  2. I tried to take pictures to make it much more readable, but the photocopy they sent me is so small, that you can hardly read it. I will therefore type it out in the hope that someone can advise what to do next. Copy of the default notice sent on Dec 13th 07 Response to CCA request: Letter stating enclosed was: * copy of the original credit card application (see 1) * terms and conditions (see 2) * recent statement of account (didn't attached as not relevant) I used the green colour to remove personal details. The black lot is MBNA's doing. 1. copy of the original credit card application 2. terms and conditions 1 more page to follow of T&C's Sorry the print is small. I don't have a scanner. Let me know if I need to type out any wording.

Further to my whole battle with MBNA here: http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/118293-mbna-any-ideas-what.html I have now received a Claim Form from Northampton County Court: Claimant is MBNA Address for sending documents and payments is Restons Solicitors Ltd Issue date is 26/03/2008 It consists of 4 pages: Claim form Response pack Admission (specified amount) Defence and Counterclaim (specified amount) What the hell do I do? I tried to communicate with MBNA, they are not very nice to deal with. Told me they passed on debt, corresponded with those people, no response and then got letter from this solicitor and now this...
  6. Just had a call from my husband...MBNA have now sent me a court summons for Northampton court and paperwork to complete. Need to read it all when I get home but I can not get to Northampton that's for sure! And am very confused as I am keep sending letters to resolve this, but signed for mail but no-one responds to me. MBNA confirmed to me on the 7th Jan 08 that they passed on my account to Debt Clear Recoveries & Investigations Ltd and that I need to contact them. I did that, no response...then got the letter from the solicitors who I emailed and they responded: We are instructed on behalf of our Client MBNA Europe Bank Limited. We do not act for you and cannot therefore advise you in relation to the above numbered account. Confused (and scared) or what?
  7. I have been battling with MBNA for a long time now, I cca'd them at the end of last year, which I posted on here. Wasn't clear if the debt was enforcable or not from what they sent me. (I can't find the old thread to link in here) In the beginning of January I received a letter from Debt Clear & Recoveries saying they now had the debt and it is not with MBNA anymore. MBNA sent me a letter confirming this. I faxed and wrote to this company (debt clear), and the letter was signed for. I enclosed financial statement, my offer of £13.25 (which MBNA did agree too and then went back on their word). Also asked for bank account and sort code to enable to set up standing order. Did not receive a response what so ever. Today I receive a letter from Restons Solicitors stating they will start legal proceedings if the debt is not paid in full. HELP! I feel sick with worry.
  8. I have a outstanding debt with MBNA which they agreed to have paid by reduced payments which I have kept up. This morning I received 2 letters from Debt Clear Recoveries & Investigations Ltd addressed from a PO Box in Manchester telling me that they now own the debt and I need to contact them. They also state that future payments have to be made to them. I have a SO that goes to MBNA and is coming out on Tuesday and I will just pay as normal I think. I have CCA'd MBNA a while back and posted the copies of letters in here (I can't find the old thread) plus I have sent a letter of complaint to MBNA which they are investigating (this was about them not replying to any of my faxes, letters or emails plus to stop the herassment calls) What should I do next? Help!!

After nearly 3 months of battles and them ignoring my emails, letters and faxes, I received this email from them this morning: Mrs Maxmum Thank you for your letter, can you please forward the £13.25 as promised in that letter. If it is received on your account by the 29th we can continue with the interest free arrangement otherwise the account will default. Please remember to allow 3 working days for it to hit the account if paying by cash. Yours Sincerely, J.P Connelly, MBNA I have replied to them: Many thanks for your email. Please be aware that I have always paid by Standing Order which goes out of my account on the 6th of each month. This is how my payment is set up and was agreed in the past. I trust we can continue this agreement. Can I also please ask to send future emails to: [email protected] and not my work email as this was classed as 'spam' and therefore would potentially be overlooked. It goes: A DEFAULT is due to register for SIX YEARS on your credit file in the next few days in relation to the above account. This will seriously affect your ability to gain ANY form of credit in the future. When the Default is registered, the balance on your account is SOLD to a Third Party. This means that: 1. You will no longer be a Customer of MBNA 2. The responsibility for recovery of the outstanding balance will be solely that of the Third Party 3. The default registered against you will be transferred into the name of the Third Party 4. The Third Party will take actions they deem appropriate to recover the full outstanding balance. To prevent this from happening, you must make an IMMEDIATE PAYMENT of £6.30 by debit card payment today. Please call 01244 674663 to clear your outstanding arrears and discuss your repayments. Please contact one of our account managers immediately. They will be available Monday to Thursday 8am to 9pm, Friday 8am to 5pm and Saturday 8am to 12pm. Yours sincerely Any ideas what I do next?

  15. I received a response from MBNA to my CCA request sent on Nov 9th. Their letter states: Thank you for your recent request, I can confirm the following are enclosed: * Copy of the original Credit Card Application * Terms and Conditions * Recent Statement of Account. The following documents were enclosed: Financial & Related Conditions. (they 'blacked' out the top and bottom part) Signature Form (they blacked out the top and bottom, I 'pinked' out my address and signature - yes it is my signature and written date) Then 4 forms which make up the Credit Card Agreement Regulated by the consumer credit act 1974 I do NOT recall ever seeing this agreement before Is this correct what they sent me?

I just received a postcard from MBNA... set of trees on the front.. on the back it tells me they gonna be calling me week commencing 19/11.. if this is inconvenient, can I call them on 01244 xxxxx They having a laugh I think... a) they confirmed they wouldn't contact me by phone anymore so no it isn't convenient but b) I stated I only will have contact in writing with them... oh better file the card me thinks!

  19. I have put this letter together...can anyone tell me to add/remove anything... Further to your letter dated November 15th 2007, I would like to point out that I have been contacting your company in writing on numerous occasions but unfortunately I am not receiving any response to my correspondence, so your statement that you have been making numerous attempts to contact me, are incorrect. In addition to your letter dated November 15th 2007, which does NOT answer any of my letters of repayment, you have replied to me in 2 separate letters with regards to my harassment letter. I have had NO response to my letters, faxes and emails dated Sept 25th 2007, Oct 10th, Oct 11th, Oct 26th, Oct 27th 2007 ,Nov 13th and Nov 16th 2007. I would also like to remind you that I sent a CCA request on November 9th, which I have confirmation from that it has been received by MBNA. To this date, I have not received any response to this either. Failure to comply to my CCA request will put the account in dispute. I look forward to hearing from you in response to ALL my correspondence as soon as possible.   20. I have a credit card debt with MBNA of just under £3K. The credit card was taken out in 2001. I have been on a repayment plan with them and they stopped interest and late payment charges. I sent them a letter back in Sept advising that I had to reduce my payments as my mortgage fixed rate had finished and my mortgage has gone up and therefore on a pro rata base, had to reduce payments to my creditors. I altered all my Standing orders. Then the calls from MBNA came..rude, very rude! I sent them the herassment letter by signed for post, email and fax which they acknowledged first and last week I received a letter from them confirming they have removed all my phone numbers (work, mobile, home) from their dialing campaigns but I should be very grateful because of interest being stopped etc. Anyway, I have emailed/fax/sent them letters on numerous occassions pointing out all my creditors have accepted my reduced payments, they haven't (well they haven't said no or yes...they just don't reply at all!) I have CCA'd them (letter sent 9th of November, signed for by MBNA on 12th November) They sent me one of their famous pink letters saying imminent court action and I had to acknowledge the letter...well I haven't acknowledged it or mentioned receiving it at all. (they don't acknowledge mine, why should I acknowledge theirs!) I sent them another fax, to 2 of their fax numbers, again,requesting if they would be willing to accept my reduced payments but they are just ignoring me. TODAY I receive the following: 1) A MBNA statement which shows my payment of £13.35 plus the £1 postal order has been credited to my account as a payment. This is the £1 postal order I sent with my CCA. 2) I also received a letter from MBNA stating the following: RE Notice of possible charging order on property I am contacting you in relation to your MBNA credit card. You currently have an outstanding balance of £xxxx. Despite numerous attempts to contact you, we have been unable to set a reduced payment programme that you are able to pay. As itentified under the land registry title number XXXXX, a preliminary investigation indicates that you are the joint freehold proprietor at the address on record. You need to contact our office within the next 48hrs to resolve the issue in relation to your account. If you fail to do so, we may pursue a county court action through your local county count and after obtaining a county coury judgment, or, if you are a resident of Scotland, a Sherrif's Court Decree, ask the Court to issue a Charging Order against your property, or if you are a resident of Scotland, an Inihibition being placed on your property. If you are currently in financial difficulty and feel that you cannot maintain the minimum contractual payment, you need to contant J.P. Connelly on telephone number 01244 674663 extension 10474 as we may be able to set for you a reduced payment programme from as little as £34.00 per month. However, if you fail to comply, we may have no choice but to pursue the action detailed above and you could be held liable for any legal costs incurred. Your sincerely HELP!! 1) They don't respond to any of my letters 2) They haven't responded to my CCA (but credited the £1 againt my account) 3) What do I do next?

  23. I just read the below in one of the other MBNA topics I haven't sent the CCA off yet as when my OH got to the postoffice, it had closed so was going to do this tomorrow. Do you think it is best waiting for them to sell the debt on and then go the CCA route?
