  1. BRIEF: My fathers car had been hit by me a couple of weeks ago and the insurance company had stated that it was a total loss. They had agreed to pay the value of the vehicle and have asked for the necessary documents now. I was the named driver on the policy with my father being the main policy holder. PROBLEM: The problem is that the vehicle was bought in november 2003 and that the policy was also taken out at that period of time. A year later my father had penalty points put on his licence for passing traffic lights, TS10 and had 3 points put on due to this. Today as I was photocopying my fathers licence, I realised that he had penalty points, and I don't think we declared it. As my father was going through a triple heart bypass at the time therefore we must have forgotton to declare the points. Now I am afraid to send the documents as they may not pay out due to this. Can anybody help with information on how to avoid this? My mate had a similar situation to this scenario. His car was set on fire and was a total loss. He did not declare that he had 9 points, instead he told them 3 and they have refused to pay him. He had tried the good old 'there word against mine' strategy stating that I did declare them. So they sent him a recording of his conversation with the insurance company. Now he still hasn't been paid after 7 months, even after getting a solicitor involved. MY INSURANCE COMPANY IS THE SAME COMPANY AS HIS. I also hit the car in december 2005 as it was my fault, and the insurance company paid for the repair. But the points were on before this date. If they find out will they ask for the previous money back also? Responses and help greatly appreciated ASAP... Thank HUMK
