  1. Update -

     

    I still have not received a copy of my credit agreement. However I have received plenty of threatening letters from Triton credit services.

    They have wrote today to inform me of their intention to commence legal proceedings.

    Should I reply or just complain to trading standards?

  2. It seems these companys are just in the business to intimidate people. However and when you fight back they don't want to know.

    They are always keen to quote laws and regulations to back up their claims but when you do the same back they try to wriggle out of their legal obligations like the slime they are.

     

    I have had a similar situation with Mercers (which was almost laughable) they kept calling me up and telling me of my obligations that I entered into on signing my credit agreement. But when I ask to see a copy of the agreement they dont want to know! They just keep asking "What do you want that for?"

  3. Sent them the template letter.

    Received a response today -

     

    "May we point out that the onus is on you as the registered owner of the vehicle to prove that you were not driving the vehicle on the day in question"

    "Failure to supply this proof could result in either debt collectors being instructed or legal proceedings being issued in the County Court to recover the monies due"

     

    For some reason they keep referring to my wife as the registered owner when infact she is the registered keeper.

  4. I have been battling with Nat West for months over an alleged credit card debt!

    I have had to deal with all the threats, phone calls, debt collection agency's etc.

     

    I have just received a letter from them admitting that they have no CCA and are discharging the agreement as ended. :D :D

     

    So just a reminder to all on here, no matter how bad it seems at times stick at it and don't let the B*****DS get you down.

     

    Big thanks to everyone on here who I have learned so much from.

     

    Now on to MBNA!!

    I can't believe it but I have just realised that I have never CCA'd or SAR'd MBNA!!!! What a plonka. (Ive had that many debts to deal with its easy to lose track)

     

    I was hoping that MBNA will sell off the debt and I might be able to deal with someone more reasonable.

     

    How are Equidebt?

     

    I have had some good news today at least. Nat West have admitted to no CCA and discharged the agreement as ended!!! :D

  6. I have a large debt £16k + with MBNA (it was a lot less but they refuse to stop the interest).

    I have had numerous telephone calls from their rude staff whom I have informed that I will only deal with this via letter.

    I have an audit trail of letters sent to them to arrange a debt management plan. - they haven't responded to any.

    2 weeks ago I sent them a letter via special delivery asking for their internal complaints procedure or I would go to the Financial Ombudsman.

    I have received no reply to that either but I am now receiving anonymous text messages.

     

    I also have recordings of telephone conversations which go something like this -

     

    Me - "I want to deal with this by letter please"

    Them - "Why is that Mr xxxx?"

    Me - "Because I am not comfortable on the telephone"

    Them - "We are a telephone bank and will only deal with this on the phone"

    Me - "I am a letter customer and I will only deal with this by letter"

    Them - "If you are not prepared to deal with this on the phone then we will take further action"

     

    What a bunch of **** bags!

     

    What's my next move?

  7. I spoke to a woman on the phone today, who spouted the biggest load of c**p I have heard in a long time.

     

    I know I shouldnt speak to them on the phone, but they keep harrasing my wife and this morning they called her a liar!! so I phoned in my fury.

     

    Here are some MBNA statements -

     

    Because they are an American firm they adhere to American laws!!!!!!

    THis might be the case, but not in Britain they dont.

     

    I have sent them my income/expenditure 3 times now. But the lady told me - Because they are a telephone bank they will only deal with the matter on the phone.

     

    I have until 8pm tonight to agree to there terms or the account will be sold off.

  8. Acknowledged service online with MCOL

     

    Posted off Curlybens original letter to Restons by special delivery.

    I will wait a couple of days then write again asking them to offer my pro-rata payments.

     

    I have made a complaint to the Financial Ombudsman and received a reference number (they are going to investigate)

     

    I have written to HFC head office advising them of my complaint to FOS and asking them to TALK TO ME!
