  2. Hi there, I am currently waiting for a court date, have written a response to Cobbetts and Court explaining refusal to reply to CPR 18 request. However, have a received an standard letter from Higley with an offer from Natwest for the exact sum of my charges. It has a tick box option and a place to sign. But I am required to accept it as a full and final settlement. This will prevent me from claiming future charges won't it? What am I legally required to do? Do I have to contact Court and let them know? Obviously, I want to get the full amount - the Court fee at least, and preferably interest on top. What is the best course of action??

  4. GRRRR. Got all three charges refunded. Only for the next day, for a mysterious cheque for exactly the same amount to be taken out the following day. What are they playing at?! I don't even have a cheque book with this account. I called them up, two days ago, and asked them to explain what was going on. They had no idea, and said they would call me back. They never did. I am seriously pi**ed off.

  6. After rediculous letter from Natwest CC department, LBA sent recorded delivery today. Bring it on!
  7. After standard letter received from Natwest, LBA sent yesterday. 14 days and counting!
  8. Result. £30 refunded. But admission of guilt? No way!! Pains taken to re-iterate, and explanation that this is a 'good-will gesture.' Yeah yeah yeah. Anyway, victory for the dick man. Very pleased. Email follows: Love the bit about telling me that no one forced me to join cahoot, and i am welcome to go elsewhere! ha ha. Victory, nonetheless. Still battling Natwest tho!
  9. Standard letter from customer relations received day before yesterday. Think I might be acruing another charge tomorrow. So will need to update my repayment request with my LBA, I suspect. Letter as follows: Ten business days, eh? Quickly and effectively? Ahem.

  13. Preliminary approach for repayment of charges sent to Natwest Credit Card Operations today. Only been charged £40, but I want it back! Haven't asked for a DPA. Surely I don't need this? I know exactly how much I have been charged i.e. £40.

  15. Sorry folks, been so busy. Can't wait 'til this PGCE is over. Right - to bring you up to speed, nothing major has happened since last post apart from another secure white envelope arrived with more statements. The joint fruit of a DPA request and a separate statement request means that I have a complete set of statements for my account, and I know my total = £581. I believe that the statements I now have are the result of the statement request rather than the DPA request, so I am writing to Natwest (preliminary approach for repayment) with a paragraph reminding them to honour the DPA request. They haven't given me any notes on manual intervention etc, so surely this is not a 'complete' DPA so I can register a complaint with the Information Commisioner after 40 days, right? The other thing is, since I have a complete set, how do I go about proving that they are indeed not the result of the DPA request, but the result of two phonecalls and an extra £5? So... with all that in mind, I was going to deliver the following to my local branch today. Any thoughts? The italics in blue are the main alterations to the template letter... let me know your thoughts, if you'd be so kind. Ta! Oh - ALSO - I am starting a separate claim for Natwest credit card. Should I start a new thread?
  16. Ok. This morning... Another set of statements arrive in post - in brown tatty holey envelope. A further set going as far back as 2002 - which I don't need as I already have them! GRRR. Waste of paper etc etc etc Along with this, a white and secure envelope with statements going back as far as December 2001. My maths isn't brilliant, but surely I should be getting statements as far back as May 2000?
  17. DPA cheque cashed on the 18th. Progress, it seems. Still awaiting second batch of statements. For those of you interested in Peter Ismali... I haven't yet had the time to call him. Will give him a bell on Monday, and let you know!
  18. Just spoke to Stacey, who was apologetic and helpful. I probably wasn't as 'stern' as I could have been, however! Put me on a stage, and I'm unstoppable;I am nonetheless crap at acting in real life!! ANYway... Stacey has no idea why the statements haven't arrived. She has ordered them to be sent to me, suggesting they will arrive in the next 7-10 days. She also gives away that a note has been placed on my account that a copy of my statements should be sent to 'Peter Ismali at Customer Relations'. I question her, asking why on earth someone else should have access to my statements - especially as I have yet to receive them in full, having paid for them. She does not know why they will be sent to Peter and suggests I call Customer Relations on 0800 0154212 to find out. He will receive them for one of two reasons... (I presume): 1) he is dealing with my DPA request (fair enough) 2) he is sussing me out, anticipating a claim (unlikely, surely? even so, legal?) Hmmm...
  19. Still no sign of second consignment of statements (i.e all those prior to system change in 2002). Anyone know how long I should leave it before concluding that they might not be sending them at all?
  20. I certainly will be complaining. Disappointed it wasn't tattier and holier, however... as I was kind of looking forward to creating a real stink if they arrived incomplete. I certainly have been reading around. Much better than asking the same question asked and answered elsewhere, over and over again!! Actually - I could be about to go entirely against what I've just said... Does anyone know (one of the moderators perhaps, or someone who has a really good birds-eye-view of the site) if, with my subtotal, as it stands(£581) whether Natwest will repay me at the last minute or defend the claim? I have looked at a few of the longer threads, and seen that when it enters the thousands, they often defend... but with less money at stake, are they likely to let it go at the last minute and back down? I suppose I could have a good look through the site, but alack, I have wasted the weekend away, and now have a frightening number of lessons to plan for this week!! Ta.
  21. Same day as DPA delivered in person to bank manager, I called up Natwest and requested my six years worth of statements. Friday - they arrive, in a holey, tatty brown envelope. But this seems to be common, according to other threads. Presumably they are hoping that, by sending them like this, some will get lost and claims will be delayed? Anyway, only got statements as far back as 2002. But I also understand, from other threads, a second batch will follow according to a system-change. Charges subtotal: £581. I eagerly await the next batch!
