  2. Hi all Just to let you know that I attended court yesterday which was, as far as I am concerned a complete waste of time. Bear in mind that a judgement of default was entered against Halifax on the 3rd October. On the 10th October a warrant was issued against the Halifax. Despite this and also the fact that I am experiencing financial hardship, the judge stated that her hands were tied because of the test case. However, Halifax's solicitor requested the default be set aside and it was granted. Has anyone else had this experience or was I just unlucky with the judge?
  3. Hi StoneThanks for your response, you guys are so helpful.I've gone through the whole process step by step. Got the standard brush off etc and made a claim via mcol. Had no response so judgement of default was ordered in my favour. The hearing tomorrow is Halifax's application to set aside judgement. They are offering a defence and I'm not sure what to take with me. I've already sent a bundle to the court and Halifax solicitor.

Hi TillyYou've been giving Kelvin some great advice.I wonder if you can do the same for me?I have a notice of hearing application to set aside judgement of default that Halifax received for not responding to my notices.Do I take the standard court bundle in with me tomorrow?Sorry about the short notice.Thank you in advance for any advice you are able to offer.What was the result of Kelvin's case?
  5. Hi All Thanks Bankfodder and co for such an invaluable site and thanks to all you contributors for your input. I have been using the Martin Lewis site and have gone through the entire process of sending letters to Halifax to now reaching the final court stage. I received default judgement yesterday together with notification that the bank will request a stay in court. Good luck with your individual cases and congratulations to all who have successfully claimed your hard earned money back. Will keep you informed.x
