Just an update, spoke to my local CAB and they advised me to speak to my landlords about ending the lease early, this was at their discretion of course, which i did, and thankfully they accepted. So moving out this weekend. Thanks to everyone for the advise and the effort. -

The 1 month notice can be from anytime after the end of the tenancy agreement, so if you serve notice on the 6th then you leave on the 6th of the next month. But wait to hear from the more informed members, as my opinion is not an expert one unfortunately. -

This Agreement is intended to create an assured shorthold tenancy as defined in Section 20 of the Housing Act 1988 (as amended by the Housing Act 1996) and the provisions of recovery of possessions by the landlord in Section 21 thereof aaply accordingly. Term: A Fixed term of 12 months from and including the 19th day of October 2005 subject to Paragraph 3(a) of the lettings provisions Break Rights: For either the Landlord or the Tenant by serving not less than two months' prior written notice on the other, expiring on or after 18th April 2006. Anything else? -

Deposit: ****.** being 6 weeks rent paid on the signing hereof to the landlord. Checked the original agreement and i have to give 2 months notice. Going to take it down to my local cab to see what can be done, thanks for the replies guys. -

I remember writing the deposit cheque in the flat owners name, not the letting agency or the let management agency. -

So i post a letter to them first class tomorrow, and assuming they get it friday, then i should specify the 19th October as my last day. The deposit issue i'm not sure about, all i remember was that it was six weeks rent. Will check and get back to you tomorrow, thanks for the replies, your help is greatly appreciated -

No, the original lease i had with company A, before Nelson Bakewell expired, and they never mentioned a 2 months notice. NB mentioned the 2 months notice to me in March'07 when i called to inform them of my intent, never before that. -

That would be great, will call them tomorrow and give notice. Just to clarify, they can't argue that i accepted the tenancy agreement verbally? It has to be on paper? -

Pay rent monthly, have not signed nor seen a tenancy agreement from them, they may email me a copy of their standard tenancy agreement if i ask. The letting agent is Nelson Bakewell. -

When i've spoken to them they've said they require two months notice -
This is my first post, so please bear with me. I moved into a flat with my brother oct'05, and we signed a twelve month lease, the property was sold Aug'06 to another investor and their new letting agent approached us about signing a new lease in oct'06, we declined and stated that we only intend to stay until feb'07, they agreed (We didn't sign a lease). We gave notice (two months) in march, but our plans fell through in May, we asked for an extension and we stayed on. Now, we are a couple of months rent in arrears, and we can't afford to keep accruing debt. If they can agree to a payment plan, we can pay them the arrears over a couple of months, that is if we can leave at the end of this month (10 days). My question is do we need to give two months notice, and if so that means we are liable for the rent or are there any alternatives. Thanks in advance.
