  1. Ok - Time has run out for Nasty West, has been for over a week. But Ive been too busy and skint to file. Looks like this might be just as well as there now seems to be an issue with claiming CI on the grounds of mutuality and reciprocity. I was looking into whether to go the MCOL route or N1, purely down to the lack of space on MCOL and the fact I was claiming CI - I had opted for N1 (unfortunate, cos my finances would be so much healthier if i could pay by card on MCOL). Now unsure whether to drop CI and go MCOL with just statutory 8% s69 or amend wording as suggested in this thread http://www.consumeractiongroup.co.uk/forum/halifax-bank-bank-scotland/97691-contractual-interest-precedent-lost-8.html and use the - if the court does not agree with CI at unauthorised borrowing rate then I claim 8% as per section 69. Hedgey??
  2. Finally received some statements (only 6 years worth). Done my sums, and from the statements received, my charges account for almost the whole of my overdraft (if I include the interest paid on those charges the total accounts for more than my OD). I am not happy about them forcibly reducing my overdraft, especially as I now know that is is entirely due to unlawful charges, I feel that it is unjust, and that they are only doing this because I am making a claim.
  3. I have just received a letter from NW and they are reducing my O/D by 250 because i have gone over the limit a couple of times recently. I still have not received my statements mind you, only on day 26/40..

  11. OK - checked back with FAQ, still need to wait out the 14 days.. LBA going off on 4th June... Its only a week monday.. seems sooooooo far away lol
  12. Just received letter stating they are currently considering my claim and anticipate they will be in a position to respond in 6-7 weeks..... As they have not entered into a sincere dialogue is it straight onto the LBA now... or do I need to wait 14 days...

Cheeky gits.... rather than signing and resending my original letter, I used the preliminary letter from above, and sent them a new cheque (just to be sure they could not complain about the payee) I only resent the preliminary letter on the 21st and just phoned Natwest to cancel the original £10 chq to nationwide.... Only to find Nationwide have already cashed it on the 04/05.. 14 days BEFORE they returned my request!!
