What is the best way to handle this problem: I have a defaulted CC and have been paying the OC on an agreed basis since the default in early 2003 A request for an increase has been made but I explained that it is not poss.They want an Income & Expenditure from me.I sent one last year(Reluctantly)I said that my circumstances have not changed since the last one and that I do not have to comply.The response was that they will reintroduce interest back into the balance. I have requested that they put in writing that they want an I&E statement.I have not requested a CCA 77/79.Should I do this at this stage or will it aggrevate them more? It seems to me to be a threat and gives them a new twist to getting info from me,and ultimately more money. I assume that they can re-introduce the interest and I would then be faced with an increasing debt.What would be my best approach here as I cannot afford more but I don't want an increase .   6. Thanks Bazooka Boo Unfortunately not I am after 1998.I have tried FSA FOS OFT BBA to no avail. I just need to clarify that in 1998 an Individual Unlimited Guarantee was not recommended or advised by the Banks. from 2002 onwards its shown as being a no no,so I must assume its so for 1998.   13. I sent my CCa request to Apex and got a quick reply,basically stating that they are referring the request back to the OC for a response.My account in the meantime is on hold. The statutory 12+2 days has now passed and I have not heard anything.Do I now send a letter in dispute or is that covered by their placing my account on hold? Do I withold payments? Thanks Stripper
  14. Thanks Kiptower and Ceberusalert. I have read and digested.Looks like I have an agreement that should not have been issued. Funnily enough,the Bank when corresponding(back in 1998-2002) only ever referred to it as a Guarantee and never Unlimited Guarantee. I didn't twig that one. Any thoughts as to what my next move should be? Thanks

I hope this is the right place to address a point that has been niggling away at me for ages.In 1998 I entered into an Unlimited Guarantee for my Company.It folded in 2002.The amount left outstanding was about £6k. There was never a DN issued and the debt was passed over to a DCA.No interest has been added and I agreed a token payment pm. I am still paying an agreed amount pm but have not heard from the DCA for over 3years.However they are taking the money. Would I be right in thinking that the Banking Code (Whatever) actually prohibits this type of Guarantee,as from what I have gleaned the Banks do not offer Unlimited Personal Guarantees (Not good practice!).I need to know how to handle this oddball. Apologies if this thread is in the wrong place,Mods please advise. Thanks Stripper

What the hell's happening here.One minute we can do something ,then on a re-read it appears not to be so.What bloody chance have we got when the 'so called' Judges can't agree on what it all really means.How the blazes can a case such as this be won and then suddenly teetering on being re-opened and possibly lost.What a total crap legal system we have,surely there must be a clear answer to this problem. Please ,someone out there give us a clue,I bet even Waksman would put a new twist on it. Stripper
