Hi everyone, great news, got back from hols & got a letter from HBOS. "I have returned your Acknowldegement of service to the xx County Court "(the wrong one as it happens - nice to see a typo in the letter!!) " indicating that Bank Of Scotland intends to defend your claim......on a commerical basis it will cost BoS to defend the claim...legal costs.....It is unlilely that Bank of Scotland will be able to recover these costs .....without admission of liability BoS is willing to reimburse £x claim + £x interest (contractual) + £30 court fee" then lots of stuff about how irresponsible we are for not keeping track of our accounts, naughty naughty me.... Success!!! it's not a huge amount of money but it'll be v handy for Xmas and it's lovely to get a result, Thanks everyone for your help & speedy replies when I needed you! emmab16:D :D -

Hi everyone, haven't done an update for a while as lots of other stuff going on too..... The claim was filed & issued on the 14th Sept & deemed to be served on the 20th Sept. HBOS filed an acknowledgement of service on the 24th Sept & has responded to the claim with an intention to defend the claim. I think this means they have until 28 days after the 20th Sept to file their defence? (which is 26 Oct) ta emmab16 -

there seems to be 2 versions of the POC's floating around - the basic one http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html and the 'new' halifax one which contains all the bank account penalty charges http://www.consumeractiongroup.co.uk/forum/bank-templates-library/109706-new-poc-n1-halifax.html I am going for 8% not CI, which one is the right one for my credit card claim?? ta

~~## New POC for N1 for Halifax ##~~
emmab16 replied to zootscoot's topic in Halifax Bank and Bank of Scotland
All of these details seem to refer to bank charges - what do I do with a halifx credit card claim. I am ready to file at court, but don't know what to put in the POC for the N1?? -
Hi, I asked for a cheque rather than a credit to the account and it came within a week, as promised. He seems amenable so it will be worth phoning him to find out where the money is

I just phoned James Ball and he came back with the full amount, after the LBA he originally offered £125 - very easy win on this one....just followed the FAQS on the site! ;-)
