  1. Having claimed and won against Lloyds should I now start with the Yorkshire bank given the case by the OFT?
  2. How so very strange LLoyds TSB are. I rang phonebank for a balance to be told my account was 4000 in credit. Yes you guessed it they paid out on my claim. The strangest thing is I only got Judgement 8th August and I was just contemplating my next step. Didn't even have to enforce it. Now all you other guys need to do is get the court to lose the defence of the defendant then get Lloyds ineptitude at sending a copy of the defence to the court and hey presto 7 days later get paid out. Even with a moritorium on paying out. My strange story comes to an end on a high and my donation is on its way. Thanks you all
  3. Filled in a form N225 for Judgement by default. Got a letter today saying With ref to your recent request for Judgement, please be advised that this was entered on 08/08/07 for £4000, payment forthwith. Do I need to do something else now?
  4. Ok Rang court today and they said one extra day as the 19th day was a Saturday. They also said I could claim default tomorrow if no defence is submitted. I thought I had seen somewhere on the site that getting default was not the panacea it is made out to be. So before I ring the court again 31st July can someone tell me if I should go for judgement by default.
  5. I was right someone is taking the p***. I got a letter from Mcol today saying "we have received a defence from the defendant but unfortunately we have misplaced this. In order for us to transfer it out we need a copy of the defence. The defendant has been given 19 days from the 9/7/7 to respond. Is this what I can come to expect from the British Judicial System or is this a way the court can give LTSB a few more days to submit a defence? To say I am annoyed is an understatement.
  6. OK So I rang them last Monday and still have nothing from MCOL or local court. Am I just impatient or is someone taking the P***.
  7. Spoke to MCOL They didn't know why I had received nothing and were going to look into it for me. Am I the first that MCOL have forgotten about?
  8. Defence shows on MCOL dated 30/04/07. Been waiting for transfer to local court. Not heard anything and wondering if its got lost in the post or back log of claims.
  9. 28 days ran out on 15/06/07. It is now 03/07/07. Should I contact MCOL, Local Court, or wait?
  10. So how long is it likely to take before the court gets in touch. Is it likely to be months rather than weeks, rather than days.

  13. Thanks for all the support you guys are giving its awesome The missus raised a question today that I can't find an answer for but think I know what the answer should be. She said do I need to attend the court on the 18th to win by default. I thought I didn't as we havent been allocated a court date due to it not getting that far yet. Am I right or is she right?
  14. I cancelled my car insurance with NU Direct mid term and ended up with a cancellation charge of £46.50. Is there any scope for using the The Unfair Terms in Consumer Contracts to claim this charge is "excessive" and "A standard term is unfair if it creates a significant imbalance in the parties’ rights under the contract, to the detriment of the consumer, contrary to the requirement of good faith." My basis is running along the lines of I didnt know about the charge when I started the insurance on the phone I was not informed of the charge prior to commencement of insurance. I was unable to negotiate the charge prior to the contract. What can it really cost a company to cancel my policy? Can I claim £46.50 from them if they cancel my policy? I sent their debt collector a letter stating the Act and copied in NU at the same time. Have I dreamt reading somewhere that the above Act does not apply to insurance contracts? What do you reckon my chances are of getting them to withdraw the charge?

  16. Guys & Gals New today with a very quick question. I served the bank with MCOL 5th May but used a service address of the responder with the "bog off" letter. I trust there is no specific address for service with Lloyds and hope my case is not damaged by incorrect service of the claim? The address used was some service centre in Andover, Hampshire. Thanks
