier response? Regards Gordon -

I also have record's from the Ombudsman stating the had said, "that no payments were recieved from Oct 2005 - Jan 2006, and as by the HFC statement it clearly shows payments were made ,also that, HFC contacted me in writing saying that," as you have maintained three monthly payments as agreed with in Oct 2005-Jan 2006", (which was never agreed in the first placed). they have basically admited with regards to the documentation they sent to the ombudsman that they have lied. But as it stands, i've nothing to say that i have been defaulted, other than whats on my credit file. I have sent then a request for my file with a CCA, but i already know what the outcome of that will be, then i will send a S.A.R ( subject. access. report), then hopefully find out some info as i have absolutely nothing, if they don't comply to my requests and execute them accordingly, then i will send a letter to Trading Standards. Have you an idea of what i should do next? regards

Mording everybody, could anyone help me i wonder? HFC/Beneficial finance defaulted me on my loan, and i've been reading some threads on DCA'S. I for one have had no involvement with a DCA, i've made no arrangement with anyone apart from the person who sold me the loan ( which is in dispute)and not the bank itself, although i'm paying half the contracted amount of the loan. Can the bank enforce the default without the involvement of a DCA? Regards

Hi there, I wish to take one of my creditors to court after the 8 week response time is up, and time is up 17th jan 2008, are there any threads that will clue me up legaly, i'm not affraid about going to court, because they have to prove that they sold me PPI product, and they have absolutely no chance of that, i am just in need of a prep guide to ensure i know what games they play in a court of law, and that i've got everything i need. Any advice is good advice as it is more than i know now. Regards -

Hi everyone, I've been on the FSA website,typed "misrepresentation" in the search bar,and down the list in part 8 (DPO6/4), section 2 gives what i think is a piece of usefull info, of what to expect from the banks regarding your PPI, with my prospective , i think that if you have a serious case with mis-selling of PPI, then this is a step in the right direction, as it out lines in none legal terms the requirements that the creditor, not the the supplier has to obide by. As in both my cases, the creditors put me in categories that they new i was not in, thus breaching and misrepresenting the sale of the PPI. I hope you find this to requirement. I have, i've been looking all day, and in certain threads it's talked about in depth, arguments more for in my interpritation, i'd like to discover and read both Consumer Credit Act,(which i seen last night), and the act that was used as a reference, could you point me in the right direction, as i'm trying to build up my case in the correct manner, or could you tell me how i link to the threads that are of interest to me? Hi everyone, I've been thinking back to when i applied for two different loans at two different times in my life, firstly, i was unemployed and given only the total amount of the loan,thus not given any info on the agreement itself, secondly, i was self-employed and advised that i should take out PPI, and as part of the PPI from hamilton insurance was critical illness, serious injury, health and sickness, then why was i brainwashed into accepting unemployment cover from the actual people who were supplying me with the loan, and when, the person dealing with my loan application was niotified of my employment situation she still pursuaded me to accept the cover anyway. Surely this should count toward (something like) benefiting the creditor an not the debtor. Any comments would be gratefull. Regards

Hi everybody, Could anyone advise me on this issue. Previously i had a loan with First National, but do not have the documentation. If i were to send for an S.A.R ( Subject Access Request) , would they still be able to handle my request with just my address datails, as i do not have nor have had any other finance through them. Any thoughts greatley appreciated. Regards.
