  2. No I didn't send it due to lots of stuff going on in my private life. Do you have a direct link to the correct letter for me? Is this the letter I send a £1 postal order with and Recorded Delivery? Cheers
  3. Well, I know appear to be being called at least twice a day by MacKenzie Hall, which is really getting on my ****, I can tell you! Is there anything I can do, apart from not answering the phone of course?

Cheers for the answers and I'm positive it's been about 7 or even 8 years since any payment was sent because the bank account I had the loan with was shut down by said bank in 2003 and I was black listed until 2010! No bank account and no credit cards - I had to get my wages paid into someone else's bank account for about 5 years - and all because of a £1000 bank loan which has now spiralled into nearly £6000. I mean, the hardship I've had to endure because of the bank in question is the reason I never paid nor will I ever pay this money back to them, regardless of the multitude of debt companies employed.

Hi Have had a major problem from Capquest for an old bank loan which was last paid sometime in 2003 for many years - see http://www.consumeractiongroup.co.uk/forum/showthread.php?158313-Capquest-SD-letter-threat-today!&p=1693211#post1693211 for details - and now, another two and a half years on, Mackenzie Hall have entered the fray. The letter that's come from Mackenzie Hall today tells me they're informing me of their client's intended action, even if I do not acknowledge the letter and I've got to contact their office within 72 hours to settle the account. The name given is a Claire Thomson, Assessment Manager. So, should I worry about this latest pile of idiocy or not? For the last 7 years or so I've completely ignored Capquest's various debt-collection morons after sending the CCA letter and they just sell the debt to another company, but with it being definitely now over 7 years since any payment, can this be sorted without any payment? It's that long ago now I don't remember what I should do next, so would appreciate anyone jogging my memory and pointing me in the right direction for a letter to send their way.

Appreciate the answers - and it may be I'm a little stupid when it comes to thing like this - but sorry I'm still confused regarding the 18 month delay, where I now stand and what's my next move?! Is it legal for them to forcibly attempt to make me bankrupt? Do I send any of the letters which are floating around on this forum? If they do turn up at my door, what do I do?

  10. Why would they have to pay me a huge amount of money? So, is this Capquest bankruptcy going to go ahead in your opinion? I'm now pretty debt free apart from this outstanding debt and haven't got a car, don't own my own house and only work part-time, which is supplimented by partial housing benefit and council tax benefit, so being made bankrupt won't affect me really.
  11. *UPDATE 13th MARCH 2010* Well, I can't believe what's happened now! It is now 18 months since I opened this thread originally and I had not heard anything regarding the enforced bankruptcy that Cap Quest had threatened me with back in september, 2008. However, this morning I've had the following letter delivered to my address stating that they have no alternative but to proceed with the enforced bankruptcy. Now though, I'm 100% sure that it has been over 6 years since I paid anything to RBS - have never paid any debt collecting agency a penny either - so can I send them a letter claiming the original amount is statute barred now? As usual, any help from anybody here more than appreciated. Here's the letter:

  13. Thanks for the two letters to send them but what worries me is them sending idiot debt collectors around to my address! Also, what if i'm only just over the 6 years mark? Is there no way they can put in a new claim from a specific date? I know I haven't paid anything since 2003 but I have had a constant barage of letters, so can this be used against me as being in touch with me? Also, I have now got my phone out of the wall as I get a continual bombardment of calls from Capquest number! Just looking for some reassurance really.
  14. Wow, now that's quick, thanks everyone! Probably in early/mid 2003. Nothing at all and I'm now worrying that me sending the "Prove it" letter may be a way of admitting the debt?! Probably not as I didn't sign it.

I've had a debt problem with a RBS bank loan from 2002 following me and black-listing me since 2003 and have always used this forum for the "prove it" letters and advice in how to deal with the various debt collection agencies. Usually, I send a letter and then get a reply apologising and telling me they're returning the debt to the original creditor and then someone else contacts me, usually on behalf of Capquest. However, this time BPO Collections have returned a letter to me from my "prove it" letter, stating the debt is mine and if i send £1 I can get a print out of the original agreement, even though i'm sure i sent a postal order for a £1!!! Here's the letter: Any help will be greatly appreciated. Thanks

So, they're legitimately connected with the various Water Board's of the UK then and in so are acting in the interests of United Utilities and are not just functioning after buying the debt from someone? Does this change things dramatically? OPPS! Sorry a double-post!
  17. Thanks mkb, will get it off but one thing bothers me: it's 5 and a half years, so 6 months short of being statute barred - what'll happen if I send the letter to them? Can they the hold it up as receiving my aknowledgement to the debt?

Many thanks for the rapid response, PGH7447 and its come as a complete surprise due to the fact i'm in Council property for the last 5 years and on the electoral register, so have had to pay and settle all known debts already. The debt must be at the least 5 and a half years old as I took tenancy in May, 2004. Can you point me in the right direction for the Prove It letter please?

Hi Hoping someone can help me out and explain a couple of things regarding the letter from The Litigation Services Co. that's turned up today (wednesday 21st October, 2009) stating I owe £789.76 from a previous address I moved from over 5 years ago! Now, I'm not denying the debt's mine as it is but why such a long delay? All my other debts have found me and have been addressed over the last 5 years, so how come these have just poped up out of the blue to knock me for six with this?! The letter states: ----------------------------------------------------------------------- DEMAND FOR PAYMENT Charges in respect of:************ This unpaid debt has been passed to us for collection and we have been authorised to take steps to obtain full payment. Please contact us immediately on 08448156590 to make payment and provide the correct details to enable us to update our records accordingly. It is vital the the account has the correct customer details if the supply is still required. PLEASE DO NOT IGNORE THIS LETTER. Our opening times are Mondayto Friday, 8.30am to 8pm ----------------------------------------------------------------------- The top of the letter has "PO BOX 604, Shrewsbury, SY3 8ZH" and that's it really. I need to know what I should do now they've got in touch with me after so long? How do this comapny approach people - for instance, am I going to find bailiffs on my doorstep anytime soon? There's no way on this Earth I can pay this money back as i'm on partial benefits and employed in a part-time job that takes home just £80 a week, so there isn't one penny left over for myself, let alone a 5 year old United Utilities bill. Also, I have just spent the last 5 years paying of thousands in Council Tax and rent due to problems stemming from around 5/6 years ago and have only just got clear in the last 6 months or so! Hope some of you debt experts can help me out? Cheers
  20. Sorted, i'll leave this 'til next week so i can think straight and then look at it again. As for the clerk i spoke to - she worked at the specific part of the county court where i'd have to put the forms in and she told me i couldn't hand in the forms if i admitted the debt was mine. I know you're all telling me this can't happen, but it has happened - i explained to her that internet forums have explained what to do, how to fill in the forms, etc, but she was adamant that if i turned-up with the 6.4 and 6.5 forms completed without a "proper" excuse for setting aside, then they wouldn't accept the forms. This is the whole reason i'm in this c**p to begin with - being unable to get things sorted out, even after advice. On top of this, in the last 2 months i've had a seizure of earnings for an old Council Tax bill from 4 years ago, even though i'm currently paying off other Council Tax debts and they know where i am, they never contacted me via letter and instead just sent it through court to seize my wages. Then, on top of this, last Thursday i come home and have a letter from Bristow and Sutor, who have been around to take my stuff for ANOTHER Council Tax claim which has gone directly to court without informing me from 9 years ago!??! Absolutely f**king sick and tired of this bulls**t! Only 3 years ago, i had a will settlement and so went to the Council offices and asked for all outstanding Council Tax bills, then settled them: it cost me in the region of £4000 and i thought that was that but no, they'll still find a way of doing you over!

Hi all Well, that's that then.... went up to County Court this morning and after trying to submit the forms, was told i didn't have grounds to set aside as i admited the debt was mine, even though i contested the full amount. F**k it, we'll see what happens next and to tell the truth, i'm too p***ed off to be bothered now as i've been fighting some form of debt non-stop for last 10 years and i need a rest!   23. Can i not get this put aside by claiming the amount asked for by Capquest is too much? They're claiming £5100 but i only borrowed £1200 originally. Also, i haven't had any contact with them prior to this bankruptcy letter, so are there not grounds for setting aside with this? I'd like to thank everyone for their time and effort regarding this and if it's a lost cause at least we'll be able to see what happens next, won't we?!
  24. The OC didn't send anything to me, but the Capquest 3 page court summery does have their name - RBS - on it. So basically, i have to ride this out or pack-up and do a runner for another couple of years before i can be guaranteed to be over 6 years?
