  1. I posted my letter recroded delivery to Citi Cards on the 10th of August, this week i received a photocopy of a signed agreement dated 4th of september. The only problem is its for someone else. Where do i stand? Unfortunately ive been working away so only just got it yesterday. \Today im away for a few days so cant reply straight away. Thanks for any help.

  3. I assume this would be suitable along with my account info etc:- I would be grateful if you could send me a copy of this agreement. I understand that under the Consumer Credit Act 1974 (Sections 77-79), I am entitled to receive a copy of my credit agreement on request. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. If so its going tonight recorded delivery

  5. With Citicard, does it matter that i am already trying to claim back from them? I have already had partial payment but they refuse to pay what they owe. I would rather put my small claim (the form has yet to be taken to court) on hold and try and get the debt made unenforceable and perhaps reclaim all i've paid.
  6. Im not sure where to post this but can someone give me some clarification. I presently have a loan with the student loans company (scotland), if i were to request a copy of the original signed document and they cant provide it would this mean that the loan is unenforceable and could therefore be wiped? I am presently paying this off and have never defaulted but i would like to try and be free of it asap. I also have a Citicard which im in the process of filling in forms for the small claims. I have had this card for nearly 10 years and this was previously with peoples bank prior to it switching to a citi card. Again if i ask for a copy of the original document and they cant provide it am i able to do the same as what i would like to do with the student loan?

Well its 14 Days since my initial letter was sent (The 1st letter was ignored so i sent another copy via recorded post - i thought i would give them the benefit of the doubt) so im off to the post office later today with my LBA. Again this letter will be by recorded post, no way are they going to ignore me now and i will just stick to the timescales suggested. Edit: - I do have another account that i have been using so im happy for A & L to close my account, providing of course they hand back my money.
  8. I have sent my preliminary approach for repayment to A&L and have since received a letter to say that the OFT were infact commenting on credit cards and not bank charges. I know this is BS and is a delaying tactic, however what i need to know is do i now send my LBA as per the timescale?
  9. I have been chasing citi cards for a refund of my charges. They have offered a partial refund which i accepted but told them i would still be pursuing for a full refund. They have since written back stating that should i take legal action that they will defend and intend to do so at salford county court. Having read various threads i understand that they wont follow through with this, if they do then i can have the court case in my own town (im in scotland). The refund im seeking is less than £750 (this was the case even before the partial refund). I still want the rest of my cash back and would like to take the next step which is via the courts. Im just looking for guidance really. I also assume i cant file a claim via moneyclaim as this looks to be england and wales only.
  10. Its taken less than 2 weeks and only a preliminary approach for repayment (which included an error on my behalf) but they have paid up! Im absolutely delighted to be getting my money back and its a nice little figure If i hadnt come across this website i'd have never know you could claim it back. Thank You!   11. I'm preparing the letter asking for the cash back. In total over the space of 5 years this adds up to £661 :o , the interest on the spreadsheet comes to £159.19. Would this be correct? My other query is this, the preliminary approach for payment letter template states the total they have taken and also interest. Do i include this in the preliminary request? i.e do i just ask for the £661 or do i ask for the full amount including the interest, reading through various posts and the FAQ i am under the impression you can only ask for interest when it goes to court. A tad confused so any help would be appreciated.
  12. I've managed to dig out a statement with A&L's T&C's on it. Monthly Overdraft Fees Authorised £5 _______________________________ Unauthorised Day 1 No Charge Day 2 £25 Charge Day 3 No Charge Day 4 No Charge Day 5 £25 Charge It would seem the above replaced the daily charge of £3.50, going by this i assume i can claim the £25 back in the same manner as i am for the previous daily charges. Would this be correct?
  13. Can anyone help clarify the 'monthly overdraft charge' (mod) that A&L charge. I have just received the last 6 years worth of statements and have so far totalled £389. What is confusing me however is this monthly overdraft charge. This varies from month to month, from £0 through to £25 and appears to be applied irrespective of me going over my limit or not. I am of the understanding that the overdraft was 'free' albeit it did incur interest each month should you use it. All i want to know is, can i claim these charges back? I can see no reason why the charge fluctuates so much from month to month, the only conclusion i can draw is that in previous months towards the start of my account opening there were daily charges for going over the limit. This seems to have been dropped by A&L as i go through the statements. I would be really grateful for any advice. If anymore info is required please let me know.
