  1. Why do you haveto respond in such a patronising manner? Of course i dont expect to be spoon fed and the whole point of posting IS to point out my mistakes to me...but there is no need to have that tone with me. Of course i realise the enormity of this excercise and I've had plenty of responses from the wonderful people here who have managed to point out my mistakes without making me feel a fool. If YOU find it too much of an 'obligation' to respond without patronising me then please dont....i think i'll take my chances that other members here will help me if they feel they can
  2. hi all, Just to confirm... now that nationwide have acknowledged my MCOL claim, i do nothing until i get the notification from court, then i send a copy of schedule of charges to their solicitors? thanks
  3. I'm sorry if my misunderstanding of this is so incredulous to you but i am new to all this and some things are difficult for a novice like me, to get my head around. I obviously don't have the insight to these matters as you do..but thankyou for making me feel i little bit more stupid about it now!
  4. 27/2/07 requested SAR 29/3/07 received statements 4/4/07 PL requesting £208 plus 38.77 stat int 5/5/07 received letter saying..no sorry but heres a goodwil gesture of £48 5/5/07 sent letter back sayin no thanks i want full amount by 19/5/07 or i'm taking you to court! 19/5/07 receved 2 letters one saying 'we are nor refunding the £1200 charges' dunno where that came from! and another saying 'sorry you wont accept £48 goodwill gesture" not sure what thats all about with the £1200! 21/5/07 issued claim with MCOL 21/5/07 sent scedule of charges x2 to court for attaching to my claim

I know i've done this correctly now but my confusion is with MBNA and CAP 1 MCOL applictions....I requested O/D int with both of these in my PL and LBA (i didn't with nationwide until i started MCOL) so according to the guidance notes on here below... ...return of the amounts debited of £XXXX; - This is the total of your charges, plus the overdraft interest if you are reclaiming these. ...S.69 County Courts Act of 8% - £xxx - This is the total of the 8% interest calculated by the spreadsheets on our site. Enter the total at the date of the court claim. i put the total amount plus o/d int in the first bit then added on another 8% to the first amount in the second bit in th POC for mbna and cap 1 have i misunderstood the above notes?
  6. 24/2/07 request S.A.R - (Subject Access Request) (received statements within 40 days sent special delivery) 4/4/07 sent letter to nationwide requesting payment of £721 (without interest added) 15/4/07 received letter back saying ...eh...na (dated 13/4/07) 30/4/07 sent LBA to respond within 14 days 16/05/07 claim issued MCOL this time i added the statutory interest for each charge so total claim is now £981.86 plus court costs of £80.00. (claim will be served on 21/5/07 they have until 4/6/07 to respond) 16/5/07 posted 2 schedules of charges with the template letter to court to attach to claim and send with claim when served to nationwide 17/5/07 received another letter from nationwide saying sorry but we still not giving you your money. Really..didn't see that coming.... update 21/5/07 claim has been acknowledged by nationwide (very quick!) i assume i now wait til i have received the notice of acknowledgement from the courts then i send schedule of charges to nationwide solicitors?

I've just realised i've made a mistake on my nationwide MCOL POC! for the amount debited in the POC i put the total of charges without the 8% interest and in the next bit i just put the interest for the charges upto the date of the claim. I realsie now i should have put the total of both amounts in the first bit then added the extra 8%! Can i amend the claim? its due to be served tomotrrow i think pls advise!
  8. I've just checked details of my claim, if i can just tell you what i've done...hope i haven't buggered it up. With the nationwide POC on the ...return of the amounts debited..i put £721.. this is the amount of charges without adding the 8% interest then on the next bit where it says 8% interest i put £260.86 whcih is 8% interest upto date of claim for all the charges. I never put in the grand total on POC just the 2 seperate amounts. Except where it says amount claimed the grand total is there(grand total is 981.86) On the attached schedule of charges it shows each individual charge, what its for, then statutory interest for each charge, then total amount at bottom. this is all the same as whats on the POC. I believe the mistake i made was i should have put toital amount debited at 981.86 then added on a further 8% interest on the POC..is that right? Please tell me i haven't mucked it up! I've also claimed for MBNA but in total amount debited on POC i put charges plus interest then added on the further 8% but the schedule of charges just shows the charges and 8% interest on charges. Not the court amount of 8% Which is the right way?
  9. after filing my claim through MCOL i sent a copy of my schedule of charges to the court but just realised i put the amount on the letter without adding the 8% interest which was on the POC. have i buggered it up? will they take the amount on the POC as being the amount or the letter to the court? should i send another letter to the court? thanks
  10. not sure this is the right forum for this query.. this unfortunately is the norm for tax credits and as its a govenrment body, there is little or no recourse. Basically they tend to do as they like because tax credits is absically a way of getting tax relief on your income Tax credits are a scheme run by the government for people earning low income. You need to get your daughter to give them a call i would imagine. good luck

Hi all, I sent barclaycard a PL asking for £140.07 (incl stat interest) and they responded today with the usual ' no our charges are fair and transparant yada yada' but they did offer me goodwill gesture payment of £44.00. I've already prepared the refusla letter and will send on monday with LBA. However, there was a paragraph in the letter which i haven't seen before and was wondering if anyone else had seen this.. 'the credit will be reflected in your account on your next statement. however, if your account is already closed, it will be necessary for you to contact us to confirm your sort code and account number, this will enable us to process a refund to you' I haven't closed the account and there are no problems on the account that i'm aware of...balance of £100 with credit limit of £5000..so dont know what they mean by above..do you think its a threat? any comments greatly appreciated shaz
  12. If they do try and close account then i would claim again. I'm sure a complaint to the FOs will avoid and account closure. Don't get me wrong if and when i get my charges back i will be so careful that i dont get in this position again but unfortunately since i've started my claim my circumstances have changed which i wasn't expecting and to cut a long story short its made more charges on my account so i'm gutted i need to reclaim again once i have this claim out the way. If i do get my current claim back then it will pay off my overdraft so should be ok but if they try and close my account i will kick up a fuss good luck shaz

  14. thanks CJ, The list MBNA sent me did itemise the charges, albeit very simply. Its was basically my account number, date of charge, what the charge was for and amount. Would this be sufficient? or should i still go for statements incase they defend When i sent a schedule of charges to the court it was in the same format as above plus i had another column which added interest shaz
  15. I'm sure i read somewhere in a thread that the banks paid up immediately after they complained to OFT that they had paid unlawful charges? Have i got this right? If anyone has heard of this could you please advise...would it be before or after banks refuse to refund charges? Cant remember where i saw the post now! many thanks

When you start MCOL and you have already made your claim to bank with 8% statutory interest, do you recalculate interest when claiming though MCOL to be to the date of claim? will it matter if the original amount you requested to bank is then less than the amount being claimed through court because of recalculating interest? I didn't do this with MBNA claim with MCOL that i started last week, i just used the same amount of interest i calculated at start of request for payment back in april. but if i dont hear from capital one by monday i will be starting another claim through MCOL with them and will recalulate the interest to be to that date instead of when i first made my request back in april if i can thanks shaz
  20. 27/2/07 sent SAR 3/4/07 received list 4/4/07 sent initial request for £165 plus interest @ 8% totalling £191.73 (giving 14days to pay) 18/4/07 sent LBA as i hadn't heard from them giving 14 days notice 19/4/07 received a letter thanking me for communication and they are investigating..will respond by 7/5/07 11/5/07 MCOL claim issued..request for £191.73 plus £30 court costs. (served on 16/5/07, they have until 30/5/07 to respond) posted 2 copies of schedule of charges to court with covering template letter for schedule to be attached to claim when served.(very important!) 11/5/07 letter received from MBNA (dated 10/5/07) stating that charges are valid fair and enforceable but offering goodwill gesture of £83.00 to be sent within next 10 working days. did not bother responding to letter as i had already stared MCOL and they were due to be served claim on 16/5/07. well this is me so far wish me luck!
  21. o dear...has this happened then to someone because they didn't give enough time? Surely if they have already responded and said no within the timescale...the template letter sent out asks for a response before the 14 days so if they write back saying no then thats a response? i'm confused now! pls check my post (the scond one as the first one was duplicated in error!) have i done it right? ta
