  1. Hello everyone- I'm a new member today and have started a claim against RBS. We received an offer on 14 July 2007 that we accepted on 01 August (within the specified 8-weeks time limit). Last Saturday we received notification from Cobbetts that they had filed RBS's defence against our claim so we thought the offer was withdrawn. Have just phoned RBS to clarify this who advise that they are having to reissue all offers, including more options for the customer in light of the forthcoming test case; so we assume that they're covering their backs in case those accepting the offer decide to claim any shortfall from their initial claim in the future if the test case comes out in favour of the consumer?? Was also told that all offers made will still be honoured regardless of the test case. Will let you know what happens but will not be withdrawing claim until offer paid out.
  2. Good Morning CAG members. I've just registered as I am trying to claim bank charges and am totally confused. I'm hoping that a kind soul out there could advise me on a few issues. I have filed a claim through the Small Claims On-line, after my bank failed to respond to my 14-day letter etc. Once I filed, my bank wrote to me offering (without admitting liability) to settle all but £150 of my claim. I considered this offer and wrote back to them accepting it. Meanwhile, I have received notification from the bank's solicitors that they have filed a defence with the Small Claims Court, disputing all of my claim. In addition they are critical of "the lack of particularity pleaded..." and that I have not disclosed reasonable grounds for bringing a claim against the bank. In light of this, they also state that if I "do not remedy the above" within 14 days of the letter (09/08/07) then the defendant will apply to the Court for an order striking out the particulars of the claim. Can anyone with a similar experience advise me what the bank is doing? Does this mean that their offer has been withdrawn and that they have decided to go to court? If so should they have written to advise me of this? I would be grateful for any help/advice on this matter as I am now thoroughly confused. With best Wishes and regards MackyD
