  2. Hi! Monopoly I hope everything goes well for you! The same thing has happened to me regarding Recorded Delivery of my CCA Request also sent 30th May. RM say I have to wait until Monday to see if it turns up! but if they are not bothering to get signatures it could literaly be anywhere!! If they cannot come back with a suitable answer then I will pursue this matter as I think it is disgusting as we are paying to get a sig at the other end otherwise we would send 1st or 2nd class. I will let you know how I get on. I do hope you are feeling better in yourself and not worrying too much. kind regards minky

I have been following this thread with great interest and I think what Peter is suggesting is the way to go.... singarly they can ignore but collectively stands a better chance of someone actually dealing with this matter as it won't be as easy to ignore/hide. I can't offer anything as yet as I only sent my CCA request off 30th May. minky xx
  4. Yes it is a one page doc with T & C's on the reverse. I am probably being thick again!! but (Big hint)?? I have been trying to find out by using search terms been at it all afternoon one thread said the sigs have to be on same page as T & C can you hint if that is what you are meaning? Please! You have got my curiosity burning! lol Thanks rory I will write a letter to the second DCA informing them it is in dispute. Just a thought because I only sent the CCA request (recorded) to Westcot on 30th May and the DCA Equidebt letter is dated 29th May do you think Wescot will pass on the CCA request? or do you think It would be prudent to send the Second DCA a CCA request also or will a letter from me saying it is in dispute suffice. It is Capital Bank plc not CapitalOne sorry for the confusion. Why would it be sent to another DCA when Wescot where handling it only 2 weeks ago it doesn't make sense! is this a normal thing?   5. This is the Second one that I got yesterday also sent to my old address. Any advice as to what is going on with two DCA after me for the same debt and what I should do about it will be gratefully received.
  6. Thanks priority Done some checking and HBOS is Bank of Scotland and it is the exact same debt, same amount just a different DCA. This is the first one from a solicitor

  8. Hiya First a letter from Wescot Re: Bank of Scotland who I sent a CCA to yesterday. Now a letter from another DCA Equidebt asking for the same amount saying owed to HBOS???? You must pay this in full to Equidebt Limited by 8th June 2007. Thanks for any help.

  13. Hi I think I am getting confused is Capital Bank plc and Capital One the same? I have read that many threads they are all becoming one now.. I have attached the agreement any advice or observations will be so appreciated.. thanks again guys minky
  14. An unsigned CCA won't stand up... so try not to worry. Thanks priority I sent the cca request yesterday (thanks rory) and told them it is now in dispute ect. Can I ask your opinion ? We have the original Customer Copy of the CCA which has been signed by someone from CapBank but none of our signatures. What will happen If they turn up with the original CCA and it is signed!! In other threads people mention cutting & pasting signatures onto documents! Do you think it likely that the original could be signed and not the customer copy especially when their sig is so prominent? I am distraught over this.. I have paid over £7000 and they say I still owe nearly £5000 for a £6000 debt!!!!! surely they can't get away with that? that is double the amount of the original loan. I don't think I can handle anymore what with losing my home and now this! Just saying that has brought another question if it is included in my husbands bankruptcy! they are selling our house to pay off the debtors so they will get a proportion of that as well? I just don't know what to do or think anymore my head is spinning, The OR can't be reached until next week.. thanks again minky

  17. I have the customer copy of my loan agreement which is unsigned. If they can produce a signed copy will I still have a case. How can I tell if they have cut & pasted my signature? thanks minky

[/php] PriorityOne Thanks for the reply, when I receivend the first demand off them back in 2002, I took it to my husband who rang the Official Receiver that was dealing with his bankruptcy & she told him that because it was in joint names they had the right to ask me for payment of all the debt but it was never taken off my husbands bankruptcy. I have just thought of something else WOW! the OR has just taken control of the house and are forcing sale & the proceeds of said sale are to be split between myself & the OR.This is why when I received the demand from Wescot it felt like another nail in my coffin. Cap Bank was definately included so I am going to give OR dealing with the sale a ring cos I have been paying off the debt since 2002 @ £80 pm and I dont think it can be included in the bankruptcy if it is being paid off?? I will get back to you when I know something more. Thank you so much at least a glimmer of hope in these sad times for us & the saddest thing of all when my hubby went bankrupt (due to unforseen circumstances) we both felt guilty that we had done wrong and accepted the punishment no question asked. After the way CapBank (BOS) have treated me and subsequently finding this great site & reading others horror stories I say **** to them ....I will fight to the death lol thanks again minky

  20. Hi! I have posted before but didn't get any replies (I think I may have waffled ) so I am trying again in the hope someone can give me some advice, Please! I want to send a CCA request but not too sure who I should be sending it to. Letter received 26th May 2007 from: Nelson Guest & Partners Solicitors Re: Bank of Scotland plc We are instructed by Wescot Credit Services Ltd on behalf of the above named Client in connection with the sum outstanding. Unless payment is made to Wescot Credit Services Ltd within 7 days, legal proceedings for the recovery ect ect... I have a dilemma. This is the first contact from them through a solicitor I don't even know who Wescot Credit Services are except that they are a DCA. Should the CCA request be sent to 1) Original Debtor Capital One Bank Which is Part of the Bank of Scotland (will need to get an address for BOS) 2) Solicitors (have address) 3) Wescot Credit Services (will need to get an address) Does it mean that since the letter states the instruction is from Wescot and payment to be made to Wescot that they have bought my debt? I have been reading through the posts and seems it is quite common for DCA's to buy debts. I do have my customers copy of the original credit agreement but it is not signed by either myself or my husband the only signature is Capital One (Bank of Scotland).... Please! Please! someone take pity and reply I am worrying myself sick over this. many thanks in advance minky
  21. Rory is quite right If it is your husbands debt they cannot touch your share but can and will if equity becomes available take your husbands share to pay off his creditors. I would consider approaching them to try & negotiate otherwise it will hinder you from moving or remortgaging. Just been through all this with my husbands bankruptcy.
