  2. Basically they have sent me a bundle of statements and my proof of signature on the initial agreement. Would an S.A.R - (Subject Access Request) just confirm all of these including the interest ? Sorry for appearing a bit dumb on these matters
  3. Is it worth sending the Subject Access Request to the company chasing the debt ?

  6. Thanks again all. OK - I will send a CCA letter off tomorrow and see what happens. This is the part that worries me slightly. I'd love to get the default off the record as I agree it is as bad as a CCJ. I'd even settle if they were to just get the default off my records.
  7. Hi Thanks all for the comments. The original debt was a M&S loan from 1998 (I moved abroad in 2000 and was away for 4 years). When I moved back in 2004, I started getting mail from Cabot and that is when my experience with them started. I have not CCA'd them so do you think i should? How does the "12 days + 1 month time limit you can stop paying until they produce the agreement" part work ? Should I state in the letter that I send that I am stopping payment until I hear from them ? My concern is that this will harm my credit record further. Thanks in advance Hipple

  9. Hi I have been making regular payments on a debt to Cabot for over 2 years now. They call every 3 months or so to ask if I want to make a final payment. I intend to do so in the next 6 months. The original debt was circa £7K and I have got this down to £3K. My problem is that they have not told any of the Credit Reference Agencies of the payments and thus it still shows as a default. This obviously has a negative effect on my rating. Any advice on what I can do to get this amended ?? Thanks Hipple
  10. Hi All Okay - I have now had a reply from Controlaccount. They have sent me a copy of the initial agreement I signed and all the subsequent bills on one of the accounts Good News - They say that one of the clients "are unable to supply documents so I have been instructed to take no further action". Does this mean I am off the hook on this one ? Bad News - the client that have provided the documents have stated that there is £3610 including interest outstatnding on the account. They say that they "look forward to receiving my proposals for settling this or my reasons if I dispute the account". I don't have the money to pay it off in one go right now and am confused as to what my next course of action should be. Looks like I won't get away with this but what should I do next ? Any advice on this is very welcome !! Thanks in advance Hipple :?

  12. Guys - thanks for your help. I received a letter from Controlaccount today. It reads as follows: "I refer to your letters to us of 26/06/07 and I would advise you that these two accounts are not subject to UK Consumer Credit Act as they are Swedish credit card accounts incurred by you when you were in Sweden. I am requesting my clients to send me full documentation of these accounts and as soon as I receive them I will send them to you though I expect this will take a few weeks. In the meantime I am retaining your POs for £2 to your credit." It then goes on to say that in future that I should send any future correspondence to a different office address than the one I used. What do you think ? Should I just sit tight now ? Cheers Hipple

  15. Hi Jeff Both letters start with "We are instructed by the above company ..." ie the Swedish companies. Will this make my CCA letter irelevant ? Apologies for my ignorance on such matters - curse of the newbie Thanks for your help (and patience!) Hipple
  16. The address of the DCA is: Controlaccount plc Westec House West Gate, Ealing W5 1YY Does the fact that its a UK based DCA make a difference ? Any advice offered to help much appreciated Hipple
  17. I had them when I lived in Sweden but I moved back 3 years ago. Do Contolaccount not own the debt now ? If I can't find the relevant law in Sweden does this mean I am buggered and have to pay ?
  18. Jeff Sorry for not replying before - been offline for a couple of days. The info you need is as follows: 2 x credit cards: one @ £1900 and the other @ £3000 They are with Swedish companies - Entercard and ICA Banken I have not made a payment on either since 2004 I have sent the CCA letters 2 days ago as instructed and wrote that I would only correspond by post. Does this info help or would anything else help the cause ? Many thanks for any advice - its much appreciated. Hipple

  20. Hello eveyone My first post ! Has anyone had any dealings with a company called Controlaccount Credit Management ? They have sent me a couple of threatening letters about defaulted credit accounts I had whilst living in Sweden 5 years ago. Can they issue legal proceedings on these accounts ? They haven't supplied any copies of the CCA on each account - only the signed application form on one. Any help or advice is much appreciated - thanks in advance.
