  1. Hi, thanks for your replies. We owe £172k with mortgage & secured loan and the house is worth about the same, I know about buying the Beneficial Interest etc and that if OR says its worth more we'll have to pay for it, hoping not though as 3 bed detached houses are between £155 - £180k asking price in our area at the minute.
  2. Hi, im not sure which forum this needs posting on. I was issued with a Interim Charging Order on 28th March, for a CCJ by Northern Rock for the unsecured part of a together mortgage. I went bankrupt on 2nd April, so will this have been included in my debts meaning they can not now get a charging order? Also my partner (joint owner & joint ccj debtor) is going BR on 23rd April. The court hearing for Northern Rock to make the Charging Order Final is 25th April, does this mean that there is now no way they can put it on our property or can they still issue it seeing that there is only 2 days between my partner going Br and there Hearing? Should i contact the courts & NR with my letter of objection anyway stating all this or would it be best to just leave it. Im a little worried that now i am BR and have been cleared of my debt that they will still put the Charging order on. Thanks guys
  3. Hiya, this is the first time i have tried reclaiming my charges. I sent the SAR to GE for 2 accounts i have 1 Dorothy Perkins, total charges £330 and 1 Outfit £202 charges. I sent my prelim had no response then my LBA, today i have received what looks like a standard letter simply saying 'the fees you refer to in your letter have been aplied in accordance with standard t&c etc ...the OFT ruling deemed that a fee over £12.00 would be presumed to be an unreasonable amount .... They then go on to say as i gesture of good will they will refund the proportion of charges incurred over £12, £51 DP and £36 Outfit in full & final settlement. Is this just a fob off standard letter and should i carry on with the claim or should i just accept the offers. Thanx x

  5. I sent my letter with a summary of charges to Lloyds last week, i took my charges from my online statements totaling £360. Today I recieved a letter from Lloyds, basically saying thanks for getting in touch blah blah blah ... The office of fair trading has published new guidelines on credit card default charges. we'r still talking through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesnt apply to you charges as these were dealing with your request to go over your agreed overdraft limit. They are not default charges because you have not broken your agreement..... ..... I do hope you can see that we make our charging system as fair as possible and that is why I cant agree to cancel your charges...... ..... If you have not sent your £10 fee you will need to send this to the address below to obtain your statements blah blah blah .. Is this a standard letter or am I really not able to claim back my charges? The charges i calculated are for Overdraft Excess fees, and a couple of direct debit fees. Do i still have to send the £10 asking for my statements even though i have already got them from my online banking? What do I do now?
  6. hiya, long story! I had an account with hsbc which they closed about a year ago because i defaulted on a loan i had with them, which is now being dealt with by DG Solicitors. I only pay £20 a month towards it but i know I had a lot of charges on the bank account. I had a £6000 loan which i was paying fine at £150 a month but then HSBC started charging me about £130 a month in charges and i was unable to pay the loan payment as well as there charges, i went to see my bank to see if they would stop charging me because i couldnt afford to repay the loan and they suggested taking out a loan for £10000 to repay my loan and overdraft, saying it would be cheaper at £250 a month rather than my £150 plus charges, they also told me that the bank manager would only accept my loan if i took out PPI, i dont know why i agreed but i did. to cut a long story short HSBC stated issuing me with charges again on top off my aready massive loan and i could afford to pay so it was passed to DG and the account closed. Am i able to claim charges on this account, think there will be quite a lot which could go towards my loan balance which is still outstanding at about £8500, or is this going to cause me more problems?
  7. Hiya, iv just sent the letter requesting my statements for 2 accounts i have with Ge, Outfit & Dorothy Perkins. The Outfit one isnt to bad but the Dorothy Perkins have issued me with 4 default notices over the last 3 months for stuphid amounts £3.74, £2.89, £3.85 and £4.60. Can i do anything about these? I have told them i cannot afford to pay the monthly payments because i had a baby last year and have not yet returned to work. The account currently stands at £391, my limit is only £250 and i only put £180 on it the other £211 is made up of late payment charges and now a charge for going over the limit is to be put on top. Any advice would be appreciated
