  1. hi everyone, if you can help me at all id ppreciate it so much. i got a new contract fone from vodafone like 2 months ago and recently the fones stopped working. i sent it to vodafone to get it repaired under warranty and they returned the fone to me still broken with a letter saying: our engineers found the fault to be caused by physical damage.(which isent covered by warranty) the warranty covers the fone for problems with design, material and workmanship but it doesent cover normal wear and tear or damage caused by excessive force. the damage has been caused by the sim card being inserted which has broken off sum of the metal contacts.(its a tight fit) ofcorse i havent used excessive force when inserting the simcard, so therefore if the damage has been caused by inserting the sim which i have to do to use the fone then surly this is a fault with design. would you agree? so really i want to know what to do next. i will fone customer service tomorrow but i know they will tell me they cant help. the decisions been made to not make the repair under warranty so how would i go about contesting that decision? how would i go about proving the fault is not because of me and that its because of a design problem? if the end result of this is they dont repair it for free obviously i wont be paying the 16 months of contract left(£450) because im not happy with the product or the service ive received so what would be the next step to make sure the dept doesent stand and i dont receive a bad credit rating for the service i paid for but didnt receive. i know my problem is tiny in comparison to other ppl on here but its driving me nuts and i cant afford to pay for something i didnt receive. please help me any way you can i am clueless about the way stuff like this works(finance,busnesses etc) and i aint got any1 else to ask. thanks so much in advance. ps. my fones a nokia 5800

'I am on this occasion, as a result of your prompt payment of the outstanding debt, I am pleased to be able to inform you that, as a gesture of goodwill, I am prepared to waive the remaining fee.' lol thats the start of like 5 sentences, what a numpty. who did you send the original letter to? the new firm is threatening doorstop call, should i ignore the new firm & just send a letter containing unlawfull dept stuff+ doorstop visits bit to certegy & hope they get the dept back from the other company & waive the charges? cheers
  4. hi, cheers for replying, as the dept has been passed on should i send the letter that greengenes wrote to certegy or the new collection firm? also should i send the letter lookinforinfo wrote about banning visits to my house to the new firm & inform them the dept they've bought is illegal? i'm totally clueless as to these matters, should i actually threaten to take them to court, say for them to take me to court? gizmo32 did you send that letter to certegy, should i? i'm unsure what to do as certegy have washed their hands of the dept cheers
  5. i'm in a similar position, i'm thinkin of sending a letter like mrgreengenes, is this a good idea? the charges have been passed on to a doorstep firm to collect, should i send a letter to them saying the dept they've bought is unlawfull as i was 15 when the cheque bounced + the charges are way too high anyway? has anyone else got out of paying these trumped up charges? please help me anyone
  6. hi, i'm in the same boat as mygreengenes, a cheque bounced for £61.20 to an online shop, certegy got involved, i got letters telling me about various charges, which i didnt pay, they said they would forget about the charges (£45.30 odd amount i know) if i paid in full immiediatly which i did but now 3+ yrs later theyve passed the dept on to scotcall a doorstep collection firm from glasgow, theyve sent me a letter saying i owe them £46.50 which i must pay within 7 days, that was 8 days ago, i'm gettin abit worried, i dont want 2 big ass blokes knockin on my door tryin to intimidate the money out of me. the charges are pulled from thin air but i dont want my credit file getting depts on it so i'm tempted 2 just pay up. are they allowed to accept full payment for the original amount & then hassle you for payment of charges they said they would forget? also when i bought the items from the online shop & got involved with these thugs that are certegy i was only 15, surley these charges wouldn't count even if they were genuine. can anyone give me advice, opinions as to this matter, the citizens advice beuro can help for the people who have posted above but could i have everyones views as to what my rights are etc. thanks in advance
