  1. Is there any one who can help with this at all?
  2. Hi there, I have a claim in to RBS for £5.3k and have been offered £3.7k. I am looking to say to them that I will accept £5k, paying off my £800 o/d with that amount, and closing my account, in order to prevent court proceedings. (I have also been charged a further £200 since then and the way things are for me, that will snowball!) Can anyone tell me if that is unwise or is there any thing else I can do? Also, if that's wise, can you fit it into the template attached? Thanks Malc Date BANK NAME Address Address Postcode Re: Account number XXXXXXXX Response to settlement offer. Dear [named sender or Sirs] Thank you for your letter dated xx/xx/xx I respectfully decline your offer of settlement and request, one final time, that you return to me all charges imposed on this account, totalling £xxxx In order to avoid Litigation against you, I am prepared to temporarily accept the sum offered as partial settlement on the clear understanding that the remainder is paid within the next 10 days. Failure to comply with this request will result in legal action against you for full recovery, as detailed in my Letter Before Action. If you do not accept my conditions for acceptance, or you do not respond within 10 days, I shall return the payment to you. For the avoidance of doubt, I wish to stress that I do not accept your offer under the terms stated in your letter. (If the bank have credited your account, please use this note in place of the above paragraph) If you do not accept my conditions for acceptance, or you do not respond within 10 days, the money transfered to my account should not be viewed as my acceptance and I hereby authorise you to remove this sum accordingly. I trust this clarifies my position. Yours faithfully [signature] [print name]
  3. Thank very mcuh. I know a lot of these questions are repeats, but it's sometimes hard to refer back when you need an enswer yourself! Thanks again.
  4. Hi folks, I've had an offer from RBS of £3700 from a £5300 claim. I'm obviously keen to receive the £3.7k but would be looking to get the full amount. How do I go about this? The FOS have been helping me also.
  5. Hi Folks, I have a claim I am going to take to court after insessent delaying tactics by RBS over 5.5k of charges. I can't go through the small claims court unless I change my address to Eng, and reduce the amount I am claiming. I have read that I can use the Financial O'man to carry out the work for free and with no limit. Is an increased timescale the only down side to this? Is there any other reason I shouldn't take this route? Thanks Malc
  6. Thanks very much, I've passed on your advice and we're going to follow on as you suggest.
  7. Hi folks, Just need some help with the claim system! I am now living in England having previously lived in England. I am claiming over £5k from the RBS, and have been using my previous address, however I see on the CAG site, that I shouldn't claim over £750 in Scotland. Sould I claim with my Eng address? My brother is still living in Sco and needs to claim 2k, should he not bother? Thanks Malcolm
