  1. It really is pointless responding to you as you obviously have little intellect, as demonstrated in your inability to read and understand my post without negative inference and even less articulate aptitude in attempting a put down in a sarcastic reply. A point I think others may have voiced (one way or another). Kindly don’t respond, I feel it hard going, dropping to your level!
  2. Hmmm, well I asked for a response, and that I have had... But to answer some points raised.... Perky... I feel a reply is justified… in response to your comments… miss founded as they are… I answer below:- You obviously were parked somewhere you should not have been. That depends on your interpretation of the Law and if you think that the charge is a "profit penalty" rather than a fair charge for a loss incurred, as the parking was free, a loss was not incured, therefore I consider it a profit penalty ! You obviously received the ticket. Duh !!! You obviously accepted you should not have been there. No I accept that a piece of paper was put on my window screen demanding a payment, I challenge their right to impose this payment as it is unjust, I see it as “a profit penalty”... I paid in ignorance of this fact, at that time; I am now in possession of more facts and wish to right a wrong! You obviously took the chance and got 'caught' One can only get "Caught" if one agrees that a wrong has been done in the first place, my argument is that I now believe they are profiteering unlawfully therefore I am now not in the wrong! This is typical of the type of post here .. not about undoing wrongs but trying every possible way to avoid paying something !!! I don’t think this is typical of the type of posts here and are somewhat aggrieved at your inference that I am trying every possible way to avoid paying it. I reiterate, I believe that it is unlawful and am within my right to challenge that, or at least the last time I checked that was the way our legal system worked. So, to clarify, I merely asked if others had been successful in their endeavours to reclaim after having wrongfully paid up! Just a general reply to the group will do, do not address it to me as I will not reply (unless it deserves one). I am thankful for small mercy’s… So, to clarify... again.... I merely asked if others had been successful in their endeavours to reclaim after having wrongfully paid up! If so have they a procedure that they followed they might wish to share… after all, that is what this forum is about…. Helping !!!!
  3. I have read all the stickys, and I must say very good advice it is too! However, a little late in my case as I was one of the unsuspecting victims who paid up …. (I won’t be caught again). So, my question is… Can I retrospectively claim my payment back from Central Ticketing (the bandits who issued the ticket), how does one go about doing that, and has anyone had any success in doing that. An idiots guide / letter would be appreciated. The Central Ticket “Parking Charge” notice attached to my windscreen I assume is standard to them and I am sure the knowledgeable people from this forum will be familiar with the terms and conditions of their tickets.
  4. I used to have a credit card (Midland bank one, pre HSBC one) going back to the late 90's, I was made redundant in 1999 and had some problems paying it, and as I remember acquired some hefty charges as a result. Anyway I eventually paid it up in 2000/2001 and then cut it up.... my questions are..... 1. I don’t know the account number.... How do I find out where and who to write to for my old credit card account number? 2. Can I still claim as it was over 6 years ago? 3. If so, whom do I ask for old statements etc as I don’t have any? Thanks... In anticipation !
  5. OK, letter done and sent, will keep you updated on the progress. Thanks for your help.
  6. Hi Castlebest, Thanks for the quick response, (must be a night owl - like myself). As a newbie, can I ask the reason as to why it is recomend one does not add the statutory interest untill the claim is filed with the court? Can it hurt the claim? My reasoning was that if they do make an offer before the court papers are filed ,you have already included a negotiating / barganing amount... If you get my drift. I will check my credit score... thanks for that!
  7. Thanks for the advise..... OK, I have printed all the statements and calculated the charges owed..... Now I am going to send the letter of claim, but have changed it slightly to:- a) try and include intrest on the charges at 8% and b) I am unsure if they have entered a default on my credit record.... (relevent changes to letter below.... appreciate your comments before I post) Frogster What I require I calculate that you have taken £641.63 in charges, fees and interest levied on my account. In addition, I also calculate that I am also out of pocket to the sum of £212.18 calculated as what is considered by the courts as a fair interest (8% APR) on the amount you have unlawfully taken. This makes a total of £853.81 I enclose a full schedule of the charges detailed above which I am claiming with this letter. Additionally you may have entered a default notice against my credit record. If so, this default would have occurred merely in respect of unlawful charges levied by you or as the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. In addition to full payment of the sum mentioned above, I require that you check and remove any such default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable.
  8. Hi all, I have just started on the journey to reclaim bank charges, and have sent the letter below to ask for all details to be sent to me…. However, after spending all day reading the forum here, I am still left with a feeling of ignorance as to the terminology used…. I.e. what is a DG? Is there a list of abbreviations I can easily refer to? Thanks Frogster….. (my letter to HSBC follows, comments welcome). Dear Sir or Madam, Re. Account number: xxxxxxxx I am writing to request a fully comprehensive list of all the default charges for direct debit, unauthorised overdrafts and standing orders that I have paid during the entirety of my account history with your organisation. I understand that under the terms of the Data Protection Act 1998, you are obliged to keep data on file for 6 years so I expect to receive at least 6 years data. However, if you hold data beyond 6 years, under the above act, you must supply it on demand. If you no longer hold data beyond 6 years, I would like a signed declaration from your data controller and a copy of all documents pertaining to its proper disposal. If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form. I would also like a schedule of all charges & interest applied to my account(s) including details of any instances that required manual intervention. Please include details of all transactions, and a copy of the original contract by which this account is/was governed including all amendments made to the contract terms since opening the account. Please find enclosed a cheque for the maximum statutory charge of £10. If you are unable to provide this data in the format requested, I will accept a copy of my statements going back at least six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law. I look forward to your response within 40 days, as HSBC is obliged to reply under the Data Protection Act 1998. If not I shall seek remedy from the Information Commissioner. Yours faithfully,
  9. My first post here Just wanted to say Hi, well done to parkvale, and thanks for giving me the incentive to start this…. I am sure my claim will be for a much much smaller amount, maybe only into the £100s, but I intend to fight to the death…. have sent off my first letter asking for all details of my account history today. Once again… Well done Parkvale !!!
