  1. another idea which will work, is ,if the signs do not appear to be laid correctly, ask the relevent council to provide you with the legal documentation that says that the council does not have to comply with the road traffic act apertaining to your case. of course they cant, so they will likely fold. you must obviosly do this before it gets to the NPAS stage.
  2. the interesting thing is, who were the threatening letters addressed to?-were they actually useing your name?-----if you hadnt replied,(assuming they wernt sent recorded delivery) you could just deny any knowledge of any letters, but once you respond they go for you.
  3. yes, i quite agree, but it is down to the particular ajudicator, and if he interprets things differently you have to appeal to court and from then on may start to get costly for no gauranteed results.
  4. just as an aside, here in southport there was a bay with a sign that said"coaches only 15 minutes parking" .someone parked a private car there and received a ticket which he took all the way to to NPAS and they ruled in his favour because the council had ommited the full stop after "only", implying cars were not restricted!

  6. in a recent case when i was up before the ajudicator regarding faulty display of yellow lines he did mention that worn or partly obscured lines are no defence, the lines must be wrongly laid or maintained to be unenforcible.check if they match the signs and traffic regulations also on this site , and if they differ you may have a case. good luck!
  7. you could be on a sticky wicket, on a recent case (see my note under this name) the ajudicator did say that faded lines were not permitted to be called unenforcible, but it is important to take photos and if they are REALLY badly faded/worn you may be lucky. the councils just seem to depend on the public paying up rather than contest the case. it doesnt cost anything to go all the way but the ajudicators responce is binding on both parties.
  8. i have just sucessfully won a case here in southport, when i parked for three hours on lines i considered were not enforcable citing case healeyvdavis, which the council rejected, but was unheld by the NPAS AJUDICATOR.-------------my advise is to go all the way if the yellow lines do not conform to the regulations, and take plenty of pictures. attend the hearing in person, the council will just send loads of maps and waffle.in my case, the lines were double, double for a length of 12 metres, that is, two sets of double side by side, and no T bars plus gaps where the road had been repaired.the council said the lines were enforcable under my car, but i argued that one portion cannot be legal and the rest unenforcible,in other words, the whole sign must be according to regulations to be effective.-----------all this costs nothing, so take "em all the way, and notify the local press when you are advised you were right all along!
