  1. hi, after almost a month of phone calls and visits we finally got the cheque, short, what a surprise but not by too much.Thought a bit of happy news would be nice to post. Thank you jowwashy for your support! Hubby still on the lookout for jobs, but got a couple of good ones linned up, so fingers crossed! elle
  2. Hey guys Im back with a hot little letter from carbot that popped though our door this morning! Help and advise needed as per normal!!! They have basically sent us a copy of the debt when B/card sold it onto them in 2004, requesting us to phone them, oh sure like we are going to do that.Then there is a selection of what they call "a representation of the letter sent on 29/09/04." This was not recieved by ourselves, but this is the account was sold to carbot on 24/09/04. There is them almost a totally unreadable orignal copy of the application to B/card.Dated 1996. We fell into problems in sept 98, this, we think is when the payment problems started. All the corespodence has carefully been copied since the debt was sold on. We have a couple of copies of "invoices" which we never got stating the total outstanding amount, dated 2004 and zero payment showing. I am sitting here not looking at anything that shows me a date when the last payment against the debt shows up and I realise, from you guys, thats the one thing we need to know. I dont know what to do next. I think the last payment against this debt was over the stat barred period, but how do I find out. I have to say the letter is not aggressive,which made me feel like they were trying it on. I hope Ive not just written a load of rubbish, hopefully one of you out there can gently push me towards my next step. as always yours, in awe, nelix
  3. My husband did some work that he was due commission on, it was due feb 1st. He has been given the run about for the whole of this month. The amount should have been about £1500, but was informed, due to problems with the installation, it was going to be less. He has phoned and been told" the cheque is in the post" which it obviously wasnt. I have to be honest and say he isnt one for confrontation, but Ive pushed the point. We have several emails refering to the "deal" and after speaking to a very good switched on friend, has told him to get himself in front of this guy and get the forms for a small claims proceedure in court. But you have been all so kind and helpful to me before that I wondered if anyone might have any other comments on this??? My hubby has been made redundent in Jan' , so this was freelance work, and we need this payment. By the way, no repsonse from the dreaded debt agency since we sent the letter you told me too. Think it was stat barred, I thank you from the bottom of my heart from taking that worry from me. hope everyone is well nelix (real name elle, used my cats name!!!!!)
  4. Hi everyone had another letter today, have a feeling we are responsable for a whole load of trees coming down! This one says they havent been able to get the information within the relevent time period, but are continuing to do so. But we can try if we want too. Er this isnt my problem:???: So my question is do I still do nothing or should I be responding? Bare in mind we think this debt is possible stat barred. many thanks as always N

  6. hey eveyone happy new year. We have had a letter back, 1st intesting point is thery have knocked a clear £600 off of the total amount. They also state they have put the account on hold, the orginal lender is experiencing a delay in retrieving the information from the archives. Their problem not mine! So Im at it again and seeking your help, do I sit on this now til I hear something or am I meant to be replying? all the best n
  7. I feel like Im always saying thank you! Im really glad you didnt understand patricks post too hippy chick, as I sat and read it twice and felt like a right dumbo! Im going to sit on the outcome of the ccas' sent and see what happens. I did put the sentence "I do not acknowledge this debt to you" on each of the letters. As this is not my debt, he is pretty vague as to when the last payment was, but it looks border line that it was 5 /6 years ago. They lost him as we moved. We are in the fortunate position of them not having a phone number either and I intend to keep it that way.   8. hey shane, sorry, Im all over the place! NO I didnt send a stat' barred letter as frankly Im not sure if it is applied, the debt is about 5/6 years old.I actually sent a CCA letter. Im waiting a reply, which came, saying they were looking into it and returned my PO for £1, but it seems they like me so much that they send futher letters! Having said that its not me but my partner. Im rather cross with him cause I didnt know about these "little problems"but Im prepared to fight the fight for him!!!

Hi guys recieved another letter today from cabot that states if they dont hear from us one of the following WILL happen an external collection angency will call a warrent of execution, this instructs bailiffs to take items from my home and sell them to pay the debt. a charging order. an attachment of earnings order an order to obtain information. a little man with plyers to pull my fingernails out....just kidding! Now Ive sent this mob a request for CCA and they sent me a reply on the 6/12 and told me it would be up to 12 working days to get back to me. That takes me to the 27th. They also sent me the po for £1 back, which makes me wonder if they know this debt is stat' barred. This is where it gets interesting, each letter has a different amount on it, changing by a few pound up and down, whats that all about? oh and it was sent 2nd. So should I answer with a copy of the two previous letters, my request and their reply or just ignor. any help gratefully recieved! nelix
  10. no, its day one of the so called 12 day wait. To be honest Im not worried, just a bit confussed as to if 1st credit and First credit are one and the same or different. Since coming on here and talking with you all, Im in a much better calmer state of mind. Whats the worse they can do:rolleyes: I was at deaths door a few years ago and thank God every day for being here and know...all this may seem important to lowell but it takes 2nd place to my health. once again, thank you for the replies, you are a smashing group nelix
  11. Im very confussed!!! anyone help me??? Been doing a bit of digging. I have the first letter from lowell saying orginal creditor: First credit and it states the orginal debt address as where we are now, which is impossible as we havent had any credit here at all. The next 3 letters the orginal creditor changed to 1st credit, same reference no and amount, this was a clear month letter, but the original address had disappeared.The 3rd letter dito, that was in reply to my cca request. I did a search on the two companies and they dont seem to be one and the same. Anyone got a comment:confused: I assume Im right in saying that only one DCA can hold a debt at a time.

  13. My partner has 2 debits running at the same time and it was suggested that I keep a separate thread on each. So here it goes so far! The orginal cerditor was 1st credit. Im lead to understand it could be neally 5/6 years ago that a last payment was made, Ive written and given them the £1 for a copy of the CCA. At this point they have written back and said they will forward this within the next 12, maybe??! Im assuming that will then give me the date of a last payment, and Im keeping my fingers crossed! All the letters he has recieved have been 2nd class, and Im keeping a detailed record of everything, as per all of your very helpful advise on here. Will post when I need some more guidence, as Im sure there are going to be many twists and turns to come. Its just great not to be alone and my partner is so proud of me taking this over, leaving him free to consintrate on keeping our house running! We have no credit cards now and I only deal in cash now, so I guess I have learnt a very hard leason from this. I also know ours is a small debt, but having said that I think we all worry the same whatever the amount is. This site is worth its weight in gold:D neelix
  14. thanks for the quick replies...I love this site!!!! I didnt explain myself clearly did I??? The second debt is currently being held by 1st credit, who ever they are, and they were happy to cash the po. The carbot debt was the po we had returned to us. So they are 2 separate debits, one of which I wasnt aware off at the time of first seeking your help on here, but thats another story:rolleyes: Im afraid I havent got a clue how to open a separate thread for the 1st credit debit, if some kind soul can for me, I can then detail each one as it unfolds. I would like to say , once again, how empowering it is to have your support and advice. Thank you. N
  15. hi, bit of un update from me and if anyone can chip in and help Id be dead grateful! We now have a letter back, 2nd class, returning the £1 Postal order, and with a coving letter stating cabot not not accept the statuary fee and is returning the fee. Also they are not obliged to provide this information but are pleased to help and have already requested documentation. Bit surprised at reading that! I found out after my orginal post that there are in fact 2 debts, the second is with a company called 1st direct. I didnt bother to mention it as I was a bit fed up with my partner, and I just followed the same advise you gave me for carbot. This is where it gets interesting! They cashed the PO and are saying they will endevour to get the information within the prescribed 12 days. So I guess my question is what do I do now and more importantly why are the replies totally different??? Any help will be very gratefully recieved! neelix

  17. Ive sent the letter this morning but he recieved another letter from them. Im guessing its box standard and have been covered over and over here ,but could some kind soul give me an opinion?It is headed up...Final demand, your account is now with the pre-litigation department. They go on to state a charge against our property( we rent:| ) could be made or a deduction against wages could be made, if we dont contact them. Up to this point they have NOT had any payment from him and just to remind you this has all started up out of the blue from a debt that is borderline 5 years old. So my question is, Ive sent the letter, they should get it tomorrow, am I right in thinking we need to sit back and wait for this validation at this point??? One thing Ive got to say is you guys have taken the complete fear and panic about opening these letters away:) neelix
  18. thank you. This is one heck of a site!!!! Ive now written my letter and Im sending it special on monday, with our £1 fee and a letter that says this is NOT to be used against the debt...etc etc. I guess I, or rather my partner, is at the begining...Im wondering if anyone can pre emp' what is likely to happen with this cabot (in my head its' carboot sales..tee hee)
  19. Its cabot, and I read with amazement at some of their antics. The strange thing is the amount is nothing like the original amount, its almost trebled, but Im guessing this is the norm' We have had a countdown of threats of personal visits, nothing happens. I really do want to get this sorted. Since becoming a member on here I cant tell you what a weight has been lifted from my mind. I pratice CBT in my personal life and ask myself what is the worse that can happen, I will not be bullied!
  20. Hey everyone, Im still a "baby" on here and learning so much from you all. I just wanted to point out how refreshing it is to read these threads, they start off with people really worried and then with the help and support of you all,you turn that person around! me included! or rather my partner. can anyone tell me what the abbrev' CCA is??? Ive been wizzing about and still cant answer that one! Im involved as an admin on another site to do with emotions and dependenses I know there must be some links with this site in this direction. These "people" who will stop at nothing to get their money back, dont seem to understand how deeply ashamed and upset this makes us, having this hanging over our heads. Someone said before, the not sleeping, I hate to think of how many of us "bury our heads in the sand". I think until you are mentally able to deal with this the whole thing just keeps getting worse, its a ctach 22 situation. thank God there are sites like this that make people not feel alone, its true what they say: there's safety in numbers...and above all knowledge! all the best to you all N
  21. Hi guys, my letter is ready to send off but there is just one thing Im muddled on. Am I sending a £1 PO with it, as Im asking for the records of the debt? and if so do I reference it in the letter or just inclose it and wait to see if its cashed. Once again thanks, nee.
  22. I think its brilliant your mum is supporting you though this. I think the feeling of being alone, is a huge issue. Once you have someone there to voice outlould what is going on and how you deal with it, it takes you to a different level altogether. Your mum is a star; be as honest as you possibly can with her and fight the fight together! N
