  1. Thanks all for the info. I did receive a letter from the Court to the effect that all claims were being stayed (in fact I think I received this first) and so I guess I'll have to wait to see the outcome of this. Bit of extra cash before christmas would have been nice though. P.S. what do you think likely outcome of the test case will be and what are the chances that I will just receive a cheque from HSBC following the result?
  2. Hi boys and girls. I am wondering whether anyone can tell me whether those claims stayed pending the outcome of OFT legal proceedings can now be re-instigated? I was at the point where a court date had been set (back in September) but received a letter from DG Solicitors on behalf of HSBC. It stated that due to the OFT action, all claims would be stayed awaiting the outcome. Does anyone therefore know if this has been concluded and what the outcome was? Also, the amount I originally claimed will now be greater as the interest will have increased and I have also received more charges (foolish I know). Is it therefore possible for me to claim a revised amount and do I have to start the process again or can I go straight for the jugular and set the court date again? Any advices anyone can give to the above and how I should proceed would be greatly appreciated. Thanks for reading
  3. Thanks for the info Buzby, however, I have been conversing with CW and they have now started responding to the complaint. The O2 account is actually on the CW O2 tarrif, rather than being directly with O2, although I am not sure how the two tie up here. The is issue (and debt) is in fact to do with the period after the 12 month contract which O2/CW are saying I owe, as they claim not to have received written notification despite a few phone calls and then my begrudingly sending a letter. Apparently, CW need 30 days 'written notice' to cancel which they claim not to have received, hence my contract continued and the debt accrued. Although I felt I had been hoodwinked, I duly paid the 12 months of the contract, whilst also paying for the T-mobile tarrif, but refuse to pay anything after the 12 months, as I feel that I have fulfilled my end of the bargain.
  4. The original letter was sent on the 27th July, to which I received no response, although it was confirmed that they had received it. I have since e-mailed them via the office of the chief executive and have had all aspects of the claim refuted, on the 7th November! Do I have grounds to refer this even though they have now responded? I need to respond to their rebuttal of the complaint, as I still feel unjustly treated and want them either to write the amount off or take it to court, so I can have my say. I also want to ensure that my credit rating is not damaged
  5. Wow fast response Tiglet, thanks very much. This will obvoiusly stop them harassing me, but how do I go about getting them to go away? The debt is now for around £130, having increased from approx £60. CWP have today also agreed to backdate the cancellation a little and so this amount too will need to be adjusted. But all in all, I was just hoping they would give up and write this off as a bad debt, although I wouldn't mind defending it in court. However, having now read a few other stories, I am now concerned as to how much my credit rating may have been affected. Alao, I am worried that I will have these debt collection agents turn up when I am out and harass my girlfriend.
  6. This is a long winded one but I will do my best to shorten it and would really appreciate some help. Back in May I walked into a CPW shop and asked if the 02 account I had with them was due for renewal as the coverage was useless and I would like a new phone. The advisor told me that my account was due, that I could have x, y, and z phones, and that I could port my number to a T-mobile account if I phoned and requested my PAC code when I got home. I did this only to be told that my 02 account did not expire for another two months and so I would not be allowed to request my PAC code for another 30 days, at which time I should write and cancel my account, requesting the code. I was annoyed that I would need to write but begrudgingly wrote in. I did not chase this up as over the course of time I decided that it would be better to text everyone my new number (which I did) and thought no more about it. I then received bills in July (12 months had run their course in May) for phone usage, which having cancelled my direct debit, remained unpaid. I phoned CPW to advise that I did not feel I owed any money as I had honoured my 12 month contract, that I had been conned by their sales advisor and that, as I had taken my new contract with them, it was obvious that I did not want the old account. CPW/O2 advised that the debt would stand as they had not received my cancellation letter, and so I wrote in and complained. No response to this complaint was ever received, although upon calling them again I was told by the sales advisor I spoke to it had been. I then decided to write in again, this time by recorded delivery, and still did not receive a response. I then started to receive calls and threats from Buchanan Clark Wells. I advised BCW by phone that I did not believe I owed the debt and they advised that they didn't care, as far as they were concerned O2 said I owed it so I did. Daily calls then ensued, as did a few letters, resulting in one recently, which states that debt collection agents will be instructed. Having visited your site, I wrote to BCW (by SPECIAL delivery) stating that I believed the debt to be in disupte, that I had not given permission for them to pass details to a further third party, and that a visit to my house may constitute harrassment. I have since continued to receive daily phone calls from BCW, but as yet no visit. I have also written to advise of all of the above to CPW, via their e-mail address, and have basically been told they believe the debt is owed. I feel I was conned into having to pay two accounts for two months, which I duly did, and that I have honoured all of my responsibilities with respect to my 02 account. I have also stated to 02/CPW that I will only converse with them and any agent in writing and that I will be happy to defend my corner in court, but that I will not be paying the money otherwise. PLEASE HELP!
