  4. This morning I received a letter from Lloyds stating I was overdrawn by 37 pence !!!!! and that I will be charged £30!!!!! I called them and asked whether they will seriously charge me £30 for being over the limit by 37 pence and they said there was nothing they could do and yes I will be charged. I hate them sooooo much. My question is this. Can I close my current account and business account with them immediately and still reclaim my charges? Will they demand the O.D. immediately then or can I say I'll pay them back their O.D. once they have paid me back my unfair charges? Play the game. Any advice would be appreciated.
  5. I'm probably answering my own questions here but will certainly help others in a similar situation. Had a look at The FOS website and like alanfromderby indicates, yes they are not too happy with banks closing accounts just for claiming back charges. There's a couple of cases on the website similar to mine. Although banks have the right to choose which customers they want and don't want, they haven't got the right to close an account in retaliation for claiming back charges. You can get compensation for inconvenience but doubt you'll have the account re-opened (not that u'd want it back anyways).

  7. Thanks you. I will complain only if the closure has left a black spot on my credit rating. Do you know if closures affect peoples' credit ratings?
  8. HSBC have decided to close my account after offer. I want to know whether this will affect my credit rating. Do I order a copy of my credit history to check if it shows? If it's there, is there any way the bank can remove it? Any advice on this will be appreciated. Thanks.
  9. I don't think they'll ask you to repay everything in one go. U'll just have to carry on with your repayments religiously but don't expect them to be lenient or loan you more cash in the future.
  10. Just wanted to tell all those fighting against HSBC that they should consider opening another account. I've just received a letter from a certain Mr. Colin Langdale stating: "Pursuant to clause 12.4 in our terms and conditions, we hereby give you 30 days notice that we will be closing your account numbered xxxxxxxx on (date) and that you should please make alternative arrangements for your banking needs" "Despite not being willing to extend banking facilities beyond the above date, we wish you well in your endeavours." Very professional indeed. It should say "We will miss sucking all that money out of you with all the charges!!" So the love affair is over... so over. I've got another bank account where to transfer my banking needs but for those who haven't I suggest you get it sorted. Laters!
  11. I've had a miserable offer from Barclays. Having rejected it they state that they are sorry I will have to proceed with county court. I am going away shortly for a four week period. Is it ok to file my claim when I come back or do I have to stick to the deadlines I've quoted to the bank? I'm just worried about getting a court date when I'm out of the country.
  12. I just had a letter from Barclays today saying they're sorry I haven't accepted a partial refund as a gesture of goodwill and they're also sorry to hear I will be proceeding to County Court. I must admit, unlike HSBC, Barclays seem to leave things 'till the last minute. In their first letter they said they will respond to my prelim letter no later than 1st June and guess what? They replied with a letter dated 1st June!! If they're pushing things 'till the end so should we!! Push them 'till you squeeze your money out of 'em. If anyone is worried about going to court, I think there's more than enough backing and support on this forum. Stories of people like us taking banks to court is all over TV and radio stations. IT's NOW OR NEVER!!!
  13. I received a letter from Mr A Pretty today. Offering me £815 out of the £915 claimed. Just not to confuse those who have followed this thread, my claim actually increased between the prem letter and the letter before action due to some charges in my account hence the change from £744.53 to £915.28. In any case I am much happier with this offer and I guess I'll accept it to give my account a breather!!! It is much needed. I also walked into my branch two days ago and had a £100 charge reversed. Courtesy of the manager so I guess that's what makes me turn a blind eye to the £100 that A Pretty is not including. One question though - If I sign and accept the proposal does it mean I will never be able to claim back unlawful charges from HSBC in the future?? Finally to you All and this wonderful site I can't thank you enough. A donation will be on its way. Lookout for my Barclays thread.

Can u please have a quick look and tell me what the most important bits I can keep? Cheers 1. The Claimant has an account with the Defendant which was opened on or around August 2002. 2. The Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. 3. The Claimant wants a refund of money taken by the defendant in the way of charges over the last 4 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. 4. The Claimant has repeatedly tried to solve this issue by means of correspondence. 5. I believe that the contents of these particulars of claim are true. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}.
