  1. Had my case stayed today as well. The Judge brought up the case in Hull where the claimant lost even though Lloyds didn't turn up and won using a written defence. Basically what he was saying was that the OFT case is a good thing because if you aren't able to win a case when the other sides lawyer doesn't turn up how can a case which has the full weight of the OFT's big brain lawyers, be a bad thing. Also beware, a lot of bank lawyers are using the argument that it's in the claimant benifit to wait till the OFT case in Jan as they'll earn more intrest that way. The Jusge seem quite taken by this argument Anyhow mine was in the Brentford county court, anyone else been 'stayed' there recently?

Made a bit of a cock-up here On the 20 August the Brentford County Court sent notice that my case was due to be heard on the 17th September (although I received this actual notice a few days later) I sent my court bundle to the court but forgot to send a copy to SC&M. Nothing sinister, I was so stressed out putting everything in my bundle that I clean forgot to send a copy to them. I'm now outside of the 14 day window (from the 20 August date). To be fair SC&M did not send anything to me either during that period. Now I've received a standard letter for a stay of my case from SC&M which they've requested from the court. Should I submit a letter asking for the case not to be stayed and send my bundle through now to SC&M or should I just submit the letter, not send the bundle and if its agreed, hope they don't turn up in court and the judge finds in my favour Would be grateful for the advice as technically I guess me and LLoyds are at fault.

  4. Hi guys I want to make sure I put in everything spot on, that has been set out in the Witness statement which is linked at the beginning of the Thread. Point 50 of the witness statement goes:- "50. The Competition Commission Report Northern Ireland Competition Commission report from October 2006 [exhibit ***] revealed that figures contributed by eight banks, including the Defendant, Abbey Plc, showed that around 12% of the banks...." I've looked in the advance bundle but can't seem to find a link to this report. Does anyone know where I can find this and post a link to it please? Also I'm having trouble finding Charges leaflet in the Lloyds TSB section of the T&C's library which is needed for , point 12 of the witness statement (the Contract terms section) vi) From the Defendant’s current published Charges leaflet [exhibit ***] which forms part of the Terms of the Account; “If you go overdrawn without agreeing this with us we Charge a higher rate of interest for unauthorised borrowing …We will also Charge you a fee for any unauthorised borrowing…. If anybody knows where this is, would also be really grateful, pretty much have everything else printed and ready to submit as a bundle and would really like to be a thorough and get every exhibit in thanks in advance:)

  6. a) the court - Brentford County Court b) the date – 17 September 2007 (and they say it should take no longer than 30 mins) c) the directions – Basically word for word what was issued in the draft order of directions that I attached with my AQ (I copied these directions from the following link on the cag site - http://www.consumeractiongroup.co.uk/forum/lloyds-bank/82148-got-court-date-important.html ) d) the date the bundle has to be submitted – 3rd August Wish me luck!

Hi there I’m just getting ready to file my N1 claim form against Lloyds TSB Used the spreadsheet on MSE to calculate what interest I was owed under the s.69 act However in the CAG template for filling out the N1 form (under the Particulars Of Claim section) I’m a bit confused in filling out the following section c) The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year, from [date when the money became owed to you] to [the date you are issuing the claim] of £ [amount] and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of [enter the daily rate of interest] My questions are:- [date when the money became owed to you] – for this bit do I put in the date the first charge was taken out? [the date you are issuing the claim] – this date I guess is when you hand in your claim to the court [amount] – is this just the bank charges total without any interest added [enter the daily rate of interest] – not sure what this is? Is it just the daily equivalent of the 8% daily rate These answers are probably really simple and I feel like a fool for asking at such an early stage, but you don’t ask you don’t get right!
