    as part of our research on outstanding debt to put together an income and expenditure form for StepChange, we requested a Noodle report and on it there was a CCJ which we have now discovered id Moriarty law for an Uncle Buck debt.

     

    In the letter it states that an instalment plan had been offered to us which it hadn't and i assume that before a CCJ gets registered we should have received some communication from the court which we didn't.

     

    Don't really know where to go from here as we are trying to pull together a plan but it's going to be blown out of the water if we are forced to make a lump sum repayment. any advice would help.

    I have had an ongoing battle with Lantern (motormile) trying to chase for an alleged Lending Stream Debt.

     

    I have provided them with a statement from Lending Stream showing a £0 balance outstanding which they have ignored and i am now receiving threat emails from Wilkin Chapman's "Lantern Team" saying they can't discuss by email due to data protection.

     

    I have sent them the same statement i have sent to Lantern and i'm certainly not calling them.

     

    Is there a templated response to an email?

    This is what they sent me

     

    "Good morning

     

    Thank you for your e-mail, we can confirm that for Data Protection reasons we are unable to discuss details of the account by e-mail without verification that you are the account holder. Please contact us on 01472 253965 or please respond confirming your full name, the first line of your address, postcode and your date of birth for confirmation.

  4. Yes. If you tell them not to call, they absolutely cannot come. They will be in breach of OFT guidance, the terms of their credit licence and potentially harassment laws.

     

    Be warned, MMF have complete disregard for the law. Thats why you need to stay strong, stand your ground and tell THEM what is going to happen. Dont let them tell you.

    I have now issued a formal complaint to the OFT and to Rob Sands. This is Harassment and is not acceptable or legal. please deal with this issue in a legitimate fashion".

  7. Get that complaint going and block that number. If they use different numbers, get those numbers recorded and use it in a complaint. You can also take legal action for harassment as you have told them not to call, they ignored you, kept calling, and even used multiple numbers.

     

    I've written the OFT complaint form and will send .... is it 100% that they cannot doorstep call - particularly after the emails expressly not wishing to make an appointment and offering email communication?

  8. Have checked credit reference files for this account? Try Noddle (Call Credit) the service if free).

     

     

    If you do so you may find this debt listed as a 'Mail Order Account' or similar one of their quirks so look at the balance and compare to what they are claiming.

     

    but am I not then going to be giving MORE personal information that the DCA will have access to by using the lists provided by these agencies? at least at the moment i'm not 100% sure they know which doorstep to go to by only communicating by email. I have had nothing at my home address from them in writing.

    We can certainly get this constant harassment stopped, it highly unlike to get passed back to WD if they have sold the debt.

     

     

    Does MMF state that is acting on behalf of Wage Day at any point or have they said they now own the debt ( the approach needed will vary).

     

    It doesn't state either way. this is the first email communication I received from them.

    TBH since my divorce 10 years ago rebuilding of my credit file is not a priority

    so i'm really not concerned if they notify credit agencies.

     

    I haven't used any form of credit for 4 years or more and don't intend to get caught up with it again.

     

    I just want to get to a stage where they pass the file back to Wage Day

    and I can make reasonable monthly payments

     

    MH jumped on the case just at the point that i was negotiating repayments with WageDay

    and the waters got so muddy with various letters and admin being generated automatically

    and contradicting each other that I COULDN'T pay back

    because MH had it in dispute and WD had it registered as out with a DCA for once nobody wanted to take my money !!

     

    just want these aggressive guys at MMF off my case

     

    as the tone of their correspondence and threats of visits continually day after day

    is a major stress when i'm trying to keep it from the kids.

I have been receiving texts and emails threatening an unannounced doorstep visit from MMF regarding an alleged debt with a payday firm from 4 years ago which remains in dispute (the amount not wether it is wed or not) I still have communication open with the original firm and no evidence that it has been passed to MMF.

     

    this is the latest couple of emails along with my response. is there anything else I could be doing?

My vehicle is due to be repossessed as a result of default on an LBL loan. my fault and lesson learned but i do need to know what happens after the repossession in order that i get the balance of monies back to me after the sale of the vehicle at auctionlink3.gif. what paperwork should the guy from DG give me when he takes the car and how will i know what it was sold for and the "true outstanding balance" on my account? :Cry:

    You state that you have received an order from your county court for the production of a statement of means, is this correct?

     

    I presume that a court claim was issued prior?

     

    Please provide more information.

    although the paperwork was from the court, it wasn't sent by them but by IND Ltd. The Court do have a record of it though as coming from Northampton Bulk

  15. thank you all. i have spoken with the court and they have suggested that i request a set aside but also to cca IND Ltd. i eventually got through to IND Ltd by phone and they are saying that its in relation to something from HSBC in 2005 so i am sending CCA. and have registered my query with the court. do i need to do anything else do you think? once again thanks for all your help guys.
