  1. Thanks. I followed the letter templates (ish, I personalised them a bit owing to individual circumstance), and then used the N1 template.

  4. Lloyds TSB did not respond, so I've just filed requesting a default judgement. What happens now?
  5. The bit I don't understand is how long do they have to file a defence. Is it 28 days from the date they were served the paperwork (deemed served 19th May), or 28 days from when they acknowledged service (2nd June) or 28 days from the date of the court paperwork telling me they intended to contest (4th June) Sorry to sound stupid, but I don't want to be phoning the court too early, but neither do I want to give them any longer than they're allowed!
  6. OK, my husband and I are claiming charges on each of our LTSB Classic Visa cards, and our joint bank account. We are still waiting for my husband's statements, and we only just received the bank account ones over the weekend; so those are at the 'letters to and fro' stage. I filed MCOL for my credit card on 13th May, and I would have put in a request for a default judgement tomorrow, but they have acknowledged today. What happens now? Anyone in a similar situation? I'm not too worried if I lose this one, as it's only £175, but I don't want to make a mistake with the bank account, as that's around £1800!
  7. Well, it's only £45, but that's 2 wins now, and a partial win (Capital One paid off my balance, but I'm disputing the other £250!), I'm now gearing up for the big £1800 showdown with LTSB. Only got my statements yesterday, 1st letter is in my bag ready to post! One month they charged me £270 for bouncing DDs. You know how it works. You bounce 1 because your wages go in a day late, and they hit you with £35 dd charge, then £25 unauthorised O/D charge, then it spirals for the rest of the month!
  8. £45 - full amount of charges refunded without even asking! I sent SAR request, and they wrote back and offered all charges refunded!
  9. After LBA, GE Capital offered all charges (but not interest) back. I've accepted - a total of £96.
  10. I'm just about to file Capital One. Would you reccomend using Moneyclaim or the old-fashioned way? As your case seems to mirror mine, any advice on the claim stage would be extremely valuable!

  12. First and foremost, I would like to thank all the posters here for their invaluable help. I have been reading with interest a lot of the threads, and learning a lot! I have 2 questions I can't seem to find the answers to, though. Firstly, my husband and I each have a credit card with Lloyds TSB, and a joint account. Owing to the way the bank has dealt with our requests for lists of charges, I have sent off an LBA for my credit card, I am waiting for a first response to my request for returned charges for my husband's credit card, and I am still waiting for copy statements on our bank account. Should I start court proceedings for my credit card, or should I wait for the joint account results and persue them as one action? Does each account need to go to court as a separate case? Secondly, I have been offered 'goodwill payments' by 2 of my old credit cards. One has automatically removed this figure from my balance, although I have told them in writing that I still intend to persue the matter and that I do not accept their settlement. The other has written, offering me about 30% of the amount in dispute. As the account is closed, they have told me that they are sending a cheque for this amount. What is the best way of dealing with this? Do I return the cheque, or do I write and tell them that I do not accept their settlement, and any payment they choose to send will be considered a partial settlement? Any help you can provide will be greatly appreciated.
