  1. Having spoken to the Court a few weeks ago, they told me that HFO track all their cases on line. Every day HFO check if an acknowledgement of service has been returned and if not they apply for the CCJ on line which is registered immediately. They submit literally hundreds and hundreds of claims at a time knowing that some people will now how to deal with them but many wont and end up with CCJ's before they know the procedure. The court is fed up with them and the judges know that if it does progress to a hearing, they very nearly always turn up unprepared without the correct documentation. Like Rhia I dont know enough to advise you but there are many very knowledgeable people on this site who will help you through. Keep your chin up and focus on kicking their butt. Good luck

  3. Yes Rosie is right. Once you understand the procedure and your legal rights, it wont seem quite so bad. There is brilliant advice on this forum to help you through. Once you begin to fight back, they will back off believe me.
  4. Hi Rhia I am not frightened by these imbeciles, they just make me very angry. I was reading the situation with loopy_loo1 this morning and she was clearly very upset. I could almost feel her distress. No-one should have to experience this sort of behaviour. Something has got to change. I am happy to share the information I have but I am a little worried as to the authenticity of who I am speaking to.
  5. I would like to give you all a little hope in your battles with this monstrous company. Although they operate under the name of HFO Services Limited, they are in fact collecting on behalf of HFO Capital Limited which are not even registered with Companies House. This is indeed a subsidery of The Concillian Group who are registered in the Caymen Islands. The Directors of the Company also Directors of many other shady operations and live in very large multi million pound homes in Chelsea, Kensington and Surrey. Turnbull is also linked to all the addresses and in fact the 'state of the art offices' (see their web site) is also Turnbulls address. The information I have uncovered about their operations is too lenghthy to go into but if you are willing to spend a couple of quid, log onto Companies House. It makes very good reading and will be their downfall. Look at their filed accounts for Roxburghe Limited, Express Delivery Limited, HFO UK Limited, Ontrack Investigations Limited, First Direct Logistics Limited, HFO Services Limited and HFO UK Holdings Limited. You will not be surprised to see who the Directors are and how they are all inexplicably linked to each other. The Directors of HFO are Kevin Harper and Badri Nathan. If there are any budding accountants out there, look very closely at the accounts! These bods are in breach of every financial service regulatory body, including Consumer Credit Act 1974, OFT debt collection guidance, Financial Services and Markets Act 2000, Financial Services Act 1986, Data Protection Act, Companies Act 2006 and Insolvency Act 2000. I wont bore you with my own situation as I am waiting to serve them with breaches relating to my SAR, CCA request and CPR request. I must say I sought advice from this forum based on the despicable way I was being treated by them. Having read some of the very disturbing cases on this site I am totally mortified that in world where the consumer is supposed to be protected, these animals can continue trading despite the endless complaints to all the recognised regulatory bodies. These organisations should be protecting us and quite clearly do not care. There is always power in numbers and I would urge everyone to complain to OFT, Trading Standards, FSA (remember your terms and conditions remain with the original firm and they are regulated), FSO, DTI, Companies House and yes you've guessed Customs & Excise! (See filed accounts). Hope this information helps. The net is closing in!

  11. Thanks for the reply Shane. Its a long story, but two years ago an employee embezzled money from my company which forced me to voluntarily liquidate .I wrote to Barclaycard four times asking for them to help me arrange a reduced payment and requesting that they freeze the interest. I heard nothing from them for two years until I received a letter stating that they had assigned the debt to HFO Services Ltd. They contacted me at work and after some consideration we reached an agreement of £50 per month although I said that I disputed the debt. ( I have this in an email) I heard nothing futher from them until Court proceedings arrived on my doorstep. The solicitors acting for them were exceptionally aggressive and threatening (Turnbull Rutherford) and I decided to fight their claim. Neither Barclaycard or HFO have been able to provide me with a deed of assignment or CCA. I have served a SAR on everyone but to date I have had no response. I have sent complaints to OFT, FSA, Barclaycard, HFO and Customs & Excise (more of my long story). I have spent the last ten days investigating this company and what I have found out is incredible. How HFO are allowed to continue trading I dont know. They are in breach of their CCL, FSA rules, Financial Service and Markets Act 2000, Data Protection, Companies Act 2006 and Insolvency Act 2000. Having said all that, I am not sure that I will win. They have also forged documents, pretending to be Barclaycard. I must get my defence off to the Court tomorrow so I am drafting it today. I have a couple of aces up my sleeve but I am not sure if I should show my hand yet. Not even sure if the buggers read things like this (it wouldnt surprise me)! I know I am not bound by the same court rules as is their legal team but I dont want to stump up in court only to have the judge rule that my evidence is inadmissable. I believe I have followed all the processes correctly and I believe the actions taken by Barclaycard and HFO are unlawful. Under FSA regulations, HFO have to be regulated to accept the introductions of business from Barclaycard and if they are not they must abide by the rules as though they were regulated. I know I am waffling on a bit but this is consuming my life, I cannot believe the injustice of it all. I was really hoping someone had a win with them. Thanks again
  12. Hi - have a little patience with a first timer. I am interested to know if anyone has heard of HFO Services Ltd aka (too many to mention)! My story is long but never boring. Very close to proving they havent got a leg to stand on but was hoping someone out there had a win against these idiots.
