  1. If they made you the offer before 27th July ( i.e before the OFT served papers about the impending cout case ) then they "will" or "should" still honour the offer they made to you. So i say get chasing them up on the phone. Looks like you've won !
  2. I am starting the ball rolling with helping my mum reclaim her Bank Charges and was just wondering a few things please ? I have already claimed against BOS for myself and was successful but now i'm dealing with another bank : 1/ Which is the best address to send a letter requesting 5 years statements to and is there a template letter on here i can use ? 2/ Or is there a phone no. i can get my mum to phone and request the 5 years statements ? 3/ Will my mum still require to pay £10 for this service as i had to with the BOS ? All help will be much apprecaited and thank you !
  3. I recieved a letter from the BOS dated "24th July" : Dear Mr Forrest, Thank you for your letter dated 12 July 2007 about the charges which have been applied to your account. I am sorry you are still unhappy but i hope i may be able to help. As prevoiusly explained when you opened yuor account you agreed to our terms and conditions......... blah, blah, blah. I have reviewed your account carefully, and i am satisfied that the charges were correctly applied. However, we do value our relationship with you so i am pleased to tell you that on this occasion as a gesture of goodwill, i am arranging for a payment of £447.00 to be made to you. Please not that this does not mean that we believe we are under any legal obligation to do so. Finally i would like to explain what accepting my offer means to you. This offer is a goodwill gesture and is in full and final settlement of your complaint against Bank Of Scotland. To accept this payment you do not need to take any further action as the payment will be credited to your account within the next 14 days. If you do not wish to accept our offer, please return this payment and contact me on the above number. Blah, blah, blah.........Financial Ombudsman stuff. Yours sincerely ****************** Customer Relations Manager Now i believe that the payment will still go ahead into my account because my letter is dated before the OFT dealt the papers to the banks, etc. In the letter it states that this is a "FULL AND FINAL SETTLEMENT". I know i can reject it and go for the full amount of £1000 but i do really, really could do with the £450 ( 50% ) right now to get my car back on the road to get to work easier. So if i phoned them and said i will accept it as part payment and said i will be reclaiming the remaonder at a later date do you think they would agree to this. OR If i phoned and said i would settle for 75% = £670.50 and made it clear if they wouldn't i was willing to wait until the test case is resolved do you think they would be open to this idea. I would just like everyones thoughts on what to do because i have read on the CAG that when people have phoned then sometimes depending on who you talk to they will settle, etc ! Thanks for your help ( If only the bank hadn't p*ssed me about i would have already had the full amount ! )
  4. I hope someone on here still decides to try and take The BOS to court and the court allows it to go ahead and they win. It would be good because then everyone else would continue. They say it's going to be a year........the dirty b**tards ! Not happy at all with this. :-x :-x :-x

  7. Can you direct me towards the correct thread for filling in a SUMMARY CAUSE SUMMONS in "SCOTLAND" just so as i have it all prepared and ready to take it to the court, etc and just for general information on how to do it. This would be much appreciated. Thank you !
  8. They'll probably try to just fob me off with 51% = £500 but i will not accept that because of the knowledge i've gained from this superb site on past cases, etc, he, he ! If they do make me a derisary "OFFER" then i shall be phoning them up just to say i'm not accepting it and if i could speak to someone ( hopefully sensible ) who would like to discuss the matter further and perhaps make me a better offer - at this point i state that i want the full amount or it's off to SUMMARY CAUSE we go, :grin: , ole, ole, ole !
  9. Phoned up Bank Of Scotland today ( Wed 18th ) just to see if they had acknowledged my letter and get a general overview of the situation. They had recieved my letter by fax from me but hadn't scanned it into the computer and taken a note of my refusal that they weren't giving me anything and that i was willing to take the matter further and go to court. The woman was very, very helpful and was wanting to help me. She sorted it out and now it's been passed up the chain to a supervisor to sort out. She says that now i should recieve an "offer" which means i'm at least moving along nicely. BUT i don't want an offer, i want the entire amount please BOS. Keep you's updated..... ( I advise everyone to FAX your letters etc via your local branch cos then you get a receipt and a few days after you've done it to phone them and hassle them, it works beautifully ) !
  10. Is the N1 when you are going to start court proceedings ? That's correct is it not ?
  11. History so far : 15th April 07 - Sent £10 Postal Order with letter requesting 5 years charges details to Data Prot. Dept ( Halifax, Trinity Rd, England ) 27th May 07 - 42 days after and still no statements or charges details ! 28th May 07 - Phoned them up and started to complain ! 7th June 07 - Only got 3 years charges deatils due to " THE MERGER " - utter bull**** ! 8th June - Complained again ! 15th June - Phoned up and complained again, low and behold - 7 days later i got the other 2 years in statements ! 29th June - Faxed my letter requesting 5 years charges and 8% interest - £1013 to the bank charges Dept via my local branch, ha, ha ! 12th July - Recieved letter saying NO and that their charges were fair ! 13th July - Phoned and complained, said i was taking them to court ! The guy said his team would review it over the next 3 weeks ! I said no i will be sending you a letter giving you 7 days to reply or i will start court proceedings ( Soon shut him up ) Just waiting for a reply now............... keep yous updated ! :grin:
  12. Another quick question if anyone can help please ? It seems to me by reading the succesfull claims part of the forums that some people are having success going throught the financial ombusman service route ! What would you advise to be the quickest way to get my hands on my money ? And if i was th got the FOS route how do i go about it i.e phone call, e-mail, fax ? This site is pure helpful, cool as 8) !
  13. Thank you very much for your help ! Now i know that all i have to do is go to the SUMMARY CAUSE COURT when i get the next letter stating that they won't give me anything ! I only gave them 7 days to reply to my letter stating that i was going to take them to court. Why should i stick to their timetable, they can bloody well stick to mine !

I recieved a letter from Bank Of Scotland stating that they think the charges are fair and that i wouldn't be getting my £1000 back so now I have sent away a letter stating that i am going to start court proceedings if they do not reply in the next 7 days. I faxed them the letter telling them of my intentions on the 12th July 2007 so hopefully i'll get a reply within the next 7 days if they stick to MY timetable. I'm from Scotland so was just wondering if anyone could help me with info about actually starting my court proceedings ( Cost, etc ), i know the internet site to start it from etc but was just also wondering from the date i start the court proceedings when the bank should actually settle. And if i do have to go to court how prepared evidence wise i should be ? Plus is the Maximum small claims court in Scotland £750 ? Any info would be great ? Thank you everyone !
