  1. When will the phone calls stop? I am now getting one everyday (running total between 15-20). Has anyone got to the end where no other contact is made or will the phone calls go on forever? I am thinking about putting a block on through BT but will that cause them to start writing letters again? I will appreciate any advice. Cheers

I realised fairly quickly that the best way to deal with their threats is to ignore everything they send to you, I tried to be reasonable in the first few weeks of contact but it made no difference. So my advice to you 'rippedofffedup' is not to respond to anything they send to you. If you have read my previous posts and all the helpful advice I have received you will realise that Excel work to a set format which involves threats of court action, bailiffs etc, and eventually (after 12 months in my case) telephone calls, (8 so far). They just hope that people will crack under the pressure, which borders on intimidation.
  3. Hi All Just a brief update I have had 3 phone calls from Graham White Solicitors one at 0930, one at 1130 and one at 1500 all on different days, all by different people. Two calls just left an "urgent" message but the third I picked up but I wouldn't talk to him. What I did notice was that the background noise was really noisy it sounded just like a call centre, I don't know if that is significant but it seamed strange to me. I rang the number back at 10pm knowing there would be no one there, the message was "you have reached the office of Cameron Petreco" I was expecting a message from Graham White Solicitors. Anyone else had this type of thing? Cheers

Hi All I received another letter from Roxburghe Debt Collectors on 5th Jan.2010, which I duly ignored but on the 20th Jan Graham White Solicitors left a message on my answer phone saying I had to ring them back urgently, which I haven't, they must have got my number from the telephone book. This is riddiculous, I am now getting grief from my family as they are worried about the amount of letters and now phone calls we are receiveing. Can the action of their solicitors be classed as harrassment? and can I do something to stop them doing so (without paying the charge). Is there a letter I can write to Excel which is basically a "put up or shut up letter" Thanks Everyone

Hi All I have received a letter (Dated 3/12/09) from Roxburghe Debt Collectors (Surrey), which reads:- "We are writing to you instead of our solicitors Graham White as the way in which you have treated this account is unacceptable. It is our intension to instruct our solicitors to commence legal action without further notice to you. In the event of judgement being entered against you we would apply to the court to enforce it by way of a warrant of execution. A warrant of execution would allow a bailiff to attend your address and remove goods for sale by public auction and in your case we would alert the court to all facts known to us including ownership of vehicles. This is your final opportunity - make payment immediately prior to legal action being taken." YOU HAVE SEVEN DAYS TO RESPOND Has anyone else received any similar letters and is this proposed action (warrant of execution) legal. I still have no intension of paying this charge, which is now back at the original amount of £60. Thanks for everyone's interest and help, it is much appreciated.
  7. Hi All Just a quick update. After a year since I was issued a parking ticket by Excel I am still receiving threats of court action, I have ignored all correspondence since Feb. 09, the last letter sent to me was by a debt collection agency,(Oct. 09) asking me to pay the original £60 or guess what? court action. You would have thought by now that they would have realised that I have no intension of paying and either take me to court or stop bothering me. I hope this helps anybody else who finds themselves in a similar position.

Hi Just recieved my 3rd response from Excel "Further to your correspondence regarding ownership of vehicle, I have been in consultation with management and have been instructed to request driver details from you. If you are not prepared to inform us of the identity of the driver, we will continue to request settlement from the vehicle owner. As we received correspondence after the stipulated date you are required to either make payment of £100 or provide us with the drivers details. Failure to comply will result in the charge increasing and eventual court action." The letter was signed by Samantha Whitham, anyone else had dealings with her? They seem fairly persistent with the driver identity, has anyone got any ideas on how I could reply back quoting any legal Acts confirming that I don't have to provide the drivers identity. Thanks once again.
  9. Thanks for all the advice Here is my next letter I refer to your previous correspondence. I have to advise you that the driver could have been any one of a number of people and I keep no records of who has driven the car on any given day. Unless you provide evidence to substantiate your claim against me I shall be unable to assist you further in this matter and I restate my denial of this claim. YF I'll keep you posted
  10. Hi Everyone I have just received a lengthy reply back to my initial responce. I won't bore everyone with the details but the gist is as follows:- "you state that you were not the driver on the day but it is the registered owner/keeper's responsibility to ensure that they know the whereabouts of their vehicle and the identity of the driver at all times, if you believe that you were not in possesion of your vehicle at the time of the contravention please provide us with the the drivers details in order for us to pursue the correct person. You are required to forward the drivers details or pay £60, if details of the driver or the payment is not received the charge will revert to £100. Failure to make payment in the allocated time may result in additional costs being incurred, through Court Action and Debt Recovery." Has anyone else had this type of reply, is it fairly standard?, I would imagine so. I am certainly not going to pay them any money, I would appreciate anyone else's comments before I compose a reply back to Excel.
  11. Thanks for all the helpfull advice I have decided to fight the penalty charge after reading the wealth of information posted. My first letter of the process was taken from bernie_the_bolt, and reads as follows:- Dear Sirs, Re: Your letter dated [dd/mmmm/yyyy] Reference[#] I acknowledge receipt of your captioned letter. It seems that you have got my details from the DVLA and I confirm I am the keeper of the vehicle in question. You need to take this matter up with the driver concerned. In the meantime I absolutely deny your claim that the amount claimed, or any amount at all, is due to you from me. Yours faithfully I await Excels standard reply and will let you know how I get on. Thanks again for everyones help.

  13. I went into George St carpark on the 8/12/08 at 21:54 drove into a carparking bay, I sat in my car recieved a call on my mobile and without going into too much detail, I had to go home. I didn't realise at the time that I had been photographed on entering and leaving the car park, I was in the car park for 22 minutes. I know that I didn,t buy a ticket, but to get a £60 penalty seems excessive, is there anyway I can fight this fine? I would appreciate any advice.
