  1. after reading this thread I am completely confused I took one of these plans out after offer was posted to me, I've paid three months and my boiler is playing up have I been ripped off..............?
  2. Evening all I am very stressed with everything tonight, and feel like I am banging my head against a brick wall. Tried to contact payplan can't get though or the CAB......tried the solicitors Horwich Farrerly the number the land reg have provided just rings out. the only person I managed to get through to was the Land Reg office, where a very helpful man got my file out and said all he could really tell me was there was a court date later on this month (after my bankruptcy) for a final charge hearing. He couldn't tell me what address the correspondance have been going to. He said t ring Sols I explained number ringing out, he then offered to give me the womans email address at robinson way who was dealing with it. I have emailed her asking for a court case number so I can contact court and also the address where they are sending my correspondance as there is no possible way the mail can be going missing. We 'should' of had letters of the solicitor robinson way and also the court and I think they would come twice copy for me copy for my hubby. Me thinks they are playing stupid games.........its peoples lives they are messing round with. I'll update 'if' she replies thanks xx

  4. hiya I rambled and confused the post sorry... Hubby had personal loan with Nationwide in aprox 2003, (before he met me) We married in 2004 and hubby came in on my mortgage. And ended up struggling and went on a joint DMP that was prob 2005. Nationwide got the biggest slice, but still went for a charging order. Payplan in fairness were next to useless, and we were no better. The debt is now £37000.00 with interest and charges. The house is in negative equity so they wouldn't get the money even if we sold it, but I can not understand how the debt can rise so much! thanks
  5. ok hope someone can help this is an old one, but I am today grabbing the bull by the horns. In 2003 my husband came in on MY mortgage and we got married had a baby etc, shortly after the mortgage we took out with 'kensington' went up and up in the end we ended up on a DMp with payplan. Nationwide sent somebody out to our house and then went straight down the route of CCJ then straight for C/O even though we were keeping up payments with payplan. Long story short we didn't defend but payplan did with the prefernetial treatment of creditors. They still got the final charging order on a debt that was my husnads before he even owned a house! We got a statement yesterday an original £8000 personal loan paid for 18 months at full rate then paid for 12 months at DMP rate aprox £60.........is now a whoping £37000.00. Is there any avenues we can take this down thanks
  6. Hi Its ages since I've been here, but wonder if some kind sole could help me please. I have received a land registry restriction order B136(CO) order this morning from the land registry. Its do with an old halifax debt being handled by the delightful Robinson Way c/o Howard Farrerly. Anyway this is the FIRST notification I have had. It states on the 3rd December in Liverpool County Court an interim charging order was granted. It then says as a result of the application (28/01/2010) RESTRICTION is being made. Does this mean they have already had a final hearing? I can't understamd why I have had no notification of this from either Robinson Way Howarth Farrerly or the court. I have tried Howarth Farrerly closed til Mon, spoke to someone at Robinson Way but there legal dept is closed til Monday. The only thing I can think of is we moved out for a few months last year when Kensington repossessed our house (and then gave us it back, there is a thread somewhere abou it) While I never told the creditors I moved we did have bills go there in our name, I'm wondering if they have found a connection and tried to chase us there? Anyway sorry to ramble my question is if a judge has had a final hearing but its still registered as interim at the land registry (I have til the 18 feb to object). When I go bankrupt on Friday will this be included or if a judge has awarded a final will that stand. Does that make sense? I'm not very well at the moment just being diagnosed with Systemic lupus erythematosus and this has kicked me off in so much pain today. thanks in advance Tracy

  8. Hi No I did not receive anything until I got the actual judgement......(but, we had our house repossesed a couple of months ago via Kensington Mortgages. The thing being they never actual took possession, we moved out and waited for the bailiffs, then at the last minute with the new goverment laws Kensington offered us a deal and we are about to move back in!! This is true as far fetched as it sounds )(my story is on the repos board) So the whole time we had the keys and we were getting the post, so I *know* it never arrived. So I don't think lost in post would be good enough. The think being with the debt it was originally 506.00 and is now 1811.00 surely these are unlawful charges, could I appeal the judgement on a N244, stating I never received it and also that the charges make up most of the debt? Or should I just bite the bullet and go bankrupt and be rid of all my debts. thanks sorry its a waffle
  9. Hi can anyone please advise me. I received a CCJ for 1811.00 for Creation Store Card, this was apparantly granted at a court in Clerkenwell on 02/03/2009. I received this about two weeks ago. A week later I received an interim charging order this was dated the 06/03/2009. They haven't even given me a chance to reply to the ccj and they went straight for the charging order? I'm a bit confused to say the least, i didn't know they were going for a ccj for a start.......I would of contested it as this was a £500.00 debt the other 811.00 is in relation to charges. We have been dealing with payplan up until a couple of months ago when I lost my job. So there are a lot of other creditors that I owe to. There is negative equity in the property to..........what can I do edited to add there is another charging order on the property in my husbands name this is down to nationwide who were getting regular payments via payplan but still went for the co and we were stupid and contested nothing. thanks
  10. thanks Ell-enn It does sound good but they have been so unco-operative even when we first had problems they said oh phone the CAB if you can't pay! I just don't trust them. And before these my mortgage was with the halifax so I've never understood why I ended up on sub prime at the time my credit rating was ok, (its not know its horrendous). We went through a broker aps mortgages and this was the only mortgage he recomended. If I could turn back time!!! anyway I'll let you know 'if' the letter arrives. Have you heard of this new department within Kensington? Its called the Special Servicing Team and they are based in Reading. This woman said they have been set up to help people like us, but searching the net I can't find anything on any forums or anything? xxx
  11. hi Ell-Enn and anyone else reading, I phoned this morning and she was on another call, I left my name and number and said it was extremely important she rang me back I didn't think she would anyway she did ring me back. I was very calm but to the the point, and thanked her for ringing back and then went on to say I was very upset over the letter I received at the weekend and could she expain. She said she had been continually trying to contact me and the last time she tried to contact me somebody had answered the phone and said have you got nothing better to do than to ring and put the phone down!!! I was very confused and asked had she definitely rang the right number? She was adament, I then said I wanted the time and date of the call, because if it was one of my older kids I was going to kill them (not literally but you know what I mean) She said it was Thursday 12 at 2.59pm, I know for a fact there was nobody in my house at that time hubby gets home from work at6 i would of been on school run and the two elder ones don't get out of school until three and I meet them on the way home and they don't have keys. She seemed a bit puzzled. I stated 1) why had she not rang my mobile, most of the conversations we have had have been on my mobile, she said she had, I argued she hadn't I get notifications if I: get called even if its switched off! 2) I: kept my part of the bargain had sent the cheque etc and she stated they hadn't received it ...........strange that since you cashed it on Friday!!! She agreed to bring the account back to SST and come to an agreement she needed to ring me back. She asked was I on this number all day I said yes and I said you have my mobile number. She checked it with me? No she had the wrong one, hence why she couldn't get through to me. She also had the wrong house number she was using my contact details from when we first took out the mortgage. Even though two weeks she had spoken to me and changed my contact numbers. Two minuted later she rang me back, ooh they found the cheque surprise surprise. So she went through the agreement, we have to pay the interest only figure on the first of the month starting on 1/04/2009. that includes nothing off the arrears for now? I asked when would we be going back to court to get the possession order suspended she said there was no need while this agreement was in place no further action will be taken. I'm not happy with that myself would appreciate some opinions (I simply don't trust them they play dirty) And I will get it all in writing in the next few days. Oh and it will be interest only for a max of 12 months and will be reviewed three monthly. What do you think, thanks Tracyxx

Hi no I didn't send it recorded delivery it was the letter with the 75.00 enclosed and it was to the Swinton address, I'm sure that is the address she said to send it to but am worrying thats what the prob is and I've sent it to the wrong one. The call I took on my mobile in the middle of a massive busy shop. She just said send it to our Swinton address (I think)

Thanks Ell-enn I hope all is not lost I've been really stupid and didn't feel strong enough to take anymore, and moving here was the biggest mistake we have ever made, after I got that letter yesterday I went in the garage (only place I can fit my dryer and freezer) and the door came crashing down on my head, it snapped off the runners completely. Along with the broken boiler and the leak in the hall I've had enough The floodgates well and truly opened and I've had a good cry but am feeling stronger now. I will stay calm when I phone her I think they are just playing games. I did attach a covering letter but it was handwritten as I was at my mums and she doesn't have a pc. It basically said the account number and we enclosed the £75.00 fee for our mortgage to be changed over from repayment to interest only as per the agreement with there SST Team. thankyou so much I really appreciate your help. xxxx
  15. i have all the letters, but she phoned me to say it was agreed so I don't have that in writing. I didn't send it recorded delivery, I'm going to check bank tomorrow as it was a cheque (from my mums acc) as I don't have a cheque book.
  16. Hi Ell-enn I intend on ringing her tomorrow typically the letter came on a Saturday and they were closed. The second letter actually came from her to, and I've done everything she asked and was waiting on her to come back to me. Would greatly appreciate help with the evection, I'm stronger now and I'm not giving this in without a fight! xx
  17. Oh I hope some kind person out there can help me get back my family home. Heres whats happened so far, we fell into arrears with the delightful completely unhelpful Kensington Mortgages due to illness and then a family bereavment. At the time we only had two months arrears and would of managed to get back on track but then I lost my job. Kensington sent out this debt counsellor and charged me 75.00 (twice because I was out the first time). He basically told me if I couldn't clear the arrears in 4 momths and then he said 3 months then I should forget the house. He told me I shouldn't be buying nappies for my children and should buy cheaper light bulbs. He left me in absolute tears and told me I couldn't afford the mortgage. We give up, I ended up on some nice anti depressants of GP went to court in November and said I wouldn't contest it they could have the house but we would like some time to try sell it. Lovely lovely jusge who gave the solicitor (th solicitor had laughed at me in the waiting room) a right earful for demanding a 28 day possession order and then awarded a 56 day outright possession order. We went home and found a private house to rent ((which is far to small far to expensive to keep and falling to bits) and spent the next two months uprooting our four kids. The order stated that we should be out by 5/01/09 we still have some stuff there and were expecting abailiff letter ....nothing came. Then a few weeks ago we had a letter of the Kensington SST (special servicing team) who claimed they wanted to come to an arrangement with us. We were exstatic we could go home (we thought) , we had to fill in an income and expenditure form and make an offer of what we could afford. We stated that if they out us on interest only for a short while we could afford I spoke a great lengths with the lady told her the ins and outs and she seemed really nice and understanding. Anyway she phoned me on my mobile in the middle of Primark with my daughter on the 4/03/09 and said our proposal had been excepted but before they could go ahead with it I had to pay the 75.00 fee to go interest only and then she would be in touch. I sent that the next day and have heard nothing since. Until today when the bombshell came through the post, its basically says because they have been unable to contact me or come to an arrangement that my account has been sent back to Kensington collections and they will be applying for an eviction order. What the hell do I do know. Please somebody tell me why are these people playing with my head I am allready on anti ds. In the first place we asked to go on interest only 4 times no reply We asked to go on a different package as it kept rising and rising they blamed libor. After the court hearing we asked for a settlement figure 3 times no reply. And now this. I just want to go home please help Tracy xx:(
  18. Jeez sorry thought I posted in the right place......poo. Would you believe I'm a forum mod for ivillage! lol:? Anyway no I'm not happy paying, £622.00 at all hence why I'm here, I'm furious tbh. The price I expected to pay was 6.49 x 52 = £337.48. Which isn't anywhere near as bad! Just thought as well, the optional service cover is surely only valid while you are paying for the goods. That means at the end of the 12 months, it wouldn't be worth anything and its got 12 months manufacturers warranty so there is absolutely no point at all in me having it. Please do send me the letter template, I'm not having this off them. thanks Tracy

  20. Hi everybody I am having some trouble with the lovely brighouse stores! I have been a customer with them for a few years now, but yesterday picked up a Nintendo Wii that I had managed to order from them as I couldn't get one anywhere else. The website price states 6.49 a week, optional service cover 3.50 a week total 9.99 for 52 weeks. I had no intention of taking the 'optional' service cover. When I took it the girl behind the counter said payment is due now, £11.98!!! I said thats not right, she said it is, it has three games with it. I replied and you've added service cover on! She said you can't take it without service cover, I said its supposed to be optional. I got this.....its at the managers discrection and we had thirty names for fifteen of these Wii's, so if you don't take service cover then you can't have it. Oh and we can't sell them for cash either. This is absolutely disgusting, I have home insurance, and it is also a new product so surely would have a 12 month guarantee. I felt like leaving it at the shop and telling them to stick it *but* its the one thing my boy wants and we have literally had the year from hell. Lost my dad, I was seriously ill and I just want christmas to be special for the kids, its going to be hard enough without there grandad. Also I've just realised she didn't give me a copy of the agreement I signed. Any help greatly appreciated. Tracy
  21. Hi the girl on the counter said We can not sell it to you if you do not take out service cover. I said its optional service cover she said its at the discretion of the manager and on this item you have to take service cover, she also said she had tried to buy one of them herself for cash and they wouldn't let her. So what can I do, it was a case of having to take the goods really as it is my boys christmas present, and Brighthouse know you can't get a wii for love nor money and they are taking serious advantage of this fact. thanks Tracy
  22. HI I'm new here and after some advice about Brighthouse. I've been with them for years, one of them things unfortunately. Anyway I'd ordered a Nintendo WII for my son for christmas. It was supposed to arrive weeks ago and never did. Was starting to panic as you can't get them anywhere and its getting so close to christmas. They phoned yesterday to say it was in and I went to pick it up. She said payment is due on it now, £11.98 I nearly fell over on there website its £6.49, or £9.99 (with optional service cover) I told her I didn't want the optional service cover as I had it with my setee and they never fixed that etc. And she said if I didn't take the service cover they wouldn't sell me the goods and that they also wouldn't let people buy them for cash either. So I've ended up taking the service cover but I don't want it. Is this legal?? I'm furious. thanks Tracy
