  1. Hi, thank you for replying so quickly. Is there a template or anything of the sort to send or do i just word it myself? What is FOS? Does the letter above posted by 42hitman constitute a complaint?

Hi, I sent the letters as shown above & this morning I have received a reply from Equidebt (the new DCA) asking me to ring them as they have a personal settlement figure which I dont think is good enough as they owe me approx £3700 in charges & they say I owe them £1429.60. I am getting rather sick of all these letters. Can I report them or do I just keep sending letters to them & the Royal bank of scotland? Please help as I'm very confused.
  3. Hi, i was wondering if anyone can help. My case on hold by the courts since August 07. The RBS say I owe them £1500 ( from Charges) I am claing almost £3700. I have 2 different DCA sending letters threatening me with action if I do not pay in full, I have sent them the letters from your site & I then receive a letter saying they have returned my account back to the client (RBS). On August 8th I received yet another letter from a different DCA saying I need to pay within 14 days in full. I am just sending the first letter to them & to RBS. I was just wondering how I go about reporting them to the FSA and the banking code standards committee (should I)? Can I go straight to the OFT to report this? I am at a loss of what to do now as they are very persistent. Any help is appreciated! Scarpetta

  5. Hi Saintly 1, yes i have sent the first letter from this site & they totally ignored it. I was going to send a second letter. The reason i ask about the N1 is when Rbs solicitors sent in their defence they asked for more information & I was going to send POC's & copies of statements Etc again to the court. I have asked for my case to be transferred to my local court as it is still, as far as i know, hearing these cases. Yes i have been given a case number by Northampton court.
  6. Hi, Could anyone help me please. I am at a loss as what to do. I am claiming against the RBS for nearly £3000 bank charges, I filed with MCOL & paid £120. On the last day they filed a defence & asked for more information, but on receiving this the Northampton court had put a stay on the claim & returned my N1 forms & all the relevant info needed, ( I have since had the papers referred to my local court ( s-o-t county court) but was told I needed to apply for a lift on the stay. Since this has been going on they have passed the debt onto a debt collector who has threatened me with court action. The first letter i received i responded with the letter from this site & I had no reply from them. I have received a phone call on Monday morning asking me for a payment & I have told them that I have filed a case against the RBS & it is illegal what they are doing but to no avail. I received a letter from them this morning asking for payment in full by tomorrow morning or they will start legal proceedings. I am at a loss as what to do. 1) Can the RBS do this once a case is filed? 2) Do I have to make a payment? 3) Can I still file the N1 & info at my local court? 4) Do I need to write to RBS or debt recovery agency? 5) Can they take me to court? 6) How can a lift the stay? 7) should I involve a solicitor?   7. Hi, an update to what has been going on. I rang MCOL to ask for papers to be transferred & was told to put it in writing or email, so I emailed & have now got a reply to say they will transfer papers but i have got to apply for the stay to be lifted & this is only granted in certain cases. I need to know what to do now, should i just wait or ask for the stay to be lifted? Can anyone advise me please! Thanks in advance, Scarpetta
  8. Thank you! I will phone tomorrow & get the paperwork transferred. I found out last week that Stoke on trent county court are still hearing cases as yet. I hope im not too late. Do you know if they do this quickly or do they dally a little. I can spend more time looking through this site. Its FAB!!! Thank you again.
  9. Hi, sorry about this but i think im having a blonde moment! I started my claim with mcol in july 2007 & paid £120.00 & then rbs sent solicitors papers to say not enough evidence. I then sent form n244 along with n1, poc's & schedule of charges & £35 pounds but these were sent back with the £35. 1) Do i have too wait for oft case? 2) Can I just pay £35 to local court along with all relevant info & then wait for a reaction? 3) Do I have to pay the full amount of £120 again & try to get it back? Sorry for being so annoying but i am just trying to get it right! Thanks alot in advance! Scarpetta :o

  11. Hi, could anyone advice me on the N1 forms & particular of claims. I filed on MCOL in July 2007 (with the help of moneysavingexpert) & did not fill the forms in correctly. So I then filled an N1 form in & a particular of claims with an extra charge of £35.00 but this was sent back with payment & said that all cases have been stayed. 1) Can I send the N1, particulars & £35 to my local court. 2) Can I send a new N1, particulars & full payment to my local court. Or will I have to wait until after the test case now. Scarpetta P.S really do wish I had found this site first! SCARED
  12. Hi, just wondering if someone could advise me on this problem. I have had a court claim dating back to July 07 which i was told was put on hold until the test case was decided. The problem i have is the bank say i owe them almost £1500 ( this is from charges). I worked it out with interest that they owe me nearly £3700 over the six year period. The bank put it in the hands of Westcot who have since said they are no longer dealing with it because I have made a claim and it has gone to court. I then received a letter from Cobbetts (rbs solicitors) to say the claim was on hold until after the court case. However yesterday i received a letter from a debt collector to say i need to pay the amount in full in 10 days or receive a court summons. I am getting really worried as I thought I had to wait until after the court case. Do I have to pay this amount (i cannot afford to pay it in full) or do i contact Cobbetts, Rbs or the debt collectors?. Are they trying to frighten me into paying? What do i have to do? Can anyone help? Very confused. P.S Spoke to the debt collectors yesterday to let them know I was claiming my charges & it was on hold. They were not interested, just told me they would hold it for 14 days then the baliffs would be calling. A VERY rude & obnoxious bloke I spoke too. Not very helpful at all.   13. Hi, I have just decided to send copies of everything to both the court & solicitors. I have sent POC's, N244 form, letter to court to say Cobbetts are being intimidating & statements/schedule of charges & interest and a cheque for £35 to cover court costs.

It reads we are instructed on behalf of our clients. We enclose by way of service: 1) Defence 2) Request for more infomation. We confirm that we have filed a copy of the same to the court. I have until 23/8/07 to send all the information. Do I have to send them this or ignore it has it has come from them & not court? Then yesterday I received a letter from Northampton court dated 16th August 2007. This reads:- Before District Judge Murdoch, sitting at Northampton County court, without hearing, It is ordered that:- 1) following the filing of a defence or holding defence the claim shall be stayed pending judgement in the Office Fair Trading test case. 2) Liberty to apply with an explanation. Note:- Any party affected by this order may under rule 3.3(5) apply to have it set aside, varied or stayed. Such a party must apply under rule 23.3 within 14 days of service of this order. PLEASE HELP! What have i got to do, rather confused. Thanks in advance.

  16. If I can, I will give you an update of how far I have gt with RBS. They are in the process of defending the claim. I have received a letter from their solicitors (Cobbetts) today to say they are defending, due to lack of evidence (particulars of claim), which I did not know about until I have read the notes on this site. I am confused as too what to do now. From what I can understand, I need to get forms (N244 & N1) from the court & pay £35 (to submit) with the particulars of claim (this info I got from the moneysavingexpert site). Do I copy & send to RBS solicitors as well as submitting to court? I have got to respond no later than 23/8/2007 or they will strike it out of court. I hope this is ok. Can anyone advise me on what to do? Thanks in advance.
